{"id":215810,"date":"2019-12-27T14:50:01","date_gmt":"2019-12-27T20:50:01","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=215810"},"modified":"2024-04-26T17:42:39","modified_gmt":"2024-04-26T22:42:39","slug":"fda-vaping-products-illegal-abortion-pill","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/fda-vaping-products-illegal-abortion-pill\/","title":{"rendered":"The FDA cracks down on vaping products, but seems slow to end illegal abortion pill sales"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>In yet another example of pro-abortion hypocrisy, websites illegally dispensing the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/report-medication-abortion-nearly-40-percent-abortions\/\" target=\"_blank\" rel=\"noopener\">abortion pill<\/a> remain active and online while websites illegally selling vaping products will soon be shut down by the FDA, which regulates both.<\/p>\n<p>A recent <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-dea-seize-44-websites-advertising-sale-illicit-thc-vaping-cartridges-us-consumers-part-operation?utm_campaign=122019_PR_FDA%2C%20DEA%20seize%20sites%20advertising%20sale%20of%20illicit%20THC%20vape%20cartridges&amp;utm_medium=email&amp;utm_source=Eloqua\" target=\"_blank\" rel=\"noopener\">press release<\/a>\u00a0noted that the <a href=\"https:\/\/www.dea.gov\/press-releases\/2019\/12\/20\/dea-and-fda-shut-down-44-websites-advertising-illegal-vaping-cartridges\" target=\"_blank\" rel=\"noopener\">DEA<\/a> and FDA &#8220;seized 44 websites advertising the sale of illicit vaping cartridges containing tetrahydrocannabinol (THC)&#8230;. The action, which is part of Operation Vapor Lock, reflects ongoing work by federal, state and local authorities to investigate the supply chain of vaping products associated with recent lung injuries.&#8221;\u00a0The FDA action took place despite the agency admitting, &#8220;To date, none of the products advertised on the 44 websites have been confirmed to be linked to any cases of lung injury&#8230;.&#8221;<\/p>\n<p>Under an FDA safety protocol called\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2019_04_11_REMS_Full.pdf\">REMS<\/a>,\u00a0the abortion pill (which consist of\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/nda\/2016\/020687Orig1s020TOC.cfm\" target=\"_blank\" rel=\"noopener\">mifepristone<\/a>\u00a0\u2013 or Mifeprex \u2013 and Misoprostol) can only be ordered, prescribed, and dispensed by and under the supervision of a hospital or clinic. In addition, there are requirements in place to confirm important details like gestational age and any possible ectopic pregnancies.\u00a0Yet, today, <a href=\"https:\/\/archive.liveaction.org\/news\/fda-probes-mail-abortion-pill-diy\/\" target=\"_blank\" rel=\"noopener\">websites<\/a> clearly identified by the FDA as illegally dispensing the abortion pill online against the REMS requirements continue to operate with impunity.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/dTsUsy30Q8A\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>Recently, illegal online abortion pill domains have popped up en masse, often defended by abortion advocates <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-tweets-diy-abortion-safe\/\" target=\"_blank\" rel=\"noopener\">pushing<\/a> for &#8220;self-managed&#8221; DIY abortion. Abortion advocates then <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-groups-tell-women-lie-miscarriage\/\" target=\"_blank\" rel=\"noopener\">advise<\/a> women who experience complications after using illegally obtained abortion pills to present to the ER and claim they are suffering natural miscarriages. This, of course, means that any deaths or injuries are labeled as pregnancy\/miscarriage complications instead of abortion pill complications. In 2018, the\u00a0Charlotte Lozier Institute <a href=\"https:\/\/lozierinstitute.org\/fact-sheet-online-sales-of-mifeprex-and-misoprostol-for-self-abortion\/\" target=\"_blank\" rel=\"noopener\">published<\/a> a fact sheet exposing the reality that \u201c72 unique websites\u201d were selling the pills online. In April 2018, the pro-abortion <a href=\"https:\/\/www.contraceptionjournal.org\/article\/S0010-7824(17)30475-4\/fulltext\" target=\"_blank\" rel=\"noopener\">Journal Contraception<\/a>\u00a0was able to &#8220;identif[y] 18 websites and order[] 22 [abortion pill products]&#8230; an FDA spokesperson told Live Action News.