Shockingly, under the current law, even those with what are considered \u201chigh-functioning\u201d disabilities such as Asperger\u2019s or other mild forms of autism, can be forcibly sterilized without their knowledge or consent, or with diminished consent under severe pressure from family or other authorities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The regressive policy has come under fire from international human rights organizations in recent years. According to article 156 of the <\/span><a href=\"https:\/\/www.legislationline.org\/download\/id\/6443\/file\/Spain_CC_am2013_en.pdf\"><span style=\"font-weight: 400;\">Spanish criminal code<\/span><\/a><span style=\"font-weight: 400;\">, all that is necessary to carry out this act is a judge\u2019s authorization and acknowledgement of the \u201cincapacity\u201d of the individual in question. <\/span><a href=\"http:\/\/www.edf-feph.org\/sites\/default\/files\/edf_forced-sterilisation_8-accessible_5.pdf\"><span style=\"font-weight: 400;\">A 2018 report<\/span><\/a><span style=\"font-weight: 400;\"> from the European Disability Forum showed that, from 2010-2013, 400 women &#8212; whom doctors deemed as having some form of disability regardless of mental capacity &#8212; were forcibly sterilized in Spain. The report highlights the story of a deaf woman who was sterilized without her consent.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cAnd these are just the cases we know about,\u201d a report in <\/span><a href=\"https:\/\/www.equaltimes.org\/a-new-report-highlights-the?lang=en#.XisyLchKjIW\"><span style=\"font-weight: 400;\">Equal Times<\/span><\/a><span style=\"font-weight: 400;\"> points out. \u201cFar more often, forced sterilization procedures don\u2019t leave traces in official records because doctors typically go it alone, performing sterilizations on women with no due process.\u201d<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/deaf-japan-coerced-abortion-sterilization\/\">Report: Deaf people in Japan were coerced into abortion and sterilization<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">When Ciudadanos party MP Sara Gimenez brought the issue to public consciousness in a <\/span><a href=\"https:\/\/twitter.com\/SaraGimnez\/status\/1219306610889232386\"><span style=\"font-weight: 400;\">tweet<\/span><\/a><span style=\"font-weight: 400;\"> in January, <\/span><a href=\"https:\/\/www.euronews.com\/2020\/01\/21\/spain-debates-bill-to-scrap-forced-sterilisation-of-disabled-people\"><span style=\"font-weight: 400;\">Euronews<\/span><\/a><span style=\"font-weight: 400;\"> illustrated the problem with the story of Cristina, who was diagnosed with autism at the age of 18. Her parents immediately pressured her to undergo a tubal ligation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThey kept telling me that it would be irresponsible to have sex because I could get pregnant; that I was not going to be able to take on the responsibility of being a mother,\u201d she told EuroNews. \u201cThat, as I was Asperger, my children would also be born Asperger; and this insistence fixed in my mind the idea that I was not capable of having children.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The pervasive societal belief at the heart of the policy is that persons with disabilities cannot be good mothers, or that the disability would be passed on and the resulting child would be a \u201cburden,\u201d both on the family and on the state which sometimes lacks appropriate resources.
