Wade during second day of Senate hearings"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">During Judge Amy Coney Barrett\u2019s <\/span><a href=\"https:\/\/www.c-span.org\/video\/?476316-3\/supreme-court-nominee-amy-coney-barrett-confirmation-hearing-day-2-part-3&amp;event=476316&amp;playEvent&amp;auto&amp;vod\"><span style=\"font-weight: 400;\">second day<\/span><\/a><span style=\"font-weight: 400;\"> of confirmation hearings in the Senate Judiciary Committee, nearly every senator on the committee asked about her views on <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\">, the 1973 case establishing legal abortion throughout the United States.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite describing herself as a textualist and an originalist, Judge Barrett insisted she is not a carbon-copy of her mentor, the late Justice Antonin Scalia\u2014who in his nearly 30 years on the Supreme Court ruled in favor of effectively overruling <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> in his dissent in <\/span><i><span style=\"font-weight: 400;\">Planned Parenthood v. (Photo by Demetrius Freeman &#8211; Pool\/Getty Images)<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Barrett also explained judges cannot rule with agendas and must wait for \u201ccases and controversy\u201d in order to decide on issues like abortion.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Graham then discussed his bill that would disallow abortion on demand after five months, saying \u201cit must be a terrible death to be dismembered by abortion.\u201d He asked Barrett if this law was challenged, whether she would be able to \u201clisten to both sides.\u201d <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u201cOf course,\u201d she said, \u201cI will do that in every case.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Graham also pressed Judge Barrett on her thoughts about \u201csubstantive due process,\u201d which is the judicial doctrine that creates the unwritten constitutional rights to abortion and birth control. Barrett agreed it is fair to say there is a \u201cgreat debate\u201d about the limitations of these rights.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHave precedents of the Court been overruled before?\u201d Graham asked. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Barrett replied that <\/span><i><span style=\"font-weight: 400;\">Brown v. Board of Education<\/span><\/i><span style=\"font-weight: 400;\"> overruled <\/span><i><span style=\"font-weight: 400;\">Plessy v. (Photo by Demetrius Freeman &#8211; Pool\/Getty Images)<\/p><\/div>\n<p><span style=\"font-weight: 400;\">After praising Judge Barrett as a mother, the senator shifted focus to a \u201cwoman\u2019s fundamental right\u201d to abortion, quoting the late Justice Ruth Bader Ginsburg, saying, \u201cthe decision whether or not to bear a child is central to a woman\u2019s life, to her wellbeing and dignity.\u201d She then asked Barrett, \u201cDo you agree with Justice Scalia\u2019s view that <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> was wrongly decided?\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Barrett invoked Justice Kagan, saying she would not \u201cgrade precedent,\u201d and furthermore that, \u201cin an area where precedent continues to be pressed and litigated, as is true of <\/span><i><span style=\"font-weight: 400;\">Casey<\/span><\/i><span style=\"font-weight: 400;\">, it would be\u2026 wrong and a violation of the canons for me to do that as a sitting judge.\u201d Barrett explained that sitting judges should not give a thumbs-up or thumbs-down to precedent because it would signal an improper bias to potential litigants.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Feinstein continued to press the issue. \u201cIt\u2019s distressing not to get a straight answer,\u201d Feinstein said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then referring back to Barrett\u2019s \u201clovely family,\u201d Feinstein said, \u201cYou understand all the implications of family life,\u201d and asked Judge Barrett to \u201ccommit\u201d herself to a position on <\/span><i><span style=\"font-weight: 400;\">Casey<\/span><\/i><span style=\"font-weight: 400;\">. Barrett again promised to \u201cfollow the law\u201d for abortion or any other issue that comes before the Court.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.c-span.org\/video\/standalone\/?476316-1\/supreme-court-nominee-amy-coney-barrett-confirmation-hearing-day-2-part-1\" width=\"612\" height=\"380\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\"><strong>Senator Patrick Leahy<\/strong> (D-Vt.) asked Judge Barrett about her Seventh Circuit opinion reviewing an Indiana law that required the remains of aborted children to be disposed of by burial or cremation. Leahy pointed out that the dissent she joined called the Indiana law a \u201ceugenics statute.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Barrett explained that the Supreme Court eventually reversed the Seventh Circuit and upheld the Indiana law\u2019s provision on fetal remains, but the \u201ceugenics portion\u201d of the law prohibiting racial, gender, or disability-based abortions was an open question for the Supreme Court.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Leahy then asked Barrett about a <\/span><a href=\"https:\/\/www.nationalreview.com\/corner\/amy-coney-barrett-in-2006-supported-the-right-to-life\/\"><span style=\"font-weight: 400;\">2006 open letter<\/span><\/a><span style=\"font-weight: 400;\"> she signed as a private citizen, opposing abortion on demand and defending the right to life. (Photo by Leah Millis-Pool\/Getty Images)<\/p><\/div>\n<p><span style=\"font-weight: 400;\"><strong>Senator Sheldon Whitehouse<\/strong> (D-R.I.) discussed the \u201chigh stakes\u201d of President Trump\u2019s insistence that he would only appoint judges willing to overrule <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\">, mentioning the pro-life Susan B. Anthony List\u2019s advertisements in support of Judge Barrett, and other nonprofit groups supporting the President\u2019s judicial nominees.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Senator Ted Cruz<\/strong> (R-Texas) said that if <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> were overruled, the question would revert to elected state and federal legislators. Cruz suggested states like California and New York would likely continue to permit \u201cunrestricted access to abortion,\u201d calling this position \u201cradical.