This information verifies the results of a 2015 <\/span><a href=\"https:\/\/www.centerformedicalprogress.org\/cmp\/investigative-footage\/\"><span style=\"font-weight: 400;\">undercover investigation<\/span><\/a><span style=\"font-weight: 400;\"> by David Daleiden and his Center for Medical Progress (CMP) team, an investigative endeavor that <\/span><a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/taking-away-basis-for-discredited-smear-campaign-planned-parenthood-declines-any-reimbursement-for-fetal-tissue-donation\"><span style=\"font-weight: 400;\">Planned Parenthood<\/span><\/a><span style=\"font-weight: 400;\"> has attempted to frame as deceptive for years. Currently, Daleiden and fellow CMP journalist Sandra Merritt are facing <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/judge-criminal-trial-center-medical-progress-proceed\/\"><span style=\"font-weight: 400;\">criminal charges<\/span><\/a><span style=\"font-weight: 400;\"> in a San Francisco court. In what is considered to be a blow to undercover journalism, this past fall, a civil trial found <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/center-for-medical-progess-guilty\/\"><span style=\"font-weight: 400;\">CMP<\/span><\/a><span style=\"font-weight: 400;\"> liable for damages to the abortion provider.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With the unsealed invoices showcasing the validity of their work, the question remains as to what impact this will have on CMP\u2019s case going forward, and what this could mean for the public\u2019s perception of it.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/9K82Oyd-lv8\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe jury verdict was $2.2 million roughly,\u201d said Peter Breen, an attorney for Daleiden from the Thomas More Society who spoke with <\/span><span style=\"font-weight: 400;\">Live Action News <\/span><span style=\"font-weight: 400;\">about developments in the case. \u201cThat includes damages troubled because of the RICO claim and punitive damages. That doesn\u2019t include [plaintiff] attorney fee claims, which would be in the millions of dollars.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Breen discussed how CMP&#8217;s legal team is attempting to reduce the amount of the verdict. He commented that they\u2019re always happy to get some relief, remarking that the jury verdict in the civil trial was \u201cabsolutely against every notion of justice.\u201d Breen stated how it went \u201cagainst the law as we understand it, and as the Constitution puts it.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So far, Breen said, there\u2019s been \u201climited success\u201d when it comes to persuading the District Court to be receptive to these arguments.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFor many of these rulings\u2026 we\u2019re going to need to bring a lot of requests to the District Court in order to preserve those issues to go up on appeal to the Ninth Circuit,\u201d Breen said, sharing what he could disclose of the legal strategy for now. \u201cSo if we don\u2019t get relief from the district judge, we would then be able to go up to the Ninth Circuit, and if we don\u2019t get sufficient relief from the Ninth Circuit, we\u2019ll take it to the U.S. Supreme Court.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But there still remains another issue, and according to Breen, Planned Parenthood has asked for a \u201cpermanent injunction\u201d against Daleiden and CMP. This would keep Daleiden, as well as anyone connected with CMP, from ever doing undercover work into the abortion provider again. Even though Planned Parenthood has requested the injunction, Breen says the District Court has not yet ruled on it.\u00a0<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/david-daleiden-attorneys-pro-life-undercover-journalism\/\">David Daleiden\u2019s attorneys: A blow to pro-life undercover journalism is a blow to all undercover journalism<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Breen classified these injunctions as \u201cvery serious,\u201d and said a ruling should come from the District Court any day now on the topic.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cYou\u2019d be taking one of the most skilled undercover journalists of our time and handcuffing him,\u201d Breen stated, praising Daleiden\u2019s efforts to expose criminal behavior in the abortion industry. \u201c\u2026 David has been very active in that space, so what you\u2019d be doing is taking one of the most effective people off the field.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He continued, saying, \u201cAnd really nowadays, where law enforcement has become so politicized\u2026 you can\u2019t get a law enforcement official to investigate abortion clinic abuses. In [blue] [states] it\u2019s often the undercover journalists who can get answers, who can uncover and document illegal activity and other offensive practices.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Speaking on the unredacted invoice records, Breen said they were proof of an issue that \u201cDaleiden has been banging the drum on\u2026 since day one.\u201d The documents came from the abortion businesses themselves, and had been given to Daleiden\u2019s legal team under \u201cprotective orders.\u201d Now the filings are visible to the public, which is fortunate, as Breen recounted the many <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/center-for-medical-progress-appeal\/\"><span style=\"font-weight: 400;\">restrictions<\/span><\/a><span style=\"font-weight: 400;\"> the defense faced in civil court.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe documents that were revealed to the public are only a fraction of what is out there, and what should have been available to us in a robust discovery process that you would have in a normal case,\u201d Breen said. \u201cTo some extent, this is an abortion case, so the rules are applied differently. Even though there\u2019s no reason for rules to be applied differently in an abortion case than in a regular civil lawsuit.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In regards to the response from StemExpress and Planned Parenthood to this new evidence, Breen stated that from what he understands, StemExpress has been \u201cvery quiet.\u201d He surmised this is because the procurement agency is still trying to sell fetal parts, and these invoice records clearly show their business model is \u201cillegal.\u201d\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/cz1gRNPgMvE\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">While Planned Parenthood has maintained the videos are a \u201csmear,\u201d Breen pointed out that the abortion provider <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/top-5-admissions-planned-parenthoods-aborted-babies\/\"><span style=\"font-weight: 400;\">confirmed<\/span><\/a><span style=\"font-weight: 400;\"> the accuracy of CMP\u2019s discovered content in court. Unfortunately, most of the mainstream media have assisted Planned Parenthood by putting what Breen calls a \u201cblackout\u201d on details related to the case. As Daleiden and Merritt prepare for a criminal trial in San Francisco (a \u201cvery tough place\u201d for pro-life people, says Breen), CMP needs all the help it can get.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case could have a \u201cchilling effect\u201d on undercover journalism, and Breen described how the task now is to bring attention to it through new media, and present the evidence to wider audiences.
