{"id":216738,"date":"2020-01-10T16:19:24","date_gmt":"2020-01-10T22:19:24","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=216738"},"modified":"2020-01-10T01:00:58","modified_gmt":"2020-01-10T07:00:58","slug":"supreme-court-doj-equal-rights-amendment-expired","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/supreme-court-doj-equal-rights-amendment-expired\/","title":{"rendered":"Supreme Court, Department of Justice agree: Equal Rights Amendment expired decades ago"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/www.nationalreview.com\/bench-memos\/olc-equal-rights-amendment-expired-decades-ago\/\">National Review<\/a>)\u00a0In a <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/highly-dubious-ratification-tally-for-equal-rights-amendment\/\" target=\"_blank\" rel=\"noopener noreferrer\">post<\/a> a year ago, I highlighted the highly dubious claim by supporters of the Equal Rights Amendment that the amendment remained ripe for ratification and that it was only one state short of the threshold needed for ratification. As I pointed out, the seven-year period for ratification that was part of Congress\u2019s proposal of the ERA expired in 1979. Further, even if one were to assume that Congress lawfully extended the ratification deadline by majority vote in 1978, that extended deadline expired in 1982. Even supporters of the ERA recognized that they needed to start over after the 1982 deadline passed. And by dismissing as moot in October 1982 a case challenging the validity of that deadline extension, the Supreme Court clearly signaled its own judgment that ratification of the ERA had failed.<\/p>\n<p>In September, Justice Ginsburg herself <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/justice-ginsburg-era-ratification-process-would-need-to-start-over-again\/\" target=\"_blank\" rel=\"noopener noreferrer\">recognized<\/a> that the ratification process would need to \u201cstart[] over again.\u201d<\/p>\n<p>So it\u2019s no surprise, and ought not to be controversial, that the Department of Justice\u2019s Office of Legal Counsel has issued an <a href=\"https:\/\/www.justice.gov\/olc\/file\/1232501\/download\" target=\"_blank\" rel=\"noopener noreferrer\">opinion<\/a> advising the National Archives that the ERA proposed in 1972 long ago expired and that, in the event that another state were to purport to ratify that amendment, the National Archives should not and could not certify the ERA to be part of the Constitution. Given that OLC\u2019s advice binds the National Archives, this opinion ought to put an end to the ratification charade.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/equal-rights-amendment-damaging-women\/\">Why the Equal Rights Amendment could actually be damaging to women<\/a><\/em><\/strong><\/p>\n<p>Here is the concluding paragraph of OLC\u2019s 38-page opinion:<\/p>\n<p style=\"padding-left: 30px;\"><em>For the reasons set forth above, we conclude that the ERA Resolution has expired and is no longer pending before the States. Even if one or more state legislatures were to ratify the 1972 proposal, that action would not complete the ratification of the amendment, and the ERA\u2019s adoption could not be certified under 1 U.S.C. \u00a7 106b. In addition, we conclude that when Congress uses a proposing clause to impose a deadline on the States\u2019 ratification of a proposed constitutional amendment, that deadline is binding and Congress may not revive the proposal after the deadline\u2019s expiration. Accordingly, should Congress now \u201cdeem [the ERA] necessary,\u201d U.S. Const. art.
