{"id":217167,"date":"2020-01-20T15:17:22","date_gmt":"2020-01-20T21:17:22","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=217167"},"modified":"2020-01-20T16:30:14","modified_gmt":"2020-01-20T22:30:14","slug":"vermont-abortion-preborn-twins-killed","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/vermont-abortion-preborn-twins-killed\/","title":{"rendered":"Vermont&#8217;s extreme abortion law prevents justice for preborn twins killed"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"http:\/\/lifesitenews.com\/\">LifeSiteNews<\/a>) \u2013 In the\u00a0<a href=\"https:\/\/www.mynbc5.com\/article\/bennington-crash-victim-seeks-fetal-homicide-law\/3292958\">summer of 2009<\/a>, Patricia Blair was driving home from shopping with her husband and children when a reckless 22-year-old woman named Kelly Cook veered into their lane of travel, striking Mrs. Blair\u2019s minivan head-on. Her husband suffered permanent injuries from broken bones, and Patricia\u2019s back was broken. But much worse, Patricia was six-months pregnant with twins, and when she woke up in the hospital she was told both had been killed.<\/p>\n<p>In most states, the offender could be charged with homicide. But not in Vermont, where all efforts to afford such protections to pregnant women have been callously resisted by extremist abortion \u201crights\u201d activists. Vermont\u2019s Supreme Court specifically highlighted this shortcoming in the 1989 case of\u00a0<a href=\"https:\/\/casetext.com\/case\/state-v-oliver-198\">State v Oliver<\/a>, noting that the responsibility for interpreting the term \u201cperson\u201d in the criminal statutes was a \u201c&#8230;task that must be accomplished by the legislature.\u201d<\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/vermont-senate-amendment-abortion-consitutional\/\"><em>Vermont Senate approves amendment adding abortion to state constitution<\/em><\/a><\/strong><\/p>\n<p>The Vermont legislature has no intention of accomplishing that task &#8212; quite the contrary. This despite the\u00a0<a href=\"https:\/\/thefederalist.com\/2019\/03\/20\/vermonts-terrifying-abortion-law-removes-protections-pregnant-victims\/\">glaring contrast<\/a>\u00a0that doctors in Vermont\u00a0<em>can<\/em>\u00a0be sued for medical malpractice where negligence is averred to have caused fetal death\u00a0<em>in utero<\/em>\u00a0(<a href=\"https:\/\/casetext.com\/case\/vaillancourt-v-medical-center-hosp-of-vt\">Vaillancourt v. Medical Center Hospital of Vermont<\/a>, 1980).<\/p>\n<p><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/410\/113\/\">Roe v Wade<\/a>\u00a0(1972) specifically determined that states hold a \u201ccompelling government interest\u201d to protect that viable third-trimester child:<\/p>\n<p style=\"padding-left: 30px;\"><em>As we have intimated above, it is reasonable and appropriate for a State to decide that, at some point in time another interest, that of health of the mother or that of potential human life, becomes significantly involved. The woman&#8217;s privacy is no longer sole and any right of privacy she possesses must be measured accordingly. (at p. 159)<\/em><\/p>\n<p>What has been particularly dishonest, even vile, in Vermont\u2019s pit-bull justification for the continuing unhindered performance of third-trimester abortions has been the absurd pretense that it is \u201cprotecting the Roe decision\u201d from incursions by a Kavanaugh Court. But Vermont has very deliberately\u00a0<em>negated<\/em>\u00a0Roe\u2019s specific recognition of fetal personhood in the third trimester, and an attempted amendment to its\u00a0<a href=\"https:\/\/vtdigger.org\/2019\/02\/07\/house-panel-passes-abortion-bill-within-hours-hearing\/\">zealous H 57 abortion law<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/vermont-passes-bill-to-enshrine-unlimited-unrestricted-abortion-until-birth\">recognize fetal personhood<\/a>\u00a0was quickly crushed by the progressive majority in 2019. Vermont\u2019s current law is now surpassed in its extremism only by the nation of China.<\/p>\n<p>As I stated in my\u00a0<a href=\"https:\/\/legislature.vermont.gov\/Documents\/2020\/WorkGroups\/Senate%20Health%20and%20Welfare\/Bills\/H.57\/Written%20Testimony\/H.57~John%20Klar~Testimony~4-19-2019.pdf\">written (and oral) testimony<\/a>\u00a0before the Vermont Senate Committee on Health and Welfare charged with taking (and promptly discarding) public comment on this bill:<\/p>\n<p style=\"padding-left: 30px;\"><em>In its self-appointed crusade to champion women\u2019s rights, Vermont is uninterested in protecting women from criminal actors who kill their unborn children; reckless in its readiness to extinguish an existing right in malpractice law. But this life in the womb, especially as it approaches the daylight of delivery (where it is safe from arbitrary torture and execution), cannot be ignored, not even by the Vermont legislature. Often, it cannot be ignored by the women who take a life this way, like Nora Leah Nelson McCovey. Vermont has not protected women in response to Oliver in the 30 years elapsed; it has not done a thing since Roe (46 years) to protect \u201cfetal life after viability,\u201d something that even secular North Korea, Russia, and France (waiting period also) do. This is not about religion &#8212; it is about being civilized, regardless of religion.