{"id":247119,"date":"2021-06-17T12:38:46","date_gmt":"2021-06-17T17:38:46","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=247119"},"modified":"2021-06-16T15:07:46","modified_gmt":"2021-06-16T20:07:46","slug":"oregon-legislature-votes-down-protections-survive-abortion","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/oregon-legislature-votes-down-protections-survive-abortion\/","title":{"rendered":"Oregon Legislature votes down protections for babies who survive abortion"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">One of the most abortion-friendly states in the nation recently upheld that reputation when both the state House and Senate voted down initiatives that would have required physicians to provide medical care to babies who survive abortion.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Born-Alive Infants Protection Act, <\/span><a href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2021R1\/Downloads\/MeasureDocument\/HB2699\/Introduced\"><span style=\"font-weight: 400;\">HB 2699<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2021R1\/Downloads\/MeasureDocument\/SB586\/Introduced\"><span style=\"font-weight: 400;\">SB586<\/span><\/a><span style=\"font-weight: 400;\">\u00a0in the Oregon House and Senate respectively, would have established a \u201ccrime for failure to exercise proper standard of care\u201d for a baby who survives an abortion. The measure required a physician to \u201cexercise the same degree of professional skill, care and diligence to preserve the life and health of the child that a reasonably diligent and conscientious health care practitioner would render to any other child born alive at the same gestational age.\u201d This wording is the same or similar to such legislation introduced federally and by a number of states.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But on June 10, the Oregon Senate voted to 18 to 11 <em>against<\/em> the Born-Alive Infant Protection Act. Just five days later, on June 15, the Oregon House rejected the measure by a vote of 37 to 22.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the proposed legislation, the maximum punishment for a physician failing to provide care would have been a five year prison sentence, $125,000 fine, or both. The measure also would have allowed civil lawsuits to be brought against medical providers \u201cfor failure to exercise proper standard of care\u201d for infants who survive abortion.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/aXTKHMrR-gA\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\n<\/p>\n<p><span style=\"font-weight: 400;\">Abortion supporters have frequently made the argument that infants are not surviving abortions, but data from the Centers for Disease Control and Prevention reveals that between 2003 and 2014, <a href=\"https:\/\/www.cdc.gov\/nchs\/health_policy\/mortality-records-mentioning-termination-of-pregnancy.htm\">at least 143 babies<\/a>\u00a0were known to have survived the abortions intended to kill them and died shortly thereafter. The CDC <a href=\"https:\/\/archive.liveaction.org\/news\/babies-born-alive-abortions-continue\/\">also noted<\/a> that these numbers are likely underestimated.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to a June 10th Oregon Right to Life <\/span><a href=\"https:\/\/www.ortl.org\/2021\/06\/oregon-house-prioritizes-partisan-politics-over-78-of-oregonians-who-oppose-infanticide\/\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\">, 78% of Oregonians favor outlawing infanticide. \u201cSadly, it\u2019s no surprise that abortion extremism continues to be rampant in the Oregon Senate,\u201d said Lois Anderson, Oregon Right to Life\u2019s executive director. \u201cInstead of passing legislation supported by the majority of Oregon voters, the Democrats continue to follow the marching orders of the abortion lobby.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Preborn babies have no protections in the state of Oregon, which has some of the most pro-abortion policies in the country for which it is<\/span> <a href=\"https:\/\/www.bustle.com\/articles\/98424-the-4-best-states-for-reproductive-rights-are-where-we-should-all-move-stat\"><span style=\"font-weight: 400;\">lauded by pro-abortion organizations<\/span><\/a><span style=\"font-weight: 400;\">. In 2017, Oregon became the first state to pass legislation for providing taxpayer funds to cover abortion on demand, as Live Action News <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/oregon-governor-signs-bill-offering-free-abortions-to-citizens-and-undocumented-immigrants\/\"><span style=\"font-weight: 400;\">reported<\/span><\/a><span style=\"font-weight: 400;\">. Currently there are <\/span><a href=\"https:\/\/prochoiceoregon.org\/issue\/abortion-access\/\"><span style=\"font-weight: 400;\">no legislative restrictions on abortion<\/span><\/a><span style=\"font-weight: 400;\"> in the state.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt\u2019s clear after two votes on the born alive legislation that abortion extremists in the Oregon Legislature think infanticide is a partisan issue. 78% of Oregonians disagree,\u201d Anderson said in a June 15th <\/span><a href=\"https:\/\/www.ortl.org\/2021\/06\/oregon-house-prioritizes-partisan-politics-over-78-of-oregonians-who-oppose-infanticide\/\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span