<\/li>\n<li>March of 2019, the FDA&#8217;s\u00a0Health Fraud Branch sent an\u00a0<a href=\"https:\/\/www.fda.gov\/consumers\/rebel-ltd-abortion-onlinecom-abortionrxcom-and-more\" target=\"_blank\" rel=\"noopener\">abuse complaint<\/a> to\u00a0Rebel Ltd., for websites that offered &#8220;misbranded and unapproved new drugs (e.g. a combination pack of mifepristone and misoprostol tablets, marketed as \u201cAbortion Pill Pack\u201d) for sale to U.S. consumers.&#8221;<\/li>\n<\/ul>\n<p>The FDA told Live Action News in an e-mail that &#8220;failure to correct the violations of the law may result in FDA regulatory action, <strong>including seizure or injunction<\/strong>, without further notice.&#8221;<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2018\/10\/FDA-warns-onsumers-to-not-buy-abortion-pills-over-the-internet.jpg\" alt=\"Image: FDA warns consumers to not buy abortion pills over the internet (Image: FDA)\" width=\"710\" height=\"239\" \/><\/p>\n<p class=\"wp-caption-text\" style=\"text-align: center;\">Image: FDA warns consumers to not buy abortion pills over the internet (Image: FDA)<\/p>\n<p><strong>What happened after FDA warnings were sent?<\/strong><\/p>\n<ul>\n<li>Live Action News has\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/lawmakers-fda-illegal-abortion-pill-online\/\">previously<\/a>\u00a0documented\u00a0that after the FDA sent a warning letter to\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/lawmakers-fda-illegal-abortion-pill-online\/\">Aid Access<\/a>, the group\u00a0<a href=\"https:\/\/aidaccess.org\/en\/page\/561\">announced<\/a>\u00a0its intent to defy the FDA\u2019s\u00a0<a href=\"https:\/\/www.fda.gov\/inspections-compliance-enforcement-and-criminal-investigations\/warning-letters\/aidaccessorg-575658-03082019\">warnings<\/a>\u00a0to \u201cimmediately cease\u201d dispension of the drugs.<\/li>\n<li>In May 2019, <a href=\"https:\/\/archive.liveaction.org\/news\/lawmakers-fda-illegal-abortion-pill-online\/\" target=\"_blank\" rel=\"noopener\">100 lawmakers<\/a> sent a\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/lawmakers-fda-illegal-abortion-pill-online\/\">letter<\/a>\u00a0to the FDA requesting for the agency to monitor Aid Access for illegally dispensing abortion pills.\u00a0The Congressional\u00a0<a href=\"https:\/\/burgess.house.gov\/uploadedfiles\/burgess_and_roby_fda_letter_2019.pdf\">letter<\/a>\u00a0urged the FDA to \u201ccontinue to conduct oversight\u201d of <a href=\"https:\/\/www.fda.gov\/inspections-compliance-enforcement-and-criminal-investigations\/warning-letters\/aidaccessorg-575658-03082019\">Aid Access<\/a>\u00a0where pills are prescribed by an abortionist in the Netherlands and filled by a pharmacy in India.<\/li>\n<\/ul>\n<div id=\"attachment_215860\" style=\"width: 657px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-215860\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-215860\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/NBC-report-on-Aid-Access-defying-FDA-warning-to-cease-dispensing-illegal-abortion-pill.jpg\" alt=\"Image: NBC News report on Aid Access defying FDA warning to cease dispensing illegal abortion pill\" width=\"647\" height=\"538\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/NBC-report-on-Aid-Access-defying-FDA-warning-to-cease-dispensing-illegal-abortion-pill.jpg 647w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/NBC-report-on-Aid-Access-defying-FDA-warning-to-cease-dispensing-illegal-abortion-pill-300x249.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/NBC-report-on-Aid-Access-defying-FDA-warning-to-cease-dispensing-illegal-abortion-pill-500x416.jpg 500w\" sizes=\"(max-width: 647px) 100vw, 647px\" \/><p id=\"caption-attachment-215860\" class=\"wp-caption-text\">NBC News report on Aid Access defying FDA warning to cease dispensing illegal abortion pill<\/p><\/div>\n<p>In May 2019, the FDA told Live Action News, &#8220;We cannot comment on a potential future action at this time, but we remain very concerned about the sale of unapproved mifepristone for medical termination of early pregnancy on the <a href=\"https:\/\/web.archive.org\/web\/20190618153330\/https:\/\/www.fda.gov\/drugs\/postmarket-drug-safety-information-patients-and-providers\/mifeprex-mifepristone-information\">Internet<\/a>, because this bypasses important safeguards designed to protect women\u2019s health. Unapproved drugs purchased from foreign internet sources are not the FDA-approved versions of the drugs, and therefore, they are not subject to FDA-regulated manufacturing controls or FDA inspection of manufacturing facilities. Drugs that have circumvented regulatory safeguards may be contaminated, counterfeit, contain varying amounts of active ingredients, or contain different ingredients altogether.