{"id":218239,"date":"2020-02-11T08:00:22","date_gmt":"2020-02-11T14:00:22","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=218239"},"modified":"2020-02-10T14:57:16","modified_gmt":"2020-02-10T20:57:16","slug":"born-alive-abortion-survivors-protection-act-back","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/born-alive-abortion-survivors-protection-act-back\/","title":{"rendered":"The Born-Alive Abortion Survivors Protection Act is back"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/www.nationalreview.com\/2020\/02\/the-born-alive-abortion-survivors-protection-act-is-back\/\">National Review<\/a>)\u00a0Congressional Republicans hope to pass legislation protecting infants who survive abortion procedures.<\/p>\n<p>On Tuesday, the Senate Judiciary Committee will hold a hearing on the\u00a0Born-Alive\u00a0Abortion Survivors Protection Act, which would require doctors to provide medical care to infants who survive attempted abortion procedures.<\/p>\n<p>The bill was in the spotlight exactly one year ago, after Virginia governor Ralph Northam suggested that, at least in some circumstances, mothers and doctors should be able to deny medical care to newborns who were meant to have been aborted. Immediately after those comments, Senator Ben Sasse (R., Neb.), the lead sponsor of the\u00a0born-alive\u00a0bill, reintroduced his legislation.<\/p>\n<p>\u201cWe\u2019re not talking about some euphemism,\u201d Sasse said at the time on the Senate floor. \u201cWe\u2019re not talking about a clump of cells. We\u2019re talking about a little baby girl who\u2019s been\u00a0born\u00a0and is on a table in a hospital or a medical facility, and then a decision or a debate would be had about whether or not you could kill that little baby.\u201d<\/p>\n<p>Here is what the\u00a0born-alive\u00a0bill does:<\/p>\n<ul>\n<li>creates criminal penalties for doctors who allow a newbornto die because they failed to provide medical care after the infant survived an attempted abortion procedure<\/li>\n<li>mandates that a childbornalive\u00a0in an abortion clinic be transported to a hospital for further care<\/li>\n<li>requires health-care practitioners to report any violations of the law<\/li>\n<li>institutes penalties for intentionally killing a newborn, including fines and up to five years\u2019 imprisonment<\/li>\n<li>grants the woman on whom the abortion is performed civil cause of action against the abortionist and protection from prosecution if her child is not cared for after birth<\/li>\n<\/ul>\n<p>Even though none of these provisions restricts abortion, after several weeks of debate, 44 Democratic senators voted to block the legislation, using a number of inaccurate arguments and disregarding the bill\u2019s text.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/babies-born-alive-abortions-continue\/\">CDC data proves babies still being born alive during abortions<\/a><\/em><\/strong><\/p>\n<p>\u201cThe effort to force a vote on this new bill with no public hearing or consideration by the committees that oversee health issues or the Judiciary Committee is also notable,\u201d said Senator Tim Kaine (D., Va.) in February 2019, in a statement announcing his vote against the bill.\u00a0\u201cA committee hearing is the normal way to make the case that legislation is needed.\u00a0The desire to avoid a public hearing suggests that the sponsors are aware that the bill is unjustified and unnecessary.\u201d<\/p>\n<p>The hearing this Tuesday, with testimony from several witnesses both for and against the legislation, will feature many of the same arguments that surfaced last time the bill was considered.<\/p>\n<p>Most Democrats who opposed the legislation last time around claimed that it is redundant or unnecessary. \u201cWe have laws against infanticide in this country,\u201d Senator Patty Murray (D., Wash.) said last year on the Senate floor when she rejected Sasse\u2019s request for unanimous consent to the legislation. \u201cThis is a gross misinterpretation of the actual language of the bill that is being asked to be considered, and therefore I object.