{"id":226749,"date":"2020-07-04T13:33:12","date_gmt":"2020-07-04T18:33:12","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=226749"},"modified":"2023-11-14T20:39:24","modified_gmt":"2023-11-15T02:39:24","slug":"uk-court-appeal-challenge-diy-abortions","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/uk-court-appeal-challenge-diy-abortions\/","title":{"rendered":"UK Court of Appeal will hear challenge against \u2018DIY\u2019 home abortions"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/righttolife.org.uk\/news\/court-of-appeal-will-hear-challenge-against-diy-home-abortions\/\">Right to Life UK<\/a>)\u00a0The Court of Appeal <a href=\"https:\/\/christianconcern.com\/news\/victory-as-court-of-appeal-grants-judicial-review-on-diy-abortions\/\" target=\"_blank\" rel=\"noreferrer noopener\">has granted permission<\/a> to hear a challenge against the UK Government\u2019s decision to introduce \u2018DIY\u2019 home abortions.<\/p>\n<p>The legal challenge being brought forward by the Christian Legal Centre was <a href=\"https:\/\/www.telegraph.co.uk\/news\/2020\/05\/19\/women-can-have-abortions-home-christian-groups-challenge-blocked\/\" target=\"_blank\" rel=\"noreferrer noopener\">initially rejected by the High Court <\/a>back in May.<\/p>\n<p>However, the Court of Appeal has now granted permission for judicial review.<\/p>\n<p><strong>Significant problems<\/strong><\/p>\n<p>Since \u2018DIY\u2019 home abortions were introduced on 30 March, a number of significant problems have arisen.<\/p>\n<p>In May, it was <a href=\"https:\/\/righttolife.org.uk\/news\/uk-police-investigate-diy-abortion-of-28-week-old-baby-using-bpas-pills-by-post-service\/\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a> UK police were investigating the death of an unborn baby after its mother took \u2018DIY\u2019 home abortion pills while 28 weeks pregnant.<\/p>\n<p>In addition, abortion provider BPAS announced that it was investigating a further eight cases of women taking \u2018DIY\u2019 home abortion pills beyond the 10-week limit, raising questions over what checks are being conducted to ensure the law isn\u2019t being broken and dangerous later-term abortions aren\u2019t happening.<\/p>\n<p>A number of women have also come forward to <a href=\"https:\/\/righttolife.org.uk\/news\/more-woman-speak-out-about-diy-home-abortion-serious-problems-with-telemedicine-abortion-service\/\" target=\"_blank\" rel=\"noreferrer noopener\">share the serious problems<\/a> they\u2019ve experienced after taking \u2018DIY\u2019 home abortion pills.<\/p>\n<p>One woman said she went through <em>\u201chell\u201d<\/em> and thought she was going to die after taking the dangerous pills.<\/p>\n<p>Another woman said the pain and physical process was <em>\u201chorrible\u201d<\/em> and <em>\u201ca lot worse than expected\u201d<\/em>.<\/p>\n<p><strong>Government\u2019s dangerous U-turn allowing \u2018DIY\u2019 home abortions<\/strong><\/p>\n<p>Despite assurances from the Government that there would be <em>\u201cno change\u201d<\/em> to abortion regulations and that in-person consultations remain <em>\u201can essential safeguard\u201d<\/em> for women, the Government brought in a policy allowing \u2018DIY\u2019 home abortions shortly after lockdown began.<\/p>\n<p>The very substantial change was made without any public consultation, parliamentary scrutiny or debate.<\/p>\n<p>Prior to the change in regulations, abortions could only take place in hospitals or abortion clinics approved by the Secretary of State.<\/p>\n<p>Under the new \u2018temporary\u2019 policy, doctors are able to prescribe mifepristone and misoprostol over the phone or video platforms such as Facetime or Skype, meaning they will be left to pass their unborn child at home without direct medical supervision.<\/p>\n<p>The Government had initially stated its intention to allow \u2018DIY\u2019 abortions on 23 March, but backtracked later that day claiming the announcement had been <em>\u201cpublished in error.\u201d<\/em><\/p>\n<p>The government web page that had published the changes instead had the following message for visitors: <em>\u201cThe information on this page has been removed because it was published in error. This was published in error. There will be no changes to abortion regulations.\u201d<\/em><\/p>\n<p>Just one day later, the Health Secretary Matt Hancock <a href=\"https:\/\/hansard.parliament.uk\/Commons\/2020-03-24\/debates\/CCD4997B-275A-4A90-8DDF-7C26C5123885\/Covid-19Update?highlight=abortion#contribution-9CBA9B0F-FAFE-4CA2-A879-6D8E4F449E8F\" target=\"_blank\" rel=\"noreferrer noopener\">reassured<\/a> the House of Commons that there would be no change to any abortion laws in response to COVID-19.<\/p>\n<p><center><iframe loading=\"lazy\" src=\"https:\/\/www.facebook.com\/plugins\/video.php?href=https%3A%2F%2Fwww.facebook.com%2FRightToLifeUK%2Fvideos%2F235545411183693%2F&amp;show_text=0&amp;width=476\" width=\"476\" height=\"476\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/center>&nbsp;<\/p>\n<p>Additionally, Health Minister Lord Bethell <a href=\"https:\/\/bit.ly\/3dyiMtn\" target=\"_blank\" rel=\"noreferrer noopener\">made it very clear<\/a> that there were significant safety and safeguarding issues for women and young girls with the proposal.