{"id":247381,"date":"2021-06-20T11:44:59","date_gmt":"2021-06-20T16:44:59","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=247381"},"modified":"2021-06-18T18:12:24","modified_gmt":"2021-06-18T23:12:24","slug":"kentucky-fights-defend-abortion-ban","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/kentucky-fights-defend-abortion-ban\/","title":{"rendered":"Kentucky AG fights to defend state&#8217;s dismemberment abortion ban"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Attorney General Daniel Cameron has filed a brief before the U.S. Supreme Court to argue for his ability to defend the dismemberment abortion ban in Kentucky.<\/p>\n<p><a href=\"https:\/\/legiscan.com\/KY\/bill\/HB454\/2018\" target=\"_blank\" rel=\"noopener\">House Bill 454<\/a>, which prohibited dilation and evacuation (D&amp;E) abortions after 11 weeks, was signed into law in 2018 by then-Governor Matt Bevin. The law was struck down as unconstitutional by a district court, a ruling that was then upheld by the Sixth Circuit in June 2020, as Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/court-kentucky-dismemberment-abortion\/\" target=\"_blank\" rel=\"noopener\">previously reported<\/a>.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/g0OTkWfLEi8\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\n<\/p>\n<p>Kentucky\u2019s new Secretary of Health and Family Services, appointed by pro-abortion Governor Andy Beshear, refused to support the law, and the Sixth Circuit denied Cameron\u2019s attempt to intervene and attempt to appeal the ruling. In March 2021, the Supreme Court agreed to hear an appeal from Cameron, who is pro-life, and argued that he should be allowed to defend HB 454.<\/p>\n<p>\u201cAs a matter of Kentucky law, the final say on whether to accept a decision enjoining state law does not belong to the Secretary, but rests with Kentucky\u2019s Attorney General,\u201d Cameron argued in his <a href=\"https:\/\/ag.ky.gov\/Press%20Release%20Attachments\/20-601%20Petitioner%20Brief%20Merits.pdf\" target=\"_blank\" rel=\"noopener\">brief<\/a> to the Supreme Court.<\/p>\n<p><center><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/jgw4X7Dw_3k\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/center>&nbsp;<\/p>\n<p>Cameron is set to present his legal argument before the Supreme Court in the fall of 2021 in the case known as <em>Cameron v. EMW Women\u2019s Surgical Center<\/em>. According to <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/cameron-v-emw-womens-surgical-center-p-s-c\/\" target=\"_blank\" rel=\"noopener\">SCOTUS Blog<\/a>, the outcome of the case will decide whether the attorney general should be permitted to defend HB 454.<\/p>\n<p>Elected in 2019, Democratic Governor Andy Beshear has been consistently pro-abortion. As Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/kentucky-governor-vetoes-abortion-survivors\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>, in April 2020, Governor Beshear even vetoed Kentucky\u2019s pro-life Senate Bill 9, which would have mandated medical care for abortion survivors. The bill\u00a0also would have reclassified abortion \u2014\u00a0which is <a href=\"https:\/\/archive.liveaction.org\/news\/pro-life-replies-abortion-never-medically-necessary\/\" target=\"_blank\" rel=\"noopener\">never medically necessary<\/a> \u2014\u00a0as an elective procedure, and therefore eligible to be restricted during the pandemic. Governor Beshear also <a href=\"https:\/\/archive.liveaction.org\/news\/kentucky-governor-planned-parenthood-open-broke-laws\/\" target=\"_blank\" rel=\"noopener\">granted<\/a> Planned Parenthood a license to operate in the state, despite its years of negligence and illegal operation.<\/p>\n<p>Susan B.
