The <a href=\"http:\/\/alisondb.legislature.state.al.us\/alison\/searchableinstruments\/2019RS\/bills\/HB314.htm\">bill<\/a> will not hold women who have abortions criminally or civilly responsible, and there is an exception in the bill to allow abortion &#8220;to prevent a serious health risk&#8221; to the woman, though many doctors agree that abortion is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-never-medically-health-care\/\">never actually medically necessary<\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pro-abortion activists\u2019 claims surrounding Alabama\u2019s pro-life bill are a continuation of the misinformation being spread around pro-life bills passed recently in several states. Live Action News recently <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/women-miscarry-jailed-georgia-heartbeat-myths-debunked\/\">debunked<\/a><span style=\"font-weight: 400;\"> myths surrounding Georgia\u2019s Heartbeat Bill. <\/span><span style=\"font-weight: 400;\">Here we will decipher between fact or fiction regarding Alabama\u2019s recently passed <\/span><a href=\"http:\/\/alisondb.legislature.state.al.us\/alison\/searchableinstruments\/2019RS\/bills\/HB314.htm\">Human Life Protection Act<\/a>.<\/p>\n<p><span style=\"font-weight: 400;\">Live Action News previously <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/strongest-pro-life-bills-heads-alabama-governor\/\">covered<\/a><span style=\"font-weight: 400;\"> that the Alabama bill: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cmake[s] abortion and attempted abortion felony offenses except in cases where abortion is necessary in order to prevent a serious health risk to the unborn child\u2019s mother.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> \u201cwould provide that a woman who receives an abortion will not be held criminally culpable or civilly liable for receiving the abortion.\u201d Only the doctor committing the abortion would be held criminally liable.\u201d<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Let\u2019s address a few myths pro-abortion activists are spreading. <\/span><\/p>\n<p><b>CLAIM: Women will be criminally prosecuted for abortions.<\/b><\/p>\n<p><b>FALSE<\/b><span style=\"font-weight: 400;\">. The bill clearly states that women will not be held criminally liable.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Relating to abortion\u2026 to provide that a woman who receives an abortion will <\/span><b>not<\/b><span style=\"font-weight: 400;\"> be held criminally culpable or civilly liable for receiving the abortion\u2026.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Section 5 states, \u201cNo woman upon whom an abortion is performed or attempted to be performed shall be criminally or civilly liable\u2026.\u201d<\/span><\/p>\n<p><b>CLAIM: Women who miscarry will be punished.<\/b><\/p>\n<p><b>FALSE<\/b><span style=\"font-weight: 400;\">: Abortion is NOT a miscarriage. Abortion is the intentional killing of a preborn child. Miscarriage occurs naturally. Abortion is clearly defined in the bill as, \u201cThe use or prescription of any instrument, medicine, drug, or any other substance or device with the intent to terminate the pregnancy of a woman known to be pregnant with knowledge that the termination by those means will with reasonable likelihood cause the death of the unborn child.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bill states clearly: \u201cThe term [abortion] does <\/span><b>not<\/b><span style=\"font-weight: 400;\"> include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">activities done with intent to save the life or preserve health of an unborn child.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">remove dead unborn child. <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">deliver unborn child prematurely to avoid serious health risk to unborn child\u2019s mother, or preserve health of unborn child.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">a procedure or act to terminate the pregnancy of a woman with an ectopic pregnancy,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">the procedure or act to terminate the pregnancy of a woman when the unborn child has a lethal anomaly.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Alabama is not trying to penalize women who miscarry. Let\u2019s be intellectually honest and fair to the drafters of the bill. The bill clearly defines abortion as the <\/span><i><span style=\"font-weight: 400;\">intentional<\/span><\/i><span style=\"font-weight: 400;\"> killing of a preborn child. That is very different than a spontaneous miscarriage, in which a baby, unfortunately, passes away naturally.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/bHe8YGPGzj4\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><b>CLAIM: The Alabama law does not allow for any exceptions.<\/b><\/p>\n<p><b>FALSE<\/b><span style=\"font-weight: 400;\">: The bill states, \u201cAn abortion shall be permitted if an attending physician licensed in Alabama determines that an abortion is necessary in order to prevent a serious health risk to the unborn child\u2019s mother. Except in the case of a medical emergency as defined herein, the physician\u2019s determination shall be confirmed in writing by a second physician licensed in Alabama\u2026.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bill, however, does not permit abortion for rape or incest. Statistics show that only a very small <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fraction-abortions-rape-incest-health\/\">fraction<\/a><span style=\"font-weight: 400;\"> of abortions are committed for rape, incest, or mother\u2019s health. U.S. law is intended to punish the criminal &#8212; in this case, the rapist &#8212; not the victims, which are in this case the baby and mother.<\/span><\/p>\n<p><b>CLAIM: Pro-lifers want to punish children who are victims of rape\/incest.<\/b><\/p>\n<p><b>FALSE<\/b><span style=\"font-weight: 400;\">: The pro-life community seeks support, equality, and protection for both the mother and child. But abuse does not justify abortion. The guilty party in a sexual assault case is the rapist, who should be punished as severely as the law permits. Rapists, however, don\u2019t face the death penalty &#8212; so why should an innocent child be sentenced to death for the crimes of his father? \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With this Alabama law, children conceived in unfortunate<\/span> <span style=\"font-weight: 400;\">circumstances will be legally protected by law and given a chance at life. <\/span><span style=\"font-weight: 400;\">Abortion does not undo rape. Adding the violence of abortion on top of sexual assault only further inflicts violence upon an innocent woman. Every person\u2019s humanity is determined not by how wanted he or she is, or the circumstances surrounding his or her conception, but by the fact that he or she is a human being.