Heidi Crowter, a 25-year-old woman from Coventry who has Down\u2019s syndrome, together with M\u00e1ire Lea-Wilson from Brentford, West London, whose twenty-three-month-old son Aidan has Down\u2019s syndrome, are challenging the UK Government over a disability clause in the current law.<\/p>\n<p><strong>\u201cIntense pressure to abort\u201d<\/strong><\/p>\n<p><a href=\"https:\/\/www.nhs.uk\/conditions\/abortion\/#:~:text=When%20an%20abortion%20can%20be,born%20with%20a%20severe%20disability.\" target=\"_blank\" rel=\"noopener\">Currently<\/a> in England, Wales, and Scotland, there is a general 24-week time limit for abortion, but if the baby has a disability, including Down\u2019s syndrome, cleft lip, and club foot, abortion is legal right up to birth.<\/p>\n<p>Latest figures show that <a href=\"https:\/\/righttolife.org.uk\/news\/rcog-tells-health-professionals-to-stop-pressuring-women-into-disability-selective-abortions\" target=\"_blank\" rel=\"noopener\">around 90%<\/a> of babies who are prenatally diagnosed with Down\u2019s syndrome are aborted.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/down-syndrome-heidi-crowter-diagnosis-pregnancy\/\" target=\"_blank\" rel=\"noopener\">Down syndrome campaigner Heidi Crowter: \u2018I\u2019m not a devastating diagnosis or a crisis pregnancy\u2019<\/a><\/em><\/strong><\/p>\n<p>Ms Lea-Wilson has <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-8351603\/Woman-Downs-Syndrome-launches-legal-bid-end-abortion-discrimination.html\" target=\"_blank\" rel=\"noopener\">spoken frequently<\/a> about how she was \u201cplaced under intense pressure\u201d to have an abortion after a 34-week scan revealed her son had Down\u2019s syndrome.<\/p>\n<p>Alongside today\u2019s announcement of the forthcoming hearing, she <a href=\"https:\/\/dontscreenusout.org\/press-release-woman-with-downs-syndromes-landmark-case-against-uk-govt-over-discriminatory-abortion-law-to-be-heard-by-high-court-on-6th-july\/\" target=\"_blank\" rel=\"noopener\">added<\/a>: \u201cI have two sons that I love and value equally, but the law does not value them equally. This is wrong and so we want to try and change that\u2026We proclaim that we live in a society that values those with disabilities, that everyone deserves a fair and equal chance at life, regardless of their ability status. This law undermines that narrative, does it really have a place in 2021?\u201d<\/p>\n<p><strong>\u201cOffensive and discriminatory\u201d<\/strong><\/p>\n<p>The UN Committee on the Rights of Persons with Disabilities has <a href=\"https:\/\/dontscreenusout-dot-yamm-track.appspot.com\/Redirect?ukey=10536Lv6t83bwHiuBsZoxOu5o2qumD7IImiYWlNDd-3g-0&amp;key=YAMMID-07237573&amp;link=http%3A%2F%2Fwww.ohchr.org%2FDocuments%2FHRBodies%2FCRPD%2F6thsession%2FCRPD.C.ESP.CO.1_en.doc\" target=\"_blank\" rel=\"noopener\">consistently criticised countries<\/a> that provide for abortion on the basis of disability. The Committee on the Rights of Persons with Disabilities\u2019 <a href=\"https:\/\/dontscreenusout-dot-yamm-track.appspot.com\/Redirect?ukey=10536Lv6t83bwHiuBsZoxOu5o2qumD7IImiYWlNDd-3g-0&amp;key=YAMMID-07237573&amp;link=https%3A%2F%2Fdocstore.ohchr.org%2FSelfServices%2FFilesHandler.ashx%3Fenc%3D6QkG1d%252FPPRiCAqhKb7yhspCUnZhK1jU66fLQJyHIkqMIT3RDaLiqzhH8tVNxhro6S657eVNwuqlzu0xvsQUehREyYEQD%252BldQaLP31QDpRcmG35KYFtgGyAN%252BaB7cyky7\" target=\"_blank\" rel=\"noopener\">concluding observations<\/a> on the initial report of the United Kingdom of Great Britain and Northern Ireland also made a key recommendation that the UK change its abortion law so that it does not single out babies with disabilities.