\u201d<\/p>\n<p>But in fact, there is no existing federal law that requires doctors to provide medical care for infants who survive an abortion procedure. The\u00a0Born-Alive\u00a0Infants Protection Act (BAIPA) of 2002 established that the terms \u201cperson,\u201d \u201chuman being,\u201d \u201cchild,\u201d and \u201cindividual\u201d in federal law include every infant\u00a0born\u00a0alive, even after an abortion; it instituted no penalties for physicians who neglect to care for such infants.<\/p>\n<p>As of 2014, only 26 states mandated care for infants\u00a0born\u00a0alive\u00a0after an attempted abortion \u2014 and those state laws can, of course, be changed. The Reproductive Health Act enacted in New York last year, for example, explicitly repealed a statute that had extended all the protections of state laws to children\u00a0born\u00a0alive\u00a0during an abortion.<\/p>\n<p>Opponents of the\u00a0born-alive\u00a0bill have also argued that these sorts of cases never happen and that infants never survive attempted abortions. But they do. Reports from several states indicate that, while abortion survivors are rare, they\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/ten-babies-born-alive-abortions-2015-3-states\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/ten-babies-born-alive-abortions-2015-3-states\/&amp;source=gmail&amp;ust=1581441512679000&amp;usg=AFQjCNFcbGMa5IP7M2TSwPj1Ck4MAAHCug\">do exist<\/a>.\u00a0<a href=\"https:\/\/melissaohden.com\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/melissaohden.com\/&amp;source=gmail&amp;ust=1581441512680000&amp;usg=AFQjCNHnY1gBIz5Br-X5h-8Yg4lu9DAMeA\">Melissa Ohden<\/a>\u00a0and\u00a0<a href=\"http:\/\/giannajessen.com\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/giannajessen.com\/&amp;source=gmail&amp;ust=1581441512680000&amp;usg=AFQjCNFYusJz2Gg4Fb8BR5VOs22eykvO8g\">Gianna Jessen<\/a>\u00a0are two specific examples, and this\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=o1YciyJG3WQ&amp;feature=youtu.be\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.youtube.com\/watch?v%3Do1YciyJG3WQ%26feature%3Dyoutu.be&amp;source=gmail&amp;ust=1581441512680000&amp;usg=AFQjCNHojmkSK_36-ERw7z1Y2ljCYVgE0A\">recent ad<\/a>\u00a0showcases several more.<\/p>\n<p>Or consider the gruesome case of former abortionist Kermit Gosnell, who is currently serving life in prison in part for illegally modifying late-term-abortion procedures, delivering live infants, and using scissors to sever their spinal columns. There is no federal law prohibiting that practice.<\/p>\n<p>During the Senate debate over the\u00a0born-alive\u00a0legislation, a number of Democrats argued that the bill is \u201canti-abortion\u201d and that it would place the government between doctors and their patients, preventing medical professionals from giving the best possible care.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/eyewitness-born-alive-abortion-drowned-saline\/\">Eyewitness: Babies born alive after abortion were drowned in saline<\/a><\/em><\/strong><\/p>\n<p>\u201cIt makes no sense for Washington politicians who know nothing about these individual circumstances to say they know better than the doctors, patients, the family,\u201d said Senate minority leader Chuck Schumer (D., N.Y.) at the time. \u201cThe bill is solely meant to intimidate doctors and restrict patients\u2019 access to care and has nothing, nothing, nothing to do with protecting children.\u201d<\/p>\n<p>But the bill doesn\u2019t specify any particular type of medical care at all, nor does it place any restrictions on when or whether an abortion may be performed. It requires only that doctors give \u201cthe same degree\u201d of care to abortion survivors that \u201cany other child\u00a0born\u00a0alive\u00a0at the same gestational age\u201d would receive if delivered at that stage of pregnancy.<\/p>\n<p>Last year\u2019s fight over the bill featured most\u00a0<a href=\"https:\/\/www.nationalreview.com\/corner\/debunking-media-falsehoods-on-the-born-alive-bill\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nationalreview.com\/corner\/debunking-media-falsehoods-on-the-born-alive-bill\/&amp;source=gmail&amp;ust=1581441512680000&amp;usg=AFQjCNGsaJlE6gzYFn3DGm4PvqJJYej9Xw\">media outlets<\/a>\u00a0parroting the claims of Democratic lawmakers, disregarding the bill\u2019s text, and insisting that Republicans were \u201cweaponizing abortion\u201d to paint Democrats as radical.