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Live Action and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/investigative-report-planned-parenthood-complicity\/\">Live Action News<\/a><span style=\"font-weight: 400;\"> have <\/span><a href=\"https:\/\/www.liveaction.org\/what-we-do\/investigations\/aidingabusers\/\">documented<\/a><span style=\"font-weight: 400;\"> how abortion is used to perpetuate rape.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Pregnant teens or pre-teens are a <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-ignoring-red-flags-sexual-abuse\/\">red flag<\/a><span style=\"font-weight: 400;\"> for possible sexual abuse.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Rapists take victims to <\/span><a href=\"https:\/\/www.childpredators.com\/cases\/\">abortion facilities<\/a><span style=\"font-weight: 400;\"> to cover crime.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-ignored-sexual-abuse\/\">Planned Parenthood<\/a><span style=\"font-weight: 400;\"> and abortion providers often <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/aiding-abusers-sexual-predators-planned-parenthood\/\">fail to report<\/a><span style=\"font-weight: 400;\"> suspicion of abuse in violation of law and requirements to receive federal tax dollars under <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/regulation-remove-title-x-funding-planned-parenthood\/\">Title X<\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Majority of <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/majority-trafficked-forced-abort-help\/\">sex trafficked<\/a><span style=\"font-weight: 400;\"> women may be forced to abort.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Even when victims <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/attorney-sexual-abuse-planned-parenthood\/\">tell<\/a><span style=\"font-weight: 400;\"> Planned Parenthood they were raped, court records show they were\u00a0<\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-abusers-26-collective-years\/\">returned<\/a><span style=\"font-weight: 400;\">\u00a0to their rapists.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/archive.liveaction.org\/news\/celebrities-ignore-planned-parenthood-abusers\/\">Hollywood<\/a><span style=\"font-weight: 400;\">,\u00a0<\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-journalists-ignore-sexual-abuse\/\">pro-abortion<\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/how-planned-parenthood-and-friends-lend-hand-harvey-weinsteins-of-world\/\">media<\/a>,<span style=\"font-weight: 400;\"> and abortion-supportive politicians fail to call out Planned Parenthood.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Last year, Live Action News <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/alabama-abortion-facility-sexual-abuse\/\">reported<\/a><span style=\"font-weight: 400;\"> how an abortion facility in Alabama failed to report abortions committed on an underage girl.<\/span><\/p>\n<p><b>CLAIM: Men are leading the way to ban abortion<\/b><\/p>\n<p><b>FALSE<\/b><span style=\"font-weight: 400;\">: This bill, HB314, was sponsored by a female lawmaker, Representative Terri Collins, and was signed into law by female Governor Kay Ivey. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pro-life organizations are led by women. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> Supreme Court decision, on the other hand, was imposed by all men.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In fact, the decriminalization of abortion was <\/span><a href=\"https:\/\/youtu.be\/T3KFXqOCE7c\">led<\/a><span style=\"font-weight: 400;\"> by men. Live Action News <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/8-ways-men-pushed-abortion\/\">previously<\/a><span style=\"font-weight: 400;\"> detailed eight ways pro-abortion men pushed abortion in the days leading up to Roe.<\/span><\/p>\n<p><b>CLAIM: Doctors would receive 99 years in prison if convicted under this new law.<\/b><\/p>\n<p><b>FALSE<\/b><span style=\"font-weight: 400;\">: As with any felony, the law provides a <em>range<\/em> of punishment options. According to <\/span><a href=\"https:\/\/www.montgomeryadvertiser.com\/story\/sports\/2019\/05\/14\/alabama-abortion-bill-vote-senate-rape-incest-details-law\/3669839002\/\">local media<\/a><span style=\"font-weight: 400;\">, \u201cUnder the law, performing an abortion would be considered a Class A felony, which carries a sentence of life or 10 to 99 years in prison.\u201d<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 7: \u201cThis act shall <\/span><b>not<\/b><span style=\"font-weight: 400;\"> apply to a physician\u2026 performing a termination of a pregnancy or assisting in performing a termination of a pregnancy due to a medical emergency\u2026.\u201d<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/www.criminaldefenselawyer.com\/resources\/criminal-defense\/felony-offense\/alabama-felony-class.htm\">legal site<\/a><span style=\"font-weight: 400;\"> explains how the state organizes felonies: \u201cThe state of Alabama organizes felony crimes into three levels: Class A, Class B, and Class C felonies. Class A felonies include crimes that are considered the most serious, while Class B and Class C crimes are less serious\u2026Every felony offense in Alabama is punishable by at least one year and one day in a state prison. Depending on the circumstances of the crime and its severity level, a felony conviction can result in a wide range of sentences.\u201d<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Class A. No less than 10 years and no more than life or 99 years.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Class B. No less than two years and no more than 20 years.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Class C. Supreme Court Justices pulled the \u201cright\u201d from the Fourteenth Amendment, known for giving citizenship and equal rights under the law to former slaves and African Americans.
