The Supreme Court recently overturned a <\/span>1972 case<\/span><\/a> ruling that the Sixth Amendment required unanimous verdicts in state criminal cases. <\/span>Justice Brett Kavanaugh<\/span><\/a> sided with the majority in a 6-3 decision, and in his ruling, it seemed to some that he implied a willingness to overturn\u00a0<\/span>Roe v. Wade<\/span><\/i><\/a>.\u00a0<\/span><\/p>\n

Explaining the concept of <\/span>stare decisis<\/span><\/a> (to stand by things decided), <\/span>Kavanaugh<\/span><\/a> wrote that the doctrine of precedent does not mean the court can never overrule ones that are \u201cerroneous.\u201d Listing several cases, Kavanaugh appeared to vaguely mention <\/span>Roe v. Wade<\/span><\/i>, but it seemed to be in the context of <\/span>Planned Parenthood Southeastern Pennsylvania v. Casey<\/span><\/i><\/a>. In this 1992 ruling, the trimester framework of <\/span>Roe <\/span><\/i>was overturned, but legalized abortion was upheld, and it was determined that \u201cundue burdens\u201d could not be placed on abortion access. <\/span>It\u2019s not clear if <\/span>Kavanaugh<\/span><\/a> was implying <\/span>Roe v. Wade <\/span><\/i>could be overturned on the basis of \u201cerroneous precedent,\u201d as he did not mention the infamous 1973 ruling in the same paragraph as this phrase. <\/span><\/p>\n

Justice Clarence Thomas, however, was much more direct.\u00a0<\/span><\/p>\n

Joining the majority opinion in the case, <\/span>Thomas<\/span><\/a> listed three \u201cincorrect decisions\u201d by the Supreme Court: <\/span>Obergefell v. Hodges<\/span><\/i>, <\/span>Roe v. Wade<\/span><\/i>, and <\/span>Dred Scott v. Sandford<\/span><\/i>.\u00a0In each of these cases,\u00a0Thomas<\/a>\u00a0maintained the Supreme Court relied on faulty reasoning to deny due process rights. <\/span><\/p>\n

Thomas has been a <\/span>longtime critic<\/span><\/a> of <\/span>Roe<\/span><\/i>, and he has strongly implied that he\u2019s willing to overturn it. Speaking on the court\u2019s reliance on precedent for decisions, <\/span>Thomas<\/span><\/a> said, \u201cWhen faced with demonstrably erroneous precedent, my rule is simple: We should not follow it.\u201d\u00a0<\/span><\/p>\n

He went on to say how the U.S. Constitution should come before court precedent. <\/span>Thomas<\/span><\/a> called on the court to \u201crestore\u201d jurisprudence and focus on the \u201ccorrect, original meaning\u201d of the laws it interprets.\u00a0<\/span><\/p>\n

Both sides of the abortion debate have grown curious about whether or not the high court will soon overturn\u00a0<\/span>Roe v. Wade<\/span><\/i>, transferring control of abortion laws back to the states.\u00a0Last October, the\u00a0<\/span>Supreme Court<\/span><\/a>\u00a0heard a\u00a0<\/span>case involving a Louisiana law concerning admitting privileges<\/a>. Abortion groups like\u00a0<\/span>Planned Parenthood<\/span><\/a>\u00a0openly expressed their fear that the case,\u00a0<\/span>June Medical Services v. Russo<\/span><\/i><\/a>, would \u201cstrip away [women\u2019s] rights.\u201d\u00a0<\/span><\/p>\n

In actuality, the\u00a0<\/span>June<\/span><\/i>\u00a0case was concerned with the numerous safety violations taking place at\u00a0<\/span>Louisiana\u2019s abortion facilities<\/span><\/a>, such as improperly sanitizing instruments, failing to monitor patients, and so much more. All involved parties await a decision in the case.<\/span><\/p>\n

Proponents of abortion often tell us we need\u00a0<\/span>Roe v. Wade\u00a0<\/span><\/i>to protect thousands of women from dying in back-alley abortions. This not true, as\u00a0<\/span>Bernard Nathanson<\/span><\/a>\u00a0\u2013 one of the founders of the abortion movement \u2013 admitted years ago that the high number of illegal abortion deaths had been fabricated. But abortion businesses also have a\u00a0<\/span>disturbing trend<\/span><\/a>\u00a0of endangering women\u2019s lives and being resistant to even the most basic of safety standards, such as ensuring the competency of abortion providers.\u00a0<\/span><\/p>\n

How is that any safer than the back-alley abortions supporters of\u00a0<\/span>Roe\u00a0<\/span><\/i>would have us fear?<\/span><\/p>\n
