Contrary to the group\u2019s claims, Menken argued that abortion is not a <\/span><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.ncjw.org\/act\/action-resources\/jewish-values-and-abortion-toolkit\/\"><span style=\"font-weight: 400;\">Jewish value<\/span><\/a><span style=\"font-weight: 400;\">.\u201d<\/span><span style=\"font-weight: 400;\">\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe ethical lessons of the Five Books of Moses, what Jews call the Torah, are today so commonly held that they are almost taken for granted,\u201d Menken wrote over at Newsweek. \u201cWe forget that beliefs such as the inestimable value of every human life, the superiority of peace to warfare and a justice system that must treat all as equals were hardly common in the ancient world.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Menken observed the desire of mankind to strive for the Bible\u2019s \u201cmoral ideal,\u201d only to inevitably fail due to our flawed human nature. The goal of every \u201choly person\u201d is to aim to do better after every fall. The issue we\u2019re seeing today is a preference to reconstruct the biblical word in order to justify behavior that diverges from the Bible\u2019s teachings.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to Menken, this is precisely the problem with the <\/span><a href=\"https:\/\/www.ncjw.org\/act\/action-resources\/jewish-values-and-abortion-toolkit\/\"><span style=\"font-weight: 400;\">\u201cAbortion and Jewish Values Toolkit\u201d<\/span><\/a><span style=\"font-weight: 400;\"> from NCJW. It relies on several untruths about Judaism and attempts to use religion to find moral grounds for abortion.\u00a0<\/span><\/p>\n<p><b>The Jewish Bible and Abortion\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">NCJW claimed that \u201cJudaism permits abortion. Full stop.\u201d Menken objected to this, stating that the Jewish Bible is \u201cunambiguously \u2018pro-life\u2019.\u201d Menken identified the Jewish Bible as the source of Western society\u2019s respect for human life. As the <\/span><a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/8c092235-e38d-4749-ae36-2fe6b04b021f\/downloads\/Judaism%20The%20Original%20Pro%20Life%20Religion%20Keynote.pdf?ver=1594408380812\"><span style=\"font-weight: 400;\">Jewish Pro-life Foundation<\/span><\/a><span style=\"font-weight: 400;\"> explained on its website, Judaism was the first religion to classify human life as \u201csacred\u201d and to prohibit child sacrifice. Various scriptures also appear to contradict the view that Judaism is a pro-choice religion.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Menken pointed to Jacob and Esau being referred to as \u201ctwo nations\u201d in the book of Genesis while they are within <\/span><a href=\"https:\/\/webcache.googleusercontent.com\/search?q=cache:n5TUVmUJeZ8J:https:\/\/www.biblegateway.com\/passage\/%3Fsearch%3DGenesis%2B25%253A19-34%26version%3DNIV+&amp;cd=18&amp;hl=en&amp;ct=clnk&amp;gl=us\"><span style=\"font-weight: 400;\">Rebecca\u2019s<\/span><\/a><span style=\"font-weight: 400;\"> womb. Even in utero, the brothers\u2019 distinctive personalities are acknowledged as already being present. Adding to this, the prophet <\/span><a href=\"https:\/\/www.biblegateway.com\/passage\/?search=Jeremiah+1%3A5&amp;version=NIV\"><span style=\"font-weight: 400;\">Jeremiah<\/span><\/a><span style=\"font-weight: 400;\"> is directly told by God that the Lord knew him before he was born and had a plan for Jeremiah\u2019s life.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some abortion-choice advocates point to Judaism\u2019s alleged support for abortion because of <\/span><a href=\"https:\/\/www.biblegateway.com\/passage\/?search=Exodus+21%3A22-25&amp;version=NIV\"><span style=\"font-weight: 400;\">Exodus 21:22-25<\/span><\/a><span style=\"font-weight: 400;\">. Pro-choice individuals assume the verse is saying two men will merely have to pay a fine if they cause a pregnant women to have a miscarriage, proving that Jewish law does not bestow the same protections on the unborn as they do with born humans.\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As <\/span><a href=\"http:\/\/learnemunah.com\/being\/abortion.html\"><span style=\"font-weight: 400;\">Rabbi Shlomo Nachman<\/span><\/a><span style=\"font-weight: 400;\"> explained on his website, this verse is often misunderstood. According to the site, Rabbi Ahron Soloveitchik\u00a0stated that the verse is not referencing a miscarriage, but a <em>premature birth<\/em>. If no harm comes to the child after the men cause a premature birth, then the penalty is only a fine. But if their actions result in the death of the baby, then it is \u201can eye for an eye\u2026.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The text found in Exodus is also referencing involuntary manslaughter and the punishment that must follow for such a crime. It is not offering justification through Jewish law for a woman to deliberately abort her child.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While <\/span><a href=\"http:\/\/www.gallup.com\/poll\/191903\/religious-groups-disagree-five-key-moral-issues.aspx\"><span style=\"font-weight: 400;\">76%<\/span><\/a><span style=\"font-weight: 400;\"> of American Jews identify as pro-choice, this position seems to be derived more from secular influences than Jewish law and tradition. Judaism promotes the idea that God established a covenant relationship with His creation. It is difficult to align the deliberate killing of preborn children with this principle.