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cruz also discussed\u00a0<\/span><i><span style=\"font-weight: 400;\">Gonzales v. Carhart<\/span><\/i><span style=\"font-weight: 400;\">, the Supreme Court case which upheld the federal ban on partial-birth abortion. Cruz called the practice \u201cgruesome,\u201d and insisted that the \u201cvast majority of Americans\u201d support banning partial-birth abortion, as well as numerous other reasonable restrictions on abortion, like parental notification laws.\u00a0<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/poll-growing-support-confirming-barrett-supreme-court\/\">New poll shows growing support for confirming Amy Coney Barrett for Supreme Court<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Senator Amy Klobuchar<\/strong> (D-Minn.) asked Judge Barrett if she thought <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> is \u201csuper precedent.\u201d Barrett described the informal term as referring to \u201ccases that are so well settled that no political actors and no people seriously push for their overruling.\u201d Barrett noted that she is being asked so many questions about <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> \u201cindicates that <\/span><i><span style=\"font-weight: 400;\">Roe <\/span><\/i><span style=\"font-weight: 400;\">doesn\u2019t fall in that category.\u201d\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThat doesn\u2019t mean that <\/span><i><span style=\"font-weight: 400;\">Roe <\/span><\/i><span style=\"font-weight: 400;\">should be overruled,\u201d Barrett said, \u201cit just means that it doesn\u2019t fall on the small handful of cases like <\/span><i><span style=\"font-weight: 400;\">Marbury v. Madison <\/span><\/i><span style=\"font-weight: 400;\">and [<\/span><i><span style=\"font-weight: 400;\">Brown v. Board of Education<\/span><\/i><span style=\"font-weight: 400;\">]<\/span> <span style=\"font-weight: 400;\">that no one questions anymore.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Senator Josh Hawley<\/strong> (R-Mo.) asked Judge Barrett again about the open letter she signed affirming her support protecting life from conception until natural death. Barrett confirmed that this is the position of the Catholic Church on abortion, but clarified that her task of applying the law as a judge is \u201cdistinct\u201d from her \u201cpersonal moral religious views.\u201d She went on to say that she signed the statement 15 years ago and that it would be inappropriate for her to now express her \u201cprivate views\u201d as a public official.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Senator Hawley emphasized that Article VI of the Constitution prohibits religious tests as a condition for holding public office.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Senator Richard Blumenthal<\/strong> (D-Conn.) raised concerns about the 2006 open letter, asking whether Barrett had disclosed this letter when she was nominated to the Seventh Circuit in 2017. Barrett replied that she had not recalled signing the letter at the time of her 2017 nomination, but that she provided over 1,800 pages of disclosures. (Photo by Sarah Silbiger-Pool\/Getty Images)<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Blumenthal also discussed a 2013 letter she signed onto that described <\/span><i><span style=\"font-weight: 400;\">Roe <\/span><\/i><span style=\"font-weight: 400;\">as \u201cinfamous.\u201d The letter was sponsored by University Faculty for Life at Notre Dame. Barrett confirmed to having been a member of the group and having signed the letter.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Blumenthal then described a victim of rape named \u201cSamantha\u201d who found out she was pregnant and decided to get an abortion. He then reminded Barrett that the St. Joseph County Right to Life\u2019s advertisement said \u201cabortion is never the right answer, even in cases of sexual assault.\u201d Judge Barrett told Blumenthal that the statement she signed did not mention rape or incest, but \u201csimply validated the teaching of my church on the sacredness of life from conception to natural death.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Blumenthal insisted that Judge Barrett state whether she thinks \u201c<\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> was correctly decided.\u201d Judge Barrett again refused to take a position, replying, \u201cAs I\u2019ve said to others of your colleagues\u2026 it\u2019s inconsistent with the duties of a sitting judge\u2026 to take positions on cases that Court has decided in the past.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Blumenthal then mentioned a woman named \u201cTracy,\u201d who was diagnosed with endometriosis, preventing her from \u201cgetting and staying pregnant.\u201d He then asked Judge Barrett if it would be constitutional to criminalize in vitro fertilization (IVF). Judge Barrett refused to express her private views, and said it is not appropriate for judges to \u201canswer questions in the abstract\u201d about how she might rule on a case. He asked the same hypothetical question with regard to criminalizing the actions of abortionists, to which Barrett gave a similar response.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Blumenthal called Barrett\u2019s answers \u201cchilling\u201d and \u201cfearful.\u201d\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Reading the 2013 statement by the University Faculty for Life, Senator Blumenthal asked Judge Barrett what it means for \u201cthe unborn to be protected in law.\u201d Judge Barrett said the statement was \u201can affirmation of life\u201d and affirmed support for \u201cwomen in crisis pregnancies\u201d and to \u201csupport babies.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt\u2019s really no more than the expression of a pro-life view,\u201d she said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, <strong>Senator Mazie Hirono<\/strong>\u00a0(D-Hawaii) mentioned that both President Trump and Senator Hawley had made statements suggesting they expected Judge Barrett to overruled <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\">. Judge Barrett repeated that she \u201cmade no promises to anyone\u201d and has \u201cno agenda.\u201d Hirono brought up numerous cases concerning state restrictions on abortion that may be working their way toward the Supreme Court, concluding, \u201cThat is why a lot of people are concerned.\u201d\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Q&amp;A portion of the hearings is <\/span><a href=\"https:\/\/www.npr.org\/sections\/live-amy-coney-barrett-supreme-court-confirmation\/2020\/10\/12\/922329124\/how-the-supreme-court-confirmation-hearings-for-amy-coney-barrett-will-work\"><span style=\"font-weight: 400;\">expected<\/span><\/a><span style=\"font-weight: 400;\"> to continue through Wednesday.