<\/p>\n<p>The Disability Rights Commission (subsumed into the Equality and Human Rights Commission in 2007) <a href=\"https:\/\/dontscreenusout-dot-yamm-track.appspot.com\/Redirect?ukey=10536Lv6t83bwHiuBsZoxOu5o2qumD7IImiYWlNDd-3g-0&amp;key=YAMMID-07237573&amp;link=http%3A%2F%2Fwww.bbc.co.uk%2Fethics%2Fabortion%2Fphilosophical%2Fdisability.shtml\" target=\"_blank\" rel=\"noopener\">has said<\/a> that this aspect of the Abortion Act \u201cis offensive to many people; it reinforces negative stereotypes of disability&#8230; [and] is incompatible with valuing disability and non-disability equally\u201d.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/mom-pressure-abort-down-syndrome-no-surviving\/\" target=\"_blank\" rel=\"noopener\">Mom recalls pressure to abort baby with Down syndrome: \u2018He has no chance of surviving\u2019<\/a><\/em><\/strong><\/p>\n<p>A 2013 <a href=\"https:\/\/dontscreenusout-dot-yamm-track.appspot.com\/Redirect?ukey=10536Lv6t83bwHiuBsZoxOu5o2qumD7IImiYWlNDd-3g-0&amp;key=YAMMID-07237573&amp;link=http%3A%2F%2Fdontscreenusout.org%2Fwp-content%2Fuploads%2F2016%2F02%2FAbortion-and-Disability-Report-17-7-13.pdf\" target=\"_blank\" rel=\"noopener\">Parliamentary Inquiry into Abortion for Disability<\/a> also found the vast majority of those who gave evidence believed allowing abortion up to birth on the grounds of disability is discriminatory, contrary to the spirit of the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2010\/15\/contents\" target=\"_blank\" rel=\"noopener\">Equality Act 2010<\/a>, and that it affects wider public attitudes towards discrimination. The Inquiry recommended Parliament reviews the question of allowing abortion on the grounds of disability.<\/p>\n<p><strong>Standing up for equality<\/strong><\/p>\n<p>In a press release announcing the High Court hearing, Lynn Murray, spokesperson for <a href=\"https:\/\/dontscreenusout.org\/\" target=\"_blank\" rel=\"noopener\">Don\u2019t Screen Us Out<\/a> and mother of Rachel who has Down\u2019s syndrome, <a href=\"https:\/\/dontscreenusout.org\/press-release-woman-with-downs-syndromes-landmark-case-against-uk-govt-over-discriminatory-abortion-law-to-be-heard-by-high-court-on-6th-july\/\" target=\"_blank\" rel=\"noopener\">stated<\/a>: \u201cBy stating that disability is grounds for termination, section 1(1)(d) of the Abortion Act promotes inequality. The provision in the Abortion Act harks back to a time when we thought it was better for people with disabilities not to be part of our society. We\u2019re a far more progressive society now, we realise that diversity is healthy, and all of our laws should reflect that\u201d.<\/p>\n<p>Mrs Crowter <a href=\"https:\/\/dontscreenusout.org\/press-release-woman-with-downs-syndromes-landmark-case-against-uk-govt-over-discriminatory-abortion-law-to-be-heard-by-high-court-on-6th-july\/\" target=\"_blank\" rel=\"noopener\">said<\/a>: \u201cPeople like me are considered to be \u2018seriously handicapped\u2019, but I think using that phrase for a clause in abortion law is so out of date\u2026People shouldn\u2019t be treated differently because of their disabilities, it\u2019s downright discrimination\u201d.