{"id":230355,"date":"2020-09-07T12:33:17","date_gmt":"2020-09-07T17:33:17","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=230355"},"modified":"2020-09-06T21:51:27","modified_gmt":"2020-09-07T02:51:27","slug":"fourth-circuit-clashes-ninth-circuit-trump-protect","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/fourth-circuit-clashes-ninth-circuit-trump-protect\/","title":{"rendered":"Fourth Circuit clashes with Ninth Circuit over Trump Administration\u2019s &#8216;Protect Life&#8217; rule"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/www.nationalrighttolifenews.org\/2020\/09\/4th-circuit-clashes-with-9th-circuit-over-trump-administrations-protect-life-rule\/\">NRL News Today<\/a>)\u00a0Putting itself at odds with the 9th U.S. Circuit Court of Appeals and opening the way to a possible resolution by the Supreme Court, the full 4<sup>th<\/sup> U.S. Court of Appeals on Thursday permanently enjoined the Trump Administration\u2019s \u201cProtect Life\u201d rule which requires recipients of Title X family planning money not to co-locate with abortion clinics or refer clients for abortion as a method of family planning.<\/p>\n<p>The court split 8-6 in upholding an April 2020 decision by a three-judge panel that denied the Trump administration\u2019s motion to stay an\u00a0<a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2020\/02\/abortion-gag-ruling.pdf\">injunction<\/a>\u00a0issued in February by Judge Richard D. Bennett.<\/p>\n<p>The result is that Maryland remains the only state where enforcement of the rules is enjoined.<\/p>\n<p>Writing for the majority, Judge Stephanie Thacker, a President Barack Obama nominee, said the administration \u201cfailed to recognize and address the ethical concerns of literally every major medical organization in the country, and it arbitrarily estimated the cost\u201d associated with the new regulations.<\/p>\n<p>\u201cMoreover, considering the time-sensitive nature of pregnancy and access to legal abortion, this attempt to hoodwink patients creates \u2018unreasonable barriers\u2019 to \u2018appropriate medical care,\u2019 and \u2018impedes timely access\u2019 to health care services,\u201d she added.<\/p>\n<p>Judge Julius Richardson, nominated by President Donald Trump, wrote a dissenting opinion. He was joined by Judges J. Harvie Wilkinson III, Paul V. Niemeyer, G. Steven Agee, A. Marvin Quattlebaum Jr., and Allison Jones Rushing.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/ninth-circuit-upholds-trump-protect-life-rule\/\">Ninth Circuit Court of Appeals upholds Trump administration\u2019s Protect Life Rule<\/a><\/em><\/strong><\/p>\n<p>In a 43-page dissent, Judge Richardson patiently laid out the case why the \u201cProtect Life\u201d rule \u201cfalls well within HHS\u2019s established statutory authority, and the record shows that it was a product of reasoned decisionmaking.\u201d<\/p>\n<p>In many places, his reasoning tracks that of the 9<sup>th<\/sup> Circuit decision written by \u00a0<a href=\"http:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2020\/02\/24\/19-15974.pdf\">Judge Sandra S. Ikuta<\/a>, which allowed the policy to take effect throughout the country.<\/p>\n<p>As <em>NRL News Today<\/em> noted at the time, Judge Ikuta made short work of the talking point that the rule was a \u201cgag.\u201d Pregnancy counselors just can\u2019t refer or encourage abortion. If abortion providers are \u201cdeprived,\u201d it is a decision of their own making.<\/p>\n<p>As expected, Planned Parenthood opted out.<\/p>\n<p>Federal funding for family planning was not\u2014as we have written many times,\u00a0<strong>not<\/strong>\u2014cut. It now goes to genuine family planning.<\/p>\n<p>The challenge was brought by the Mayor and City Council of Baltimore, which \u201cargued that the Final Rule is not a cogent product of agency expertise,\u201d Judge Richardson wrote. \u201cThe district court agreed with Baltimore and now so does the majority. Both are wrong.\u201d<\/p>\n<blockquote class=\"wp-block-quote\"><p><em><strong>In my view, the Final Rule falls well within HHS\u2019s established statutory authority, and the record shows that it was a product of reasoned decisionmaking.\u00a0<\/strong><\/em><\/p><\/blockquote>\n<p>The city also maintained that the Final Rule \u201cwas promulgated in an arbitrary and capricious manner.\u201d Judge Richardson responded:<\/p>\n<blockquote class=\"wp-block-quote\"><p><em><strong>Again, I disagree. Whatever courts or commenters think about the wisdom of an agency\u2019s regulations are of no moment. We must uphold regulations against allegations of arbitrariness, capriciousness, whimsicality, or temperamentality so long as the record shows that the agency gave a hard look and a reasonable response to the problem at hand.