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/CFZDhM5Gwhk\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/miscarriage-ectopic-delivery-not-abortions\/\">Why miscarriage, ectopic pregnancy, and early delivery are not abortions<\/a><\/em><\/strong><\/p>\n<p><b>Abortion and Jewish Law<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Conservative commentator <\/span><a href=\"https:\/\/dailycaller.com\/2018\/07\/18\/judaism-unborn-ben-shapiro\/\"><span style=\"font-weight: 400;\">Ben Shapiro<\/span><\/a><span style=\"font-weight: 400;\"> attracted controversy in 2018 when he stated that Judaism does not support the destruction of the preborn. Critics of his position \u2013 some of them Jewish \u2013 said this view aligned more closely with Christianity. But both Shapiro and Menken have offered an explanation on abortion that aligns with the attitude of most <\/span><a href=\"https:\/\/www.thepublicdiscourse.com\/2018\/07\/22070\/\"><span style=\"font-weight: 400;\">Orthodox rabbis<\/span><\/a><span style=\"font-weight: 400;\">, as well as Jewish legal authorities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In fact, several writings from ancient times treated abortion as a form of murder. <\/span><a href=\"https:\/\/www.kairosjournal.org\/document.aspx?DocumentID=6664&amp;L=1\"><span style=\"font-weight: 400;\">\u201cThe Sentences of Pseudo Phocylides\u201d<\/span><\/a><span style=\"font-weight: 400;\"> forbids a woman from destroying the \u201cunborn in her belly.\u201d <\/span><a href=\"https:\/\/www.thegospelcoalition.org\/blogs\/justin-taylor\/abortion-and-early-church\/\"><span style=\"font-weight: 400;\">Josephus<\/span><\/a><span style=\"font-weight: 400;\">, a first-century Jewish historian, proclaimed, \u201cThe law orders all the offspring be brought up, and forbids women to either cause abortion or to make away with the fetus.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Widely considered an expert on abortion in Jewish law, <\/span><a href=\"https:\/\/docs.google.com\/viewerng\/viewer?url=http:\/\/agudathisrael.org\/wp-content\/uploads\/2016\/10\/JO1976-V11-N07.pdf&amp;hl=en_US\"><span style=\"font-weight: 400;\">Rabbi Moshe Feinstein<\/span><\/a><span style=\"font-weight: 400;\"> decried abortion as an act of \u201clegalized bloodshed\u201d in a 1976 article in <\/span><span style=\"font-weight: 400;\">The Jewish Observer<\/span><span style=\"font-weight: 400;\">. These sentiments were echoed in Rabbi Dr. Shimon Cowen\u2019s <\/span><a href=\"http:\/\/www.hakirah.org\/Vol22Cowen.pdf\"><span style=\"font-weight: 400;\">\u201cA Populism of the Spirit,\u201d<\/span><\/a><span style=\"font-weight: 400;\">\u00a0 in which Cowen criticized abortion as \u201can anchor of the permissive society, in which sexuality is pursued without commitment or responsibility\u2026.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The laws surrounding the Sabbath do not support NCJW\u2019s claim that the preborn are not given the \u201cstatus of personhood\u201d under Jewish law. Menken said the only permissible violation of Shabbat is if a \u201clifesaving activity\u201d must be performed. When a fetal life is in danger, then the law demands the Sabbath be violated in order to save the preborn baby. If the preborn were not seen as human, then this would not be the case.\u00a0<\/span><\/p>\n<p><b>Life of the Mother\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Menken stated that the only exception the Mishnah grants for abortion is if the mother\u2019s life is at risk. As <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-life-replies-abortion-never-medically-necessary\/\"><span style=\"font-weight: 400;\">Live Action News<\/span><\/a><span style=\"font-weight: 400;\"> has previously reported, abortion is actually never medically necessary. If a pregnant woman\u2019s life is endangered, then preterm delivery is advised. Or, in the case of an <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-media-equate-miscarriage-ectopic\/\"><span style=\"font-weight: 400;\">ectopic pregnancy<\/span><\/a><span style=\"font-weight: 400;\">, the intention is to correct a pathology. <a href=\"https:\/\/archive.liveaction.org\/news\/miscarriage-ectopic-delivery-not-abortions\/\">This cannot be considered an abortion<\/a>, as it does not involve the intentional, targeted taking of an unborn life.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Typically, the pro-life view when the mother\u2019s life is at risk embodies the <\/span><a href=\"https:\/\/plato.stanford.edu\/entries\/double-effect\/#End\"><span style=\"font-weight: 400;\">doctrine of double effect<\/span><\/a><span style=\"font-weight: 400;\">. Abortion is an evil that can never bring about a good, but a medical intervention to save a live can be neutral or good. The latter action may also result in the death of the preborn child, but the intention is <em>not to deliberately end<\/em> the child\u2019s life.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regardless of Judaism\u2019s abortion exceptions for health concerns, this does not prove a widespread acceptance for abortion like NCJW has alleged.<\/span><\/p>\n<p><em>Editor&#8217;s Note, 7\/18: This article previously incorrectly credited Rabbi Soleveitchik as authoring a website.