<\/p>\n<p>Ms Lea-Wilson <a href=\"https:\/\/dontscreenusout.org\/press-release-woman-with-downs-syndromes-landmark-case-against-uk-govt-over-discriminatory-abortion-law-to-be-heard-by-high-court-on-6th-july\/\" target=\"_blank\" rel=\"noopener\">added<\/a>: \u201cI am thrilled to hear that the case will be heard in court on the 6th and 7th July, and I hope that this will be the time that we all stand up for equality\u201d.<\/p>\n<p><strong>Widespread popular and political support<\/strong><\/p>\n<p>Last March, the UK Government introduced new abortion regulations to Northern Ireland. The regulations allow abortion up to birth for disabilities including Down\u2019s syndrome, cleft lip, and club foot. <a href=\"https:\/\/dontscreenusout-dot-yamm-track.appspot.com\/Redirect?ukey=10536Lv6t83bwHiuBsZoxOu5o2qumD7IImiYWlNDd-3g-0&amp;key=YAMMID-07237573&amp;link=https%3A%2F%2Fdontscreenusout.org%2F1800-people-with-downs-syndrome-and-families-call-on-boris-johnson-to-not-introduce-abortion-up-to-birth-for-downs-syndrome-as-new-figures-show-710-late-term-abortion-for-down-syndr%2F\" target=\"_blank\" rel=\"noopener\">1,875 people with Down\u2019s syndrome and their families<\/a> signed a letter to Boris Johnson urging him to ensure that selective abortion for Down\u2019s syndrome was not introduced to Northern Ireland.<\/p>\n<p><a href=\"https:\/\/dontscreenusout-dot-yamm-track.appspot.com\/Redirect?ukey=10536Lv6t83bwHiuBsZoxOu5o2qumD7IImiYWlNDd-3g-0&amp;key=YAMMID-07237573&amp;link=http%3A%2F%2Fwww.standard.co.uk%2Fnews%2Fpolitics%2Ftory-peer-says-lords-dont-want-disabled-babies-to-live-after-abortion-bill-thrown-out-a3488066.html\" target=\"_blank\" rel=\"noopener\">Polling<\/a> has shown that the majority of people in England, Wales and Scotland feel that disability should not be a grounds for abortion at all, with only one in three people thinking it is acceptable to ban abortion for gender or race but allow it for disability.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/birth-rates-down-syndrome-plummeted-50-europe\/\" target=\"_blank\" rel=\"noopener\">Birth rates for babies with Down syndrome drop by over 50% in Europe<\/a><\/em><\/strong><\/p>\n<p>In February this year, Northern Irish MLA Paul Givan <a href=\"https:\/\/righttolife.org.uk\/news\/northern-ireland-bill-launched-to-end-abortion-up-to-birth-for-babies-with-disabilities-including-downs-syndrome-cleft-lip-and-club-foot\" target=\"_blank\" rel=\"noopener\">introduced<\/a> the Severe Fetal Impairment Abortion (Amendment) Bill in conjunction with the <a href=\"https:\/\/dontscreenusout.org\/\" target=\"_blank\" rel=\"noopener\">\u2018Don\u2019t Screen Us Out\u2019<\/a> Campaign. It has since received a huge level of support with <a href=\"https:\/\/dontscreenusout.org\/press-release-heidi-addresses-ni-assembly\/\" target=\"_blank\" rel=\"noopener\">1,608<\/a> people with Down\u2019s syndrome and their families signing an open letter to the Assembly urging them to vote in favour of the bill. Almost 28,500 members of the general public have also signed a petition in support of the Bill, which proposes to amend the aspect of the 2020 Regulations that allows abortion up until birth for babies with disabilities.<\/p>\n<p>Right To Life UK spokesperson, Catherine Robinson, said: \u201cAs Heidi and M\u00e1ire have tragically highlighted, the current law \u2013 which allows abortion up to birth for babies with disabilities but does not permit abortion past 24 weeks for babies without disabilities \u2013 does tell people with disabilities that they are valued less than people without disabilities\u201d.<\/p>\n<p>\u201cThere is simply no place for such abhorrent legal discrimination in 21st century Britain.
