As a result of the council\u2019s unanimous 6-0 vote, no unborn child will be able to be murdered by abortion within the city limits of Ackerly.<\/p>\n<p dir=\"ltr\">The <a href=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/Ackerly-Ordinance-Outlawing-Abortion-11-30-20.pdf\">Ackerly Ordinance Outlawing Abortion<\/a> states, \u201cIt shall be unlawful for any person to procure or perform an abortion of any type and at any stage of pregnancy in the City of Ackerly, Texas,\u201d and, \u201cIt shall be unlawful for any person to knowingly aid or abet an abortion that occurs in the City of Ackerly&#8230;.\u201d Abortion is defined in the ordinance as, \u201cthe act of using or prescribing an instrument, a drug, a medicine, or any other substance, device, or means with the intent to cause the death of an unborn child of a woman known to be pregnant.\u201d<\/p>\n<p dir=\"ltr\">Over the last year, several Ackerly residents signed an\u00a0<a href=\"http:\/\/www.sanctuarycitiesfortheunborn.com\/online-petition\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.sanctuarycitiesfortheunborn.com\/online-petition&amp;source=gmail&amp;ust=1607022891936000&amp;usg=AFQjCNG8lweTA5e5VnspCUVbYtCVuF_JTA\">online petition<\/a> supporting the outlawing of abortion in their city. The first signer was Meagan Gicklhorn in November 2019. Her reason was simple and direct: \u201cI want to see abortion outlawed in Ackerly because abortion is murder, no matter the gestation.\u201d\u00a0Peter Enns, owner of the local cafe in Ackerly, also signed the petition, noting his conviction that abortion is murder. These residents were two of many with similar convictions regarding abortion.<\/p>\n<p dir=\"ltr\"><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/aclu-withdraws-lawsuit-texas-sanctuary-cities-unborn\/\">ACLU withdraws lawsuit against seven Texas \u2018sanctuary cities for the unborn\u2019<\/a><\/em><\/strong><\/p>\n<p dir=\"ltr\">Ackerly is located in two conservative counties: Dawson and Martin County.In 2018, Dawson and Martin County voters had the opportunity to vote on Proposition #7, which allowed citizens to state if they were &#8220;In Favor&#8221; or &#8220;Against&#8221; the statement, &#8221; I believe abortion should be abolished in Texas.&#8221; In Dawson County, out of 1,401 votes, 1,045 voted in favor of the idea of abolishing abortion in the state of Texas and 356 voted against the idea. In Martin County, out of 768 votes, 618 voted in favor of the idea of abolishing abortion in the state of Texas and 150 voted against the idea.<\/p>\n<p dir=\"ltr\">There was no doubt that the majority of Ackerly residents opposed abortion and recognized its negative impact in communities across the country. During the City Council meeting, Mayor Scott Ragle shared his desire to see the culture of life found in Ackerly preserved for current and future generations. \u201cWe do not want our city to become the Los Ybanez of abortion,\u201d said Mayor Ragle, referring to a small nearby city which was incorporated in the 1970s for the purpose of legalizing the sale of alcohol within its city limits. Los Ybanez became a destination hotspot for residents in neighboring towns looking to purchase alcohol, which impacted neighboring communities. Councilman Kornelius Enns and the five other council members agreed: abortion is not something they ever want to see offered or committed within city limits.<\/p>\n<div id=\"attachment_235590\" style=\"width: 550px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-235590\" decoding=\"async\" loading=\"lazy\" class=\" wp-image-235590\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/ackerly-city-council.jpg\" alt=\"\" width=\"540\" height=\"405\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/ackerly-city-council.jpg 1200w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/ackerly-city-council-300x225.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/ackerly-city-council-768x576.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/ackerly-city-council-700x525.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/12\/ackerly-city-council-500x375.jpg 500w\" sizes=\"(max-width: 540px) 100vw, 540px\" \/><p id=\"caption-attachment-235590\" class=\"wp-caption-text\">Ackerly City Council members (Photo: Mark Lee Dickson)<\/p><\/div>\n<p dir=\"ltr\">Upon the ordinance\u2019s unanimous passage, the Mayor Shannon Thomason of Big Spring, who had attended the meeting to show support, congratulated the Mayor and City Council, saying, \u201cAckerly: Welcome to the Club!\u201d The City of Big Spring (pop. 28,162), located 25 miles southwest of Ackerly, was the 11th and closest city to Ackerly <a href=\"https:\/\/archive.liveaction.org\/news\/west-texas-city-with-over-28500-residents-becomes-11th-sanctuary-city-for-unborn\/\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/west-texas-city-with-over-28500-residents-becomes-11th-sanctuary-city-for-unborn\/&amp;source=gmail&amp;ust=1607022891937000&amp;usg=AFQjCNFYorFuGTzaucfJgX47VjiQA30KUg\">pass<\/a> the ordinance. Thomason encouraged Ackerly not to be discouraged or swayed by inquiries or pushback from groups like the ACLU, which previously sued seven cities in East Texas over the ordinance but <a href=\"https:\/\/archive.liveaction.org\/news\/aclu-withdraws-lawsuit-texas-sanctuary-cities-unborn\/\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/aclu-withdraws-lawsuit-texas-sanctuary-cities-unborn\/&amp;source=gmail&amp;ust=1607022891937000&amp;usg=AFQjCNESwgDTPzpmGvWAiQLJpdJFH0rSRg\">withdrew<\/a> their lawsuit three months later. Abortion remained banned in every city which was sued and the lawsuit did not cost the city or taxpayers any money.