&#8221;<\/p>\n<p><strong>FDA history of domain suspensions<\/strong><\/p>\n<p>The FDA <a href=\"https:\/\/www.fda.gov\/safety\/report-problem\/reporting-unlawful-sales-medical-products-internet\" target=\"_blank\" rel=\"noopener\">encourages<\/a> consumers to &#8220;[r]eport a website that you think is illegally selling human drugs, animal drugs, medical devices, biological products, foods, dietary supplements or cosmetics.&#8221; And the FDA has a history of <a href=\"https:\/\/www.fda.gov\/consumers\/health-fraud-scams\/seizures-and-injunctions-health-fraud\" target=\"_blank\" rel=\"noopener\">seizing drugs<\/a> and suspending or shutting down websites that violate their regulations&#8230; except, it seems, when the illegal pills are abortion drugs.<\/p>\n<ul>\n<li><a href=\"https:\/\/web.archive.org\/web\/20130307212103\/http:\/\/www.fda.gov\/NewsEvents\/Newsroom\/PressAnnouncements\/ucm322492.htm\" target=\"_blank\" rel=\"noopener\">2012<\/a>: FDA shutdown of more than\u00a018,000 illegal pharmacy websites, seized $10.5 million worth of pharmaceuticals worldwide.<\/li>\n<li><a href=\"https:\/\/web.archive.org\/web\/20160601223946\/http:\/\/www.fda.gov\/NewsEvents\/Newsroom\/PressAnnouncements\/ucm358794.htm\" target=\"_blank\" rel=\"noopener\">2013<\/a>: FDA\u2019s Office of Criminal Investigations, in coordination with United States Attorney&#8217;s Office for District of Colorado, seized and shut down 1,677 illegal pharmacy websites.<\/li>\n<li><a href=\"https:\/\/www.wsj.com\/articles\/icann-regulators-clash-over-illegal-internet-drug-sales-1414463403\" target=\"_blank\" rel=\"noopener\">2014<\/a>: Wall Street Journal reported, &#8220;FDA teamed with Interpol and dozens of countries to try to shut down more than 1,300 websites suspected of selling drugs without a prescription.&#8221;<\/li>\n<li><a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-targets-unlawful-internet-sales-illegal-prescription-medicines-during-international-operation\" target=\"_blank\" rel=\"noopener\">2016<\/a>:\u00a0FDA took action against 4,402 websites that &#8220;illegally sell potentially dangerous, unapproved prescription drugs to U.S. consumers&#8230;. The FDA conducted extensive inspections at International Mail Facilities (IMFs) in coordination with U.S. Customs and Border Protection, and sent formal complaints to domain registrars requesting the suspension of the 4,402 websites.&#8221;<\/li>\n<li><a href=\"https:\/\/www.washingtonpost.com\/news\/to-your-health\/wp\/2017\/09\/25\/fda-targets-hundreds-of-rogue-websites-illegally-selling-opioids-and-other-prescription-drugs\/\" target=\"_blank\" rel=\"noopener\">2017<\/a>: Washington Post reported the FDA &#8220;targeted more than 500 websites it said were illegally selling unapproved\u00a0versions of prescription medications&#8230; .The FDA&#8230; focused on websites that illegally sell opioids online and ship them through the U.S. postal system to U.S. consumers. The agency said it sent 13 warning\u00a0<a href=\"https:\/\/www.fda.gov\/NewsEvents\/Newsroom\/PressAnnouncements\/ucm577178.htm\">letters<\/a>\u00a0to the operators of more than 400 websites and seized nearly 100 domain names&#8230;.&#8221;<\/li>\n<li><a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-launches-global-operation-crack-down-websites-selling-illegal-potentially-dangerous-drugs\" target=\"_blank\" rel=\"noopener\">2018<\/a>: During Operation Pangea XI, FDA sent warning letters to seven different networks&#8230; operating&#8230; 465 websites offering misbranded and unapproved drugs to U.S. consumers. More than 450 domain names were brought to the attention of search engines and the appropriate domain name registries and registrars.\u00a0FDA investigators found products attempting to make their way into the country from places such as India, the United Kingdom, China and El Salvador; 794 products were refused entry into the U.S.<\/li>\n<\/ul>\n<p>While we wait for the FDA to seize illegally dispensed abortion drugs or suspend their websites, Aid Access <a href=\"https:\/\/aidaccess.org\/en\/media\/inline\/2019\/5\/16\/19_05_16_gomperts_letter_and_exhibit_a.pdf\" target=\"_blank\" rel=\"noopener\">admitted<\/a> that\u00a0in 2018, the group\u00a0<a href=\"https:\/\/www.guttmacher.org\/sites\/default\/files\/report_pdf\/abortion-incidence-service-availability-us-2017.pdf\">reportedly<\/a>\u00a0filled 2,500 prescriptions of the illegal abortion pills, filled by a &#8220;pharmacy in India.