The vote of the Hayes Center Board of Trustees&#8217; majority female leadership was a unanimous 5-0 vote.<\/p>\n<p dir=\"ltr\">While some U.S. cities have passed <em>resolutions<\/em> declaring themselves to be \u201csanctuary cities for the unborn,\u201d those resolutions are statements which do not actually outlaw abortion. In passing an <em>enforceable ordinance,<\/em>\u00a0the city leadership of Hayes Center recognizes, along with 23 cities in Texas, that a\u00a0resolution is not enough to protect the health and welfare of the residents of Hayes Center.<\/p>\n<p dir=\"ltr\">As <a href=\"https:\/\/www.hayescentertimesrepublican.com\/feature-stories\/hayescentersanctuaryfortheunborn\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.hayescentertimesrepublican.com\/feature-stories\/hayescentersanctuaryfortheunborn&amp;source=gmail&amp;ust=1617905810688000&amp;usg=AFQjCNHvyBEIq-UhjiTeXTxE2EFlQxOtfg\">reported<\/a> by The Hayes Center Times-Republican, \u201cVillage Chair Kimberle Primavera first heard about the initiative through a <a href=\"https:\/\/archive.liveaction.org\/news\/texas-20th-sanctuary-city-unborn-nation\/\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/texas-20th-sanctuary-city-unborn-nation\/&amp;source=gmail&amp;ust=1617905810688000&amp;usg=AFQjCNHx4Uk2UNi3glnR-FrgQbh_5Lpuhw\">story on Live Action<\/a> about the small town of Carbon, Texas (population 348) becoming the 20th city in Texas to outlaw abortion.\u201d<\/p>\n<p dir=\"ltr\">Seeking to be a voice for the voiceless is nothing new for Primavera. In an exclusive interview, Primavera shared about how she got started in standing up for the smallest and most vulnerable among us. &#8220;I got involved in being an advocate for life starting when I was a teenager. With the knowledge of when life begins and how rapidly that unique human grows, I am horrified every day that innocent life is taken so casually.\u201d<\/p>\n<p dir=\"ltr\">Primavera continued, \u201cIn my early twenties I had the opportunity to be the director of the Pregnancy Resource Center in Beatrice, Nebraska. After giving birth to my third child, I stepped back from the role of director in order to care for my children. For the next nine years I remained on the board of directors for the PRC. Over the next 15 years, the stories of abortion survivors Gianna Jessen and Melissa Ohden \u2014 coupled with losing two babies at 14 weeks past conception \u2014\u00a0only deepened my resolve to spread advocacy for our innocent little ones.\u201d<\/p>\n<p dir=\"ltr\">After living in large cities across America, Primavera moved to Hayes Center, Nebraska, and ran for village office four years ago. Photo courtesy of Cindy McKillip.<\/p><\/div>\n<p dir=\"ltr\">After seeing that a small town like Carbon, Texas, could pass such an ordinance, Primavera began entertaining the possibility of Hayes Center becoming a Sanctuary City for the Unborn. Primavera discussed the idea during the Village Board of Trustees meeting last month and with the support of the Board of Trustees, Primavera reached out to the Sanctuary Cities for the Unborn Initiative for assistance in seeing the outlawing of abortion become a reality in Hayes Center.<\/p>\n<p dir=\"ltr\"><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/city-lubbock-texas-against-sanctuary-unborn-ordinance\/\">Texas city of Lubbock votes against \u2018sanctuary city for the unborn\u2019 ordinance<\/a><\/em><\/strong><\/p>\n<p dir=\"ltr\">The Hayes Center Ordinance states, \u201cIt shall be unlawful for any person to procure or perform an abortion of any type and at any stage of pregnancy in the village of Hayes Center, Nebraska\u201d and \u201cIt shall be unlawful for any person to knowingly aid or abet an abortion that occurs in the village of Hayes Center, Nebraska.\u201d<\/p>\n<p dir=\"ltr\">The ordinance defines abortion as \u201cthe act of using or prescribing an instrument, a drug, a medicine, or any other substance, device, or means with the intent to cause the death of an unborn child of a woman known to be pregnant.\u201d The Ordinance clarifies that the act is not an abortion if the act is done with the intent to \u201csave the life or preserve the health of an unborn child\u201d or to \u201cremove a dead, unborn child whose death was caused by accidental miscarriage\u201d or to \u201cremove an ectopic pregnancy.\u201d<\/p>\n<p dir=\"ltr\">In addition to outlawing abortion, the Hayes Center Ordinance also declares abortion-inducing drugs to be contraband when it states, \u201cIt shall be unlawful for any person to possess or distribute abortion-inducing drugs in the village of Hayes Center, Nebraska.\u201d Abortion-inducing drugs are defined by the ordinance as \u201cmifepristone, misoprostol, and any drug or medication that is used to terminate the life of an unborn child.\u201d The Ordinance does not define the terms \u201cabortion\u201d or \u201cabortion-inducing drugs\u201d to include birth control devices or oral contraceptives.<\/p>\n<p dir=\"ltr\">While the Hayes Center Ordinance is similar to the Sanctuary Cities for the Unborn ordinances in Texas in that they all outlaw abortion immediately, it is also vastly different in how the ordinance is enforced. In the Texas ordinances there are two major enforcement mechanisms: a public enforcement mechanism that is dependent upon future court decisions, and a private enforcement mechanism that can take place immediately apart from any future court decisions. The Hayes Center Nebraska Ordinance is much more simple. In the Hayes Center Ordinance there is no private enforcement mechanism, but the public enforcement is immediate and is not based on future court decisions.<\/p>\n<p dir=\"ltr\">The Ordinance reads, \u201cany person, corporation, or entity who commits an unlawful act . . . shall be subject to a fine of $500.\u201d This fine, which is enforceable immediately, contains only one exception. \u201cUnder no circumstance may the penalty described . . . be imposed on the mother of the unborn child that has been aborted.\u201d<\/p>\n<p dir=\"ltr\">The Village of Hayes Center will most certainly not be the last city to outlaw abortion.
