Human Rights Committee has taken broad aim at pro-life laws and policies in the United States.\u00a0Meeting last month, the Committee<a href=\"http:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=6QkG1d%2fPPRiCAqhKb7yhsijKy20sgGcLSyqccX0g1nlYhE7dxYvkfnqbOgGjt0WN%2bV80Vhr%2fCeDA%2fmavqFwov8pSVO80BC2Blh%2f7I%2bUBsm%2f7%2buQp4Oidt1KdSgRNH5%2f4\"> called<\/a> on the Trump administration to \u201creview\u201d a number of its pro-life policies, suggesting that these were incompatible with international law. The Committee singled out for criticism President Trump\u2019s Mexico City Policy,<a href=\"https:\/\/www.pop.org\/u-n-committee-launches-attack-on-u-s-pro-life-laws\/?eType=EmailBlastContent&amp;eId=83ba042a-3d38-4d9b-9f50-254bd36e8b7a#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> his executive order \u201cProtecting Free Speech and Religious Liberty,\u201d and his executive order which protects religious employers like the Little Sisters of the Poor from being forced against their religious beliefs to pay for contraceptives in their employer-sponsored health plans.<\/p>\n<p>Specifically, the Committee called for the Trump administration to explain the \u201ccompatibility\u201d of these pro-life policies with the International Covenant on Civil and Political Rights (ICCPR), suggesting that the U.S. is bound by its own Constitution and by international law to observe the Committee\u2019s interpretation of this international human rights treaty as legitimating abortion.<\/p>\n<p>What is driving this new assault on American efforts to protect the unborn is the Committee\u