&#8221; A\u00a0<a href=\"https:\/\/assets.documentcloud.org\/documents\/6390359\/Access-Aid-Verified-Complaint-With-Exhibits.pdf\">lawsuit<\/a>\u00a0later filed by the group noted it had actually shipped\u00a0<em>7,131 abortion pills<\/em>\u00a0to women in the U.S. between March 30, 2018, and August 27, 2019, well after the FDA\u2019s warning letter was sent &#8212; a deliberate violation of the FDA demand.<\/p>\n<div id=\"attachment_215851\" style=\"width: 707px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-215851\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-215851\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/Aid-Access-responds-to-FDA-warning-letter-admits-illegally-dispensing-abortion-pills.jpg\" alt=\"Image: Aid Access responds to FDA warning letter admits illegally dispensing abortion pills\" width=\"697\" height=\"142\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/Aid-Access-responds-to-FDA-warning-letter-admits-illegally-dispensing-abortion-pills.jpg 697w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/Aid-Access-responds-to-FDA-warning-letter-admits-illegally-dispensing-abortion-pills-300x61.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2019\/12\/Aid-Access-responds-to-FDA-warning-letter-admits-illegally-dispensing-abortion-pills-500x102.jpg 500w\" sizes=\"(max-width: 697px) 100vw, 697px\" \/><p id=\"caption-attachment-215851\" class=\"wp-caption-text\">Aid Access responds to FDA warning letter admits illegally dispensing abortion pills<\/p><\/div>\n<p>According to an October 2019 article published by the New York Times, &#8220;Nearly 1,300<a title=\"\" href=\"https:\/\/www.cdc.gov\/tobacco\/basic_information\/e-cigarettes\/severe-lung-disease.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0people<\/a>, disproportionately young, have been sickened from vaping THC, nicotine or both. At least<strong> 29 have died<\/strong>.&#8221; Yet, in\u00a0<a href=\"https:\/\/www.fda.gov\/downloads\/Drugs\/DrugSafety\/PostmarketDrugSafetyInformationforPatientsandProviders\/UCM603000.pdf\" target=\"_blank\" rel=\"noopener\">2018<\/a>, the FDA\u00a0<a href=\"https:\/\/www.fda.gov\/Drugs\/DrugSafety\/PostmarketDrugSafetyInformationforPatientsandProviders\/ucm492705.htm\" target=\"_blank\" rel=\"noopener\">updated<\/a>\u00a0its adverse effects reports on just\u00a0<em>legally<\/em> dispensed abortion pills, revealing\u00a0<strong>24 deaths<\/strong>\u00a0of women associated with the abortion pill since its approval. The report\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/women-die-abortion-pill-fda-generic\/\" target=\"_blank\" rel=\"noopener\">documents<\/a>\u00a0that <em>legally<\/em> dispensed abortion pills have caused nearly\u00a04,200 reported adverse effects, including 1,042 hospitalizations, nearly\u00a0600 instances of blood loss requiring transfusions and other serious complications. But, as Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-men-legalize-expand-abortion\/\" target=\"_blank\" rel=\"noopener\">previously<\/a> noted, under\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/nda\/2016\/020687Orig1s020RemsR.pdf\" target=\"_blank\" rel=\"noopener\">2016 changes<\/a>, abortion pill manufacturer\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/secrecy-abortion-pill-maker-investors\/\" target=\"_blank\" rel=\"noopener\">DANCO<\/a>\u00a0<em><strong>no longer has to report non-fatal adverse effects<\/strong><\/em>, so we can only imagine what the number really is.<\/p>\n<p><em><strong>Editor&#8217;s Note, 4\/18\/21<\/strong>:\u00a0The FDA has received reports of serious adverse events in women who took Mifeprex. As of December 31, 2018, there were reports of 24 deaths of women associated with Mifeprex since the product was approved in September 2000, including two cases of ectopic pregnancy resulting in death; and several cases of severe systemic infection (also called sepsis), including some that were fatal.\u00a0<\/em><\/p>\n<p><em>The adverse events cannot with certainty be causally attributed to mifepristone because of concurrent use of other drugs, other medical or surgical treatments, co-existing medical conditions, and information gaps about patient health status and clinical management of the patient.
