The legal foundation of abortion in Roe v. Wade, the Supreme Court decision that legalized abortion on demand throughout the United States, is nonsense. In a newly released Live Action video, Live Action president Lila Rose details what led up to the decision and what it was based upon. As viewers will see, the case is based upon the most shockingly questionable of premises.<\/p>\n

As\u00a0previously<\/a> documented, Roe was actually decided by men<\/em> in a 7-2 ruling. The women in the case, Norma McCorvey (Jane Roe) and Sandra Cano (Mary Doe in the companion Doe v. Bolton<\/em> case), claimed they were lied to and used by activist attorneys seeking to legalize abortion.<\/p>\n

Prior to Roe<\/em>, abortion was still\u00a0illegal<\/a>\u00a0in many states, except to save the life of the mother. As a result, abortion enthusiasts and organizations led<\/a> by men\u00a0fabricated<\/a>\u00a0the idea that a high number of women were dying annually from illegal<\/em> abortions. The truth? I<\/span>n the year Roe was decided (1973), the CDC reports that 19 women died from illegal <\/i><\/b>abortion while 25 died from legal <\/i><\/b>abortion. Today, when women die<\/a> from legal<\/em> abortion, abortion supporters are silent.<\/span><\/p>\n

Roe v. Wade<\/em> case and Doe v. Bolton<\/em> were\u00a0argued<\/a>\u00a0together. They were presented two times before the High Court,\u00a0first in December of 1971 just after\u00a0Justices Hugo Black and John Marshall Harlan II retired from the bench.\u00a0Nixon appointed replacements, Justice Lewis F. Powell Jr. and\u00a0William H. Rehnquist, did not join the court until January of 1972. As such, the case was re-argued<\/a>\u00a0the following October.<\/p>\n

A decision in the cases favoring legalized abortion was rendered on January 22, 1973. These two cases combined essentially allowed for unrestricted abortion on demand in all months of pregnancy. The language of Roe originated years earlier when it was drafted by the American Law Institute’s (ALI)\u00a0Model Penal Code<\/a>\u00a0on abortion.<\/p>\n
