{"id":228238,"date":"2020-08-02T15:18:44","date_gmt":"2020-08-02T20:18:44","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=228238"},"modified":"2020-08-02T12:25:14","modified_gmt":"2020-08-02T17:25:14","slug":"18-ag-supreme-court-mississippi-15-week-ban","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/18-ag-supreme-court-mississippi-15-week-ban\/","title":{"rendered":"18 state AGs ask Supreme Court to uphold Mississippi&#8217;s 15-week abortion ban"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/studentsforlife.org\/2020\/07\/31\/attorney-generals-from-18-different-states-ask-supreme-court-to-uphold-mississippis-15-week-abortion-ban\/\">Students for Life<\/a>)\u00a0<span data-preserver-spaces=\"true\">Last December, a\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/www.breitbart.com\/news\/appeals-court-blocks-mississippis-15-week-abortion-ban\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">U.S. Court of Appeals for the Fifth Circuit<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0ruled against a Mississippi law banning abortions after the 15th week of pregnancy. The federal appeals court sided with a lower judge\u2019s ruling from 2018 that categorized the abortion ban as \u201cunconstitutional.\u201d\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cIn an unbroken line dating to Roe v. Wade, the Supreme Court\u2019s abortion cases have established (and affirmed, and re-affirmed) a woman\u2019s right to choose an abortion before viability,\u201d Judge Patrick Higginbotham wrote in the ruling.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cStates may regulate abortion procedures prior to viability so long as they do not impose an undue burden on the woman\u2019s right, but they may not ban abortions,\u201d the judge continued. \u201cThe law at issue is a ban. Thus, we affirm the district court\u2019s invalidation of the law.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">But\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2020\/07\/28\/18-states-ask-supreme-court-to-uphold-mississippi-15-week-abortion-ban\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">attorney generals from 18 states<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0have cited \u201cadvances in science\u201d that have occurred since the Supreme Court legalized abortion nationwide in 1973. Based on this reasoning, the coalition of attorney generals argues the ban should be upheld.\u00a0<\/span><\/p>\n<p><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/admin\/2020\/Press\/19-1392%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">Texas Attorney General Ken Paxton<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0pointed out in an amicus brief filed this month that \u201cmuch has changed since Roe.\u201d At the time the case was decided, fetal viability was not until 28 weeks. With current advancements in medical technology, babies can be considered viable as early as\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/archive.liveaction.org\/news\/youngest-preemie-world-21-weeks-going-home\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">21 weeks<\/span><\/a><span data-preserver-spaces=\"true\">.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/bHe8YGPGzj4\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span data-preserver-spaces=\"true\">The chief law enforcement officers noted several flaws in the Fifth Circuit\u2019s decision. Not only did it contradict the legal framework of Roe, but it also conflicts with the 1992 Planned Parenthood v. Casey and the 2020 June Medical Services ruling.\u00a0\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201c[I]n affirming the district court\u2019s judgment, the Fifth Circuit applied a test that would invalidate automatically any law that might prevent some previability abortions, without regard to the State\u2019s interest and the law\u2019s burden.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The Fifth Circuit\u2019s test treats the right to previability abortion as absolute such that no state interest could ever justify any limitation of abortion previability. But no other constitutional right enjoys such absolute unquestioning protection, which perhaps is why Roe and Casey do not elevate the abortion right above all others.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Within the brief, the attorney generals acknowledge how current\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-researcher-preborn-pain-earlier\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">research<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0heavily indicates the unborn experience pain within the second trimester, perhaps even earlier. The abortion method done at this stage of a woman\u2019s pregnancy is commonly referred to as a Dilation &amp; Evacuation (D &amp; E) or \u201cdismemberment.\u201d\u00a0<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/mississippi-senate-ban-abortions-race-disability\/\">Mississippi governor signs bill banning abortions based on sex, race, or disability<\/a><\/em><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">During this type of procedure, the abortionist will use a Sopher clamp to tear the arms and legs from the baby\u2019s body and extract the pieces from the woman\u2019s uterus. The abortionist continues to use the grasping instrument to remove the unborn child\u2019s organs and crush the baby\u2019s skull. Afterward, a curette is used to scrape out any leftover body parts and remove the placenta.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cAbortion is not just another routine and victimless procedure,\u201d Paxton said. \u201cAt 15 weeks, the fetus can feel the pain of being ripped apart during an abortion, and later-term abortions are proven to pose a greater risk to women\u2019s health.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe Mississippi legislature enacted this law in accordance with the beliefs of its constituents and the precedents of the United States Court,\u201d he said. \u201cIt should be upheld.\u201d<\/span><\/p>\n<p><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/archive.liveaction.org\/news\/poll-pro-choice-support-abortion-restrictions\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">Polls<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0show that many people support strong restrictions on abortion that Roe does not allow.
