{"id":244596,"date":"2021-05-07T09:40:15","date_gmt":"2021-05-07T14:40:15","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=244596"},"modified":"2021-05-05T16:38:59","modified_gmt":"2021-05-05T21:38:59","slug":"texas-protect-patients-hospitals-end-lives","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/texas-protect-patients-hospitals-end-lives\/","title":{"rendered":"New Texas bill could protect patients from hospitals seeking to end their lives"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">Some of the most vulnerable patients in Texas could enjoy better protections in the future, as the Texas House Public Health Committee has advanced a bill that would nix the current ticking time bomb that begins when a hospital decides to pull the plug.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bill, <\/span><a href=\"https:\/\/legiscan.com\/TX\/text\/HB2609\/2021\"><span style=\"font-weight: 400;\">HB 2609<\/span><\/a><span style=\"font-weight: 400;\">, takes aim at the so-called <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/HS\/htm\/HS.166.htm\"><span style=\"font-weight: 400;\">10-Day-Rule<\/span><\/a><span style=\"font-weight: 400;\"> which allows hospitals to form a medical committee to determine whether to continue providing life-sustaining medical care to a patient. When doctors and patients are at an impasse, the committee can decide to withdraw treatment for any reason, including \u201cquality of life.\u201d The patient\u2019s family then has 10 days to seek another provider willing to provide care. If no care is found, the hospital will simply withdraw the medical treatment that is deemed \u201cinappropriate\u201d (including nutrition and hydration). <\/span><\/p>\n<p><span style=\"font-weight: 400;\">As <\/span><a href=\"https:\/\/www.texasrighttolife.com\/what-is-the-texas-10-day-law-and-who-is-at-risk\/\"><span style=\"font-weight: 400;\">Texas Right to Life<\/span><\/a><span style=\"font-weight: 400;\"> points out, \u201cEven if the patient is conscious, coherent, and actively requesting the continuation of life-sustaining treatment, the 10-Day-Law gives the hospital the power to overrule the patient\u2019s wishes.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The pro-life bill\u2019s language demotes the role of medical committees to mere advisory bodies that provide recommendations but which no longer have the power of life and death. Under the revised language, the hospital must continue to provide care for a patient regardless of the recommendation of the attending physician and\/or medical committee.<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/texas-10-day-rule-unethical-institutional-power\/\">The \u201910-Day-Rule\u2019 in Texas is an unethical and institutional power play<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Pro-life groups cheered the committee for clearing HB 2609 for consideration by the House. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cTexas Right to Life applauds the representatives who voted in favor of ending the 10-Day Rule and Chairwoman Stephanie Klick for her leadership. We also thank Representative Parker for authoring and shepherding this life-saving bill out of committee,\u201d Texas Right to Life Senior Legislative Associate Rebecca Parma <\/span><a href=\"https:\/\/www.texasrighttolife.com\/texas-house-committee-green-lights-10-day-rule-reform-bill\/\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\"> in response to the committee\u2019s vote.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The rule has been in the spotlight in recent years as a Texan mother has been fighting a <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-declines-appeal-tinslee-lewis-life\/\"><span style=\"font-weight: 400;\">protracted legal battle<\/span><\/a><span style=\"font-weight: 400;\"> to keep her two-year-old daughter, Tinslee Lewis, from being removed from medical treatment at Cook Children\u2019s Medical Center. Earlier this year, the Supreme Court denied the hospital\u2019s request to remove life support from Tinslee. Yet even this week the case remains active in lower courts, as the hospital has filed with a state appeals court to allow it to withdraw Tinslee&#8217;s care, according to <\/span><a href=\"https:\/\/www.nbcdfw.com\/news\/local\/hospital-seeks-new-trial-to-remove-toddler-from-life-support\/2622870\/\"><span style=\"font-weight: 400;\">NBC DFW<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After passing the committee, HB2609 will now go before the state Committee on Calendars in order to schedule a House floor
