{"id":206295,"date":"2019-07-12T17:26:59","date_gmt":"2019-07-12T22:26:59","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=206295"},"modified":"2019-08-05T13:35:10","modified_gmt":"2019-08-05T18:35:10","slug":"kentucky-expands-protections-pregnant-women-workplace","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/kentucky-expands-protections-pregnant-women-workplace\/","title":{"rendered":"Kentucky passes law expanding protections for pregnant women in the workplace"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>In April, Kentucky governor <a href=\"https:\/\/archive.liveaction.org\/news\/appeals-court-aclu-kentucky-abortion-ultrasounds\/\">Matt Bevin<\/a> signed the <a href=\"https:\/\/apps.legislature.ky.gov\/record\/19RS\/SB18.html\">Kentucky Pregnant Workers Act<\/a> into law to help <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-dark-pregnancy-discrimination\/\">end pregnancy discrimination<\/a>. The law amends the current <a href=\"https:\/\/kchr.ky.gov\/Pages\/default.aspx\">Kentucky Civil Rights Act<\/a>\u00a0and expands on the protections of the federal Pregnancy Discrimination Act, the Americans with Disabilities Act, and the Family Medical Leave Act. The new law is different from past state and national legislation because, according to <a href=\"https:\/\/www.disabilityleavelaw.com\/2019\/04\/articles\/uncategorized\/kentucky-adopts-pregnant-workers-act\/\">disability law firm Jackson Lewis<\/a>, &#8220;It requires employers to accommodate employees who are\u00a0<em>limited<\/em>\u00a0\u2013not just disabled under the ADAAA or KCRA,\u00a0or unable to perform an essential function of their job due to serious health condition under the FMLA.&#8221; Lewis reports that these accommodations may include:<\/p>\n<ul>\n<li>More frequent or longer breaks<\/li>\n<li>Time off to recover from childbirth<\/li>\n<li>Acquisition or modification of equipment<\/li>\n<li>Appropriate seating<\/li>\n<li>Temporary transfer to a different job<\/li>\n<li>Modified schedules<\/li>\n<li>Light duty<\/li>\n<li>Private space to express breastmilk other than a bathroom<\/li>\n<\/ul>\n<p>The Kentucky Pregnant Workers Act took effect on June 27th and applies to companies employing 15 or more people during at least 20 weeks of each calendar year.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/nike-discriminated-pregnant\/\">Female athletes say Nike discriminated against them for getting pregnant<\/a><\/em><\/strong><\/p>\n<p>Of note, also: previous legislation has applied to <a href=\"https:\/\/www.monster.com\/career-advice\/article\/whats-the-difference-between-exempt\">non-exempt<\/a> employees only, and limited the length of required accommodations for breastfeeding to one year. This new law impacts <a href=\"https:\/\/www.monster.com\/career-advice\/article\/whats-the-difference-between-exempt\">exempt<\/a> employees as well,\u00a0and does not limit the length of breastfeeding accommodations to one year postpartum.<\/p>\n<p>Groups like <a href=\"https:\/\/www.facebook.com\/FeministsForLife\/posts\/bipartisan-support-resulted-in-a-kentucky-law-for-pregnant-women-and-new-moms-th\/10157470725176882\/\">Feminists for Life<\/a>\u00a0and <a href=\"https:\/\/www.wsaz.com\/content\/news\/New-law-secures-pregnant-womens-rights-at-work-511860781.html?fbclid=IwAR3AGmdXzLR1hxDO-jgGI0j_iE8w0RhXyBWqtSoGn3igzja7h1adj_VWY5o\">pregnancy resource centers<\/a> hailed the bipartisan law as a step forward for pregnant women, making it easier for them to choose life without risking <a href=\"https:\/\/archive.liveaction.org\/news\/nike-discriminated-pregnant\/\">loss of income<\/a> or <a href=\"https:\/\/archive.liveaction.org\/news\/irish-women-pilots-claim-told-abortion-fired\/\">job security<\/a> due to pregnancy.<\/p>\n<p>Feminists for Life president Serrin Foster said, &#8220;May this be replicated in any state that currently does not afford protection. When you listen, care, and problem-solve, it really isn&#8217;t all that hard for most employers \u2014 or universities \u2014 to offer a private space for lactation or more frequent breaks. Most mothers I know are fierce workers who multitask and give as good as they get. No matter what size company or campus, by working together, we can always do more and better, which is good for everyone.&#8221;<\/p>\n<p><a href=\"https:\/\/www.stites.com\/resources\/client-alerts\/kentucky-employers-new-pregnancy-worker-accommodation-law-becomes-effective-june-27-2019\">Other commentaries<\/a> on the new law noted that its broad wording will likely mean a headache for Human Resources departments in the state, as they determine the finer points on how it corresponds with previously enacted legislation. Still, a law that supports both mother and child represents a <a href=\"https:\/\/archive.liveaction.org\/news\/the-pregnant-workers-fairness-act-because-choosing-life-shouldnt-cost-you-your-job\/\">commonsense step<\/a> in the right direction for pregnant women in Kentucky.