<\/p>\n<p dir=\"ltr\">Like the ordinances which recently passed in <a href=\"https:\/\/archive.liveaction.org\/news\/city-texas-becomes-15th-nation-declare-sanctuary-city-preborn-children\/\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/city-texas-becomes-15th-nation-declare-sanctuary-city-preborn-children\/&amp;source=gmail&amp;ust=1607022891937000&amp;usg=AFQjCNHrWINV7HW01qyk4Y85lIDTbSWcwQ\">New Home<\/a> and <a href=\"https:\/\/archive.liveaction.org\/news\/texas-city-morton-16th-nation-outlaw-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/texas-city-morton-16th-nation-outlaw-abortion\/&amp;source=gmail&amp;ust=1607022891937000&amp;usg=AFQjCNG7l-f0YW5Sgajd8-S-GgxXoci60Q\">Morton<\/a>, Ackerly&#8217;s Ordinance is based on the Ten Findings in Section A1-10. It immediately outlaws abortion within the city limits and contains both and public and private enforcement mechanisms. The public enforcement (or delayed enforcement) mechanism establishes fines against the abortionist and anyone who aids and abets the abortionist for any abortion taking place within the city limits of Ackerly. The penalties under this section of the ordinance cannot be imposed unless the \u201cindividual seeking to impose the penalty . . . has determined that the imposition or threatened imposition of this penalty . . . will not create an \u2018undue burden\u2019 on women seeking abortions,\u201d OR the \u201cperson, corporation, or entity who committed the unlawful act . . . lacks standing to assert the third-party rights of women seeking abortions in court\u201d OR the Supreme Court overrules Roe v. Wade (1973) and Planned Parenthood v. Casey (1992).\u201d<\/p>\n<p dir=\"ltr\">The private enforcement (immediate enforcement) mechanism is not delayed and is not dependent upon <em>Roe v. Wade<\/em> being overturned but is immediately enforceable. The Private Enforcement section of the Ackerly Ordinance states, \u201cAny person, corporation, or entity that commits an unlawful [abortion]. . . other than the mother of the unborn child that has been aborted, shall be liable in tort to a surviving relative of the aborted unborn child, including the unborn child\u2019s mother, father, grandparents, siblings or half-siblings. The person or entity that committed the unlawful act shall be liable to each surviving relative of the aborted unborn child for: (a) Compensatory damages, including damages for emotional distress; (b) Punitive damages; and (c) Costs and attorneys\u2019 fees.\u201d<\/p>\n<p dir=\"ltr\">Section F4 of the Ackerly Ordinance states that \u201cPrivate enforcement . . . may be brought against any person, corporation, or entity that commits an unlawful act . . . upon the effective date of the ordinance, regardless of whether the Supreme Court has overruled Roe v. Wade, 410 U.S. 113 (1973), or Planned Parenthood v. Casey, 505 U.S. 833 (1992), and regardless of whether the current jurisprudence of the Supreme Court permits states and municipalities to punish those who violate abortion prohibitions.\u201d<\/p>\n<p dir=\"ltr\"><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/city-lubbock-texas-against-sanctuary-unborn-ordinance\/\">Texas city of Lubbock votes against \u2018sanctuary city for the unborn\u2019 ordinance<\/a><\/em><\/strong><\/p>\n<p dir=\"ltr\">Ackerly will not be the last city to outlaw abortion in Texas. Efforts to outlaw abortion are underway by residents in several cities including Livingston (population 6,430), Seminole (population 7,815), Lamesa (population 8,640), Levelland (population 13,929), Marshall (23,935) and Midland (population 145,012). The city of Odessa (population 119,733), located 80 miles southeast of Ackerly, may be one of the next larger cities to vote on the ordinance in the near future.<\/p>\n<p dir=\"ltr\">The City Council of the City of Lubbock (population 255,885), located 80 miles northeast of Ackerly, were recently forced to vote on the ordinance through a provision in the City Charter called \u201cInitiative and Referendum.\u201d Because Lubbock residents took advantage of this provision, the recent 7-0 vote by the Mayor and City Council of Lubbock <a href=\"https:\/\/archive.liveaction.org\/news\/lubbock-citizens-stand-life-right-side-justice\/\" target=\"_blank\" rel=\"noopener noreferrer noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/lubbock-citizens-stand-life-right-side-justice\/&amp;source=gmail&amp;ust=1607022891937000&amp;usg=AFQjCNGSl6p7O-kLM1rzwpxMXGkakJXBNQ\">against<\/a> the ordinance outlawing abortion was not the final word on the matter.