<\/em><\/p>\n<p>Following my testimony,\u00a0<a href=\"https:\/\/legislature.vermont.gov\/Documents\/2020\/WorkGroups\/Senate%20Health%20and%20Welfare\/Bills\/H.57\/Written%20Testimony\/H.57~Patricia%20Blair~Testimony~4-19-2019.pdf\">Patricia Blair addressed the same group<\/a>\u00a0of callous bureaucrats, a trip she has made in futility many times for nearly a decade.<\/p>\n<p>This disrespected mother stood by as the unrepentant killer of her children was sentenced to\u00a0<a href=\"https:\/\/www.benningtonbanner.com\/stories\/update-driver-sentenced-in-vermont-fetal-death-crash,73786\">30 months to 20 years<\/a>\u00a0in prison &#8212; and released after serving 13 months, despite pre-sentencing probation violations which led the prosecutor \u201c&#8230;<a href=\"https:\/\/www.benningtonbanner.com\/stories\/woman-pleads-guilty-in-crash-that-killed-fetuses,67832\">to argue against<\/a>\u00a0any kind of probationary or deterred sentence.\u201d<\/p>\n<p>Vermont has gone too far. The shallow abuse of \u201cwomen\u2019s rights\u201d to deprive pregnant women of the most fundamental of legal protections has grown stale, and the public is catching on to just how extremist are these faux-defenders. Efforts have been made to lie about these \u201cprocedures,\u201d but they have failed.<\/p>\n<p>It is time for the\u00a0<a href=\"https:\/\/www.libertynation.com\/will-enshrining-abortion-rights-backfire-on-vermont\/\">pendulum to swing<\/a>\u00a0back in the Vermont legislature, in the direction of justice.\u00a0<a href=\"https:\/\/www.americanthinker.com\/articles\/2019\/04\/in_vermont_and_kansas_babies_arent_people_until_they_leave_their_mothers_wombs.html\">Barbarism<\/a>\u00a0and dishonesty have held sway far too long, and Vermonters must stand and vote in 2020 if their pregnant women and unborn children are to have the barest of shields from criminals. Vermont is in the throes of an opioid crisis, where substance abusers are afforded rights (and free suboxone and methadone) but babies may be killed with impunity &#8212; Kelly Cook was in possession of narcotics at the scene of the crash.<\/p>\n<p>Democrats have barred women like Patricia\u00a0<a href=\"https:\/\/www.mynbc5.com\/article\/bennington-crash-victim-seeks-fetal-homicide-law\/3292958\">from justice<\/a>:<\/p>\n<p style=\"padding-left: 30px;\"><em>First, my heart goes out to the Blair family,&#8221; said Rep. Rachel Weston, a Burlington Democrat, who opposes the Illuzzi bill. &#8220;Violent crimes against pregnant women are a real problem, but I don&#8217;t think fetal personhood put forth in this bill is the answer. There can be unintended consequences both for women&#8217;s health and fetal health.<\/em><\/p>\n<p>Vermont\u2019s Attorney General has\u00a0<a href=\"https:\/\/www.americanthinker.com\/blog\/2019\/09\/vermont_claims_the_right_to_compel_healthcare_workers_to_kill_babies.html\">brought suit<\/a>\u00a0claiming healthcare workers who refuse to participate in abortion \u201c<a href=\"http:\/\/www.truenorthreports.com\/checking-the-fact-checkers\">procedures<\/a>\u201d are unfit to care for their patients. And a recent record request to discover his office\u2019s connections with Planned Parenthood revealed that there are more than 3,000 emails between the Vermont Attorney General\u2019s Office and Planned Parenthood &#8212; but it will\u00a0<a href=\"https:\/\/www.lifesitenews.com\/opinion\/vermont-attorney-general-demands-7k-to-release-state-correspondence-with-planned-parenthood\">cost $7,232<\/a>\u00a0to\u00a0<a href=\"https:\/\/ie.gofundme.com\/f\/view-vermont039s-records\">obtain them<\/a>.<\/p>\n<p>When he signed H 57 in 2019,\u00a0<a href=\"https:\/\/www.americanthinker.com\/articles\/2019\/09\/vermont_conservatives_have_had_enough_of_their_rino_governor.html\">RINO Governor Phil Scott<\/a>\u00a0hid behind the pathetic ruse that he deferred to the\u00a0<a href=\"http:\/\/www.truenorthreports.com\/using-the-doctor-patient-privilege-to-kill\">doctor and patient<\/a>\u00a0to decide when to perform even third-trimester abortions, but avoided consideration of fetal homicide in the bargain. Obviously, a doctor and patient do not decide whether a criminal will be charged for killing an unborn child, deliberately (domestic violence cases) or with gross negligence.<\/p>\n<p>Patricia Blair would like the nation to know what she has suffered.
