Whenever they invoke \u201cautonomy,\u201d for instance, it\u2019s to claim a right to kill someone else. But <em>actual<\/em> autonomy &#8211; like, for instance, the right to run your own business the way you want &#8211; is alien to them.<\/p>\n<p>Unfortunately, such confused souls sometimes hold positions of great power over the rest of us. On Friday, federal district court judge Carol Jackson <a href=\"http:\/\/www.lifenews.com\/2012\/10\/01\/judge-dismisses-suit-hhs-mandate-no-threat-to-religious-freedom\/\">threw out<\/a> a small Catholic business owner\u2019s lawsuit against ObamaCare\u2019s HHS mandate, saying Frank O\u2019Brien doesn\u2019t qualify as a \u201creligious employer\u201d and that his business won\u2019t be \u201csubstantial[ly] burden[ed].\u201d Saith Judge Jackson:<\/p>\n<blockquote><p>The challenged regulations do not demand that plaintiffs alter their behavior in a manner that will directly and inevitably prevent plaintiffs from acting in accordance with their religious beliefs. Frank O\u2019Brien is not prevented from keeping the Sabbath, from providing a religious upbringing for his children, or from participating in a religious ritual such as communion. Instead, plaintiffs remain free to exercise their religion, by not using contraceptives and by discouraging employees from using contraceptives. The burden of which plaintiffs complain is that funds, which plaintiffs will contribute to a group health plan, might, after a series of independent decisions by health care providers and patients covered by OIH\u2019s plan, subsidize someone else\u2019s participation in an activity that is condemned by plaintiffs\u2019 religion. This Court rejects the proposition that requiring indirect financial support of a practice, from which plaintiff himself abstains according to his religious principles, constitutes a substantial burden on plaintiff\u2019s religious exercise.<\/p>\n<p>[T]he health care plan will offend plaintiffs\u2019 religious beliefs only if an OIH employee (or covered family member) makes an independent decision to use the plan to cover counseling related to or the purchase of contraceptives.\u00a0\u00a0 Already, OIH and Frank O\u2019Brien pay salaries to their employees\u2014money the employees may use to purchase contraceptives or to contribute to a religious organization. By comparison, the contribution to a health care plan has no more than a de minimus impact on the plaintiff\u2019s religious beliefs than paying salaries and other benefits to employees.<\/p><\/blockquote>\n<p>This morning, <em>National Review<\/em> judicial analyst Ed Whelan <a href=\"http:\/\/www.nationalreview.com\/bench-memos\/329043\/aggressive-decision-against-religious-liberty-ed-whelan\">dismantled<\/a> Jackson\u2019s reasoning, noting that the fine\u2019s financial burden &#8211; \u201ca $100\/per day tax for every employee\u201d and \u201cannual fines of $2000 for every employee\u201d &#8211; is indeed \u201csubstantial,\u201d and that by conceding that \u201cit is appropriate [to] take into account the effect on the religious beliefs of certain religious employers,\u201d the Department of Health &amp; Human Services has implicitly conceded that the determination whether or not to cover contraception is an exercise of religion. Whelan also points to Professor Rob Vischer\u2019s <a href=\"http:\/\/mirrorofjustice.blogs.com\/mirrorofjustice\/2012\/10\/forcing-a-church-to-pay-for-its-employees-abortions-would-not-create-a-substantial-burden-on-religio.html\">observations<\/a>:<\/p>\n<blockquote><p>[T]he court accepts the equivalency (for\u00a0&#8220;substantial burden&#8221; purposes) of paying salaries and paying for particular services under a health plan.\u00a0 (&#8220;Already, [plaintiffs] pay salaries to their employees &#8212; money the employees may use to purchase contraceptives or to contribute to a religious organization.\u00a0 By comparison, the contribution to a health care plan has no more than a de minimis impact on the plaintiff&#8217;s religious beliefs than paying salaries and other benefits to employees.&#8221;)\u00a0 This\u00a0misses the\u00a0scandal that is created by more direct complicity with the illicit ends.\u00a0 If a Belmont Abbey College employee were to bring the invoice from an abortion provider to\u00a0work and demand that her employer pay it, is that really the same as using salary to pay the abortion provider?\u00a0 For purposes of determining whether a government requirement amounts to a substantial burden on the employer&#8217;s religious exercise, apparently it is.<em> <\/em><\/p><\/blockquote>\n<p>At its heart, the <a href=\"http:\/\/standupforreligiousfreedom.com\/mandate\/\">HHS mandate<\/a> is founded on flawed understandings of the nature of government power and religious liberty that completely reverse the meaning of both principles. First is the presumption that the federal government\u2019s scope is open-ended, extending to most anything a majority decides would be a good idea and its only limits being whatever the <a href=\"http:\/\/www.law.cornell.edu\/constitution\/\">Constitution<\/a> specifically forbids. The truth is <a href=\"\/news\/analysis\/obamacare-tramples-constitution\/\">precisely the opposite<\/a>: the Constitution doesn\u2019t give the feds power to do <em>anything<\/em> except the limited number of duties it expressly authorizes. It is <em>the people\u2019s<\/em> freedom, not the government\u2019s, which should be presumed to be open-ended in matters that don\u2019t infringe on their neighbors\u2019 rights. Neither Congress nor the federal bureaucracy has been constitutionally authorized to manage private businesses\u2019 insurance policies, and the decision of what to offer your employees falls firmly within the scope of personal freedom and voluntary association.<\/p>\n<p>Second, the idea that we\u2019re entitled to religious freedom only if we fit some narrowly defined subset of religious organizations is downright poisonous. The <a href=\"http:\/\/www.law.cornell.edu\/constitution\/first_amendment\">First Amendment<\/a> guarantees <em>everyone\u2019s<\/em> right to the \u201cfree exercise of religion\u201d by ordering Congress to make \u201cno law\u201d that would infringe on it. As a principle America <a href=\"http:\/\/www.loc.gov\/exhibits\/religion\/\">owes its very existence to<\/a> perhaps more than to any other, religious liberty is non-negotiable, and any attempt to undermine it should be met with the deepest suspicion and resistance. Government deciding whom it will and won\u2019t recognize as \u201creligious\u201d is a naked attempt to get around the Free Exercise Clause, and accepting such a precedent would all but destroy religious liberty in this country.<\/p>\n<p>Lest you feel inclined to give the Obama administration\u2019s intentions the benefit of the doubt, recall that they <a href=\"\/news\/politics\/kathleen-sebelius-admits-she-didnt-bother-to-ensure-contraception-mandate-was-constitutional\/\">barely even pretend<\/a> to care about the constitutionality of their actions.