<\/p>\n<p>As the Coronavirus Bill was brought to the House of Lords on Wednesday 25 March, Lord Bethell rejected strongly, on behalf of the Government, the proposed changes to abortion law, stating:<\/p>\n<p><em>\u201c\u2026.we do not agree that women should be able to take both treatments for medical abortion at home. We believe that it is an essential safeguard that a woman attends a clinic, to ensure that she has an opportunity to be seen alone and to ensure that there are no issues.<\/em><\/p>\n<p><em>\u201cDo we really want to support an amendment that could remove the only opportunity many women have, often at a most vulnerable stage, to speak confidentially and one-to-one with a doctor about their concerns on abortion and about what the alternatives might be? The bottom line is that, if there is an abusive relationship and no legal requirement for a doctor\u2019s involvement, it is far more likely that a vulnerable woman could be pressured into have an abortion by an abusive partner.\u201d<\/em><\/p>\n<p>He also made it clear that it would be inappropriate to make this change without parliamentary scrutiny: <em>\u201cIt is not right to rush through this type of change in a sensitive area such as abortion without adequate parliamentary scrutiny.\u201d<\/em><\/p>\n<p>Despite these clear statements, the Government went against its own warnings and, in an incredible double U-turn, announced on 30 March it would allow \u2018DIY\u2019 home abortions.<\/p>\n<p>Through their legal challenge, the Christian Legal Centre wants the dangerous legislation overturned immediately and full disclosure of the Government\u2019s decision-making process and rationale.<\/p>\n<p><strong>Serious risk of harm and coercion<\/strong><\/p>\n<p>Their case is being backed by former Government Minister <a href=\"https:\/\/christianconcern.us2.list-manage.com\/track\/click?u=bed173cc9adfcad1e0e442a35&amp;id=abff933301&amp;e=a73568ce05\" target=\"_blank\" rel=\"noreferrer noopener\">Ann Widdecombe<\/a> and <a href=\"https:\/\/christianconcern.us2.list-manage.com\/track\/click?u=bed173cc9adfcad1e0e442a35&amp;id=f9f213e052&amp;e=a73568ce05\" target=\"_blank\" rel=\"noreferrer noopener\">Dr Gregory Gardner<\/a>.<\/p>\n<p>In an <a href=\"https:\/\/christianconcern.com\/wp-content\/uploads\/2018\/10\/CC-Resource-Misc-Gregory-Gardner-Witness-Statement-Abortion-200420.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">expert witness statement<\/a> for the High Court challenge, Dr Gregory Gardner, a longstanding GP and honorary clinical lecturer at the University of Birmingham, highlights the risk of serious injury and harm to women self-administering abortion pills.<\/p>\n<p><em>\u201cThe introduction of home abortions as proposed (notwithstanding the presence of a Covid-19 pandemic) is a policy that is more likely than not to depart from the essential tenets of duty of care through proper clinical assessment, thereby raising the risk of serious injury and harm being done to women self-administering Mifepristone and Misoprostol at home,\u201d<\/em> Dr Gardner wrote.<\/p>\n<p>In addition to citing risks of infection, haemorrhage, psychological trauma, and risk of future preterm birth, Dr Gardner explains how the Government\u2019s decision could result in more women being coerced into unwanted abortions.<\/p>\n<p>He said: <em>\u201cIt will be difficult if not impossible to verify by phone or video whether a woman is undergoing any kind of duress to have an abortion. There does not seem to have been any consideration given to this in the proposed change in policy. There will be women who need delicate counselling to discover coercion or other forms of abuse.\u201d<\/em><\/p>\n<p>Former Government minister Ann Widdecombe has also written a <a href=\"https:\/\/christianconcern.com\/wp-content\/uploads\/2018\/10\/CC-Resource-Misc-Ann-Widdecombe-Witness-Statement-Abortion-200420.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> to the high court in support of the legal challenge.<\/p>\n<p>In her statement, the former Shadow Health Secretary reveals the history of the legislation which has enabled health services in England, Scotland &amp; Wales to roll out \u2018DIY\u2019 abortions.<\/p>\n<p>During a parliamentary debate in 1990, Miss Widdecombe raised concerns that <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/1990\/37\/section\/37\" target=\"_blank\" rel=\"noreferrer noopener\">an amendment<\/a> to abortion legislation, allowing the Health Secretary to designate <em>\u201ca class of places\u201d<\/em> as suitable for abortions would inadvertently pave the way for \u2018DIY\u2019 home abortions.<\/p>\n<p>However, the author of the amendment, Robert Key MP, dismissed Miss Widdecombe\u2019s concerns and accused the then Conservative MP of speaking from <em>\u201cthe whip issued by the pro-life group\u201d<\/em> and misleading Parliament.<\/p>\n<p>The Health Secretary at the time, Kenneth Clarke, then <a href=\"https:\/\/publications.parliament.uk\/pa\/cm198990\/cmhansrd\/1990-06-21\/Debate-17.html\" target=\"_blank\" rel=\"noreferrer noopener\">assured<\/a> MPs that the legislation was not intended to legalise home abortions and that abortions would be <em>\u201cadministered only in closely regulated circumstances under the supervision of a registered medical practitioner\u201d.<\/em>30 years later, Ann Widdecombe\u2019s previously dismissed concerns have become a reality.When the legal challenge was launched, Ann Widdecombe <a href=\"https:\/\/christianconcern.com\/ccpressreleases\/government-to-face-urgent-judicial-review-on-diy-abortion-u-turn\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>: \u201c<em>Parliament was told one thing.
