Pro-abortion New Zealand Labour Party MP<\/span> Louisa Wall<\/span><\/a> has introduced an amendment to that nation\u2019s<\/span> abortion legislation<\/span><\/a>, passed last year. The amendment, known as the<\/span> Contraception, Sterilisation, and Abortion (Safe Areas) Amendment Bill<\/span><\/a>, \u201cprovides a regulation-making power to set up safe areas around specific abortion facilities on a case-by-case basis.\u201d In other words, the bill would enable the government to establish buffer zones wherein pro-life outreach is prohibited.<\/span><\/p>\n

This provision was included in the original legislation decriminalizing abortion \u2014 effectively up to birth \u2014 but was<\/span> accidentally removed<\/span><\/a> in a Parliamentary procedural snafu. Wall\u2019s bill seeks to overturn the amendment prohibiting the establishment of buffer zones, which pro-abortion MPs accidentally passed in 2020.<\/span><\/p>\n

According to the<\/span> text of the bill<\/span><\/a>, behavior that would be prohibited within the buffer zones includes \u201cintimidating, interfering with, or obstructing a protected person either with the intention of frustrating the purpose for which the protected person is in the safe area, or in a manner that an ordinary reasonable person would know would cause emotional distress to a protected person\u201d and\/or \u201ccommunicating with, or visually recording, a person in a manner that an ordinary reasonable person would know would cause emotional distress to a protected person.\u201d Infractions would be punishable by arrest and a fine of up to $1000.<\/span><\/p>\n

The language is so vague and subjective that\u00a0<\/span>any<\/span><\/i> attempt to speak to women entering abortion facilities could easily be twisted to fit the parameters of the law and therefore be punished by arrest and subsequent fine \u2014 and of course, that\u2019s the point.<\/span><\/p>\n

Wall claims that women entering abortion centers \u201chave been through the process of determining whether or not an abortion is a health service they need.\u201d However, sidewalk counselors know from<\/span> experience<\/span><\/a> that many women are actually<\/span> uncertain<\/span><\/a> about getting an abortion even after they have entered the facility, and <\/span>countless lives<\/span><\/a> are<\/span> saved<\/span><\/a> by<\/span> sidewalk advocacy<\/span><\/a>.<\/span><\/p>\n

Libertarian ACT Party leader MP David Seymour is expected to back the bill at first reading, however, he has said that his party\u2019s support of the bill at later stages is contingent upon changes regarding the section of the bill that prohibits communication. \u201cOnce you give a Minister the ability to put restrictions on communication, you\u2019re going down a very dark route,\u201d Seymour<\/span> said<\/span><\/a>. Wall\u2019s party is unlikely to agree to any changes.<\/span><\/p>\n

Wall\u2019s bill claims that it is merely following the lead of places such as the United States in attempting to establish this legislation, but this is an outright lie, as buffer zones were<\/span> declared unconstitutional<\/span><\/a> by the United States Supreme Court in 2007, though various<\/a> municipalities have continued<\/a> to attempt to establish<\/a> them. In reality, this law would make New Zealand, which already has some of the most permissive abortion laws in the world, even more pro-abortion.<\/span><\/p>\n
