Despite Minnesota <\/span>Governor Tim Walz<\/span><\/a> having banned \u201cnon-essential or elective\u201d procedures that require personal protective equipment (PPE), abortion facilities in the state have continued operating during the COVID-19 pandemic. The purpose of Walz\u2019s suspension of elective surgeries is to conserve PPE, but in defiance<\/a> of the governor\u2019s order, the State Department has not enforced the ban against Minnesota\u2019s abortion businesses.\u00a0 <\/span><\/p>\n

I<\/span>n response, the Thomas More Society has filed a <\/span>lawsuit<\/span><\/a> on behalf of Minnesota doctors against the governor, the Commissioner for the Minnesota Department of Health Jan Malcolm, and the five operating abortion businesses in the state.\u00a0<\/span>Additional <\/span>plaintiffs<\/span><\/a> in the suit include nurses, the AALFA Family Clinic, the American Association of Pro-Life Obstetricians and Gynecologists, Pro-Life Action Ministries, and several concerned individuals.<\/span><\/p>\n

\u201cNot only is the governor\u2019s action in allowing elective surgical abortion dangerously unsafe but critically and irresponsibly wasteful,” said\u00a0Thomas More Society Special Counsel\u00a0Erick Kaardal<\/a>.\u00a0“These elective abortion procedures take personal protective equipment away from hospitals, clinics, emergency rooms, doctors, nurses, and others on the frontlines of trying to stop the spread of the deadly coronavirus.\u201d<\/span><\/p>\n

The <\/span>lawsuit<\/span>\u00a0has requested that the enforcement of COVID-19 executive orders be enjoined \u201cunless and until those orders are amended or reinterpreted to prohibit surgical abortions.\u201d While the injunction aims to halt surgical abortions, it does not appear to be seeking a ban on chemical abortions.\u00a0<\/span><\/p>\n

Though the suit contends that administering the abortion pill uses less PPE, <\/span>chemical abortions<\/span><\/a> still carry the risk of complications that cannot be treated at the clinic. Serious <\/span>side effects<\/span><\/a> may require a hospital visit, which may expose women to COVID-19.\u00a0<\/span><\/p>\n

Back in March, <\/span>criticism<\/span><\/a> was leveled at Walz\u2019s temporary ban on elective surgeries because it did not specifically say if it would include abortion. The ban called for any \u201csurgery or procedure that can be delayed without undue risk to the current or future health of a patient.\u201d\u00a0<\/span><\/p>\n

Sarah Stoez<\/span><\/a>, president and CEO of Planned Parenthood North Central States, praised Walz for his actions, saying all abortions are \u201cessential.”\u00a0<\/span>Except abortion doesn\u2019t treat any <\/span>medical conditions<\/span><\/a>, and if a pregnant woman\u2019s health is endangered, <\/span>thousands of doctors<\/span><\/a> have already confirmed that preterm delivery is the best option to save both mother and child, not abortion.<\/span><\/p>\n

A spokesperson for the <\/span>Minnesota Department of Health<\/span><\/a> later confirmed that \u201cthe order does not apply to the full site of family planning services,” meaning despite the ban on elective procedures, abortion could continue. The Thomas More Society has stated in their lawsuit that this is a violation of the <\/span>Equal Protection Clause<\/span><\/a>.\u00a0<\/span><\/p>\n

Pro-choice advocacy groups want people to believe that abortion is\u00a0<\/span>healthcare<\/span><\/a>, b<\/span>ut abortionists are now being held to a different standard than other medical professionals during the COVID-19 crisis. Despite the fact that abortion has always been called a “choice” for women, abortion businesses have been allowed to continue operating during a global pandemic, while other non-essential surgeries have come to a halt.\u00a0<\/span><\/p>\n

\u201cI just think that it\u2019s indefensible to tell cancer patients they can\u2019t have a chemo treatment, a lifesaving chemo treatment, but it\u2019s OK for abortions to go forward,\u201d said Rep. Peggy Scott, R-Andover. \u201cI just think that\u2019s indefensible. And I think most of the public would agree.\u201d<\/p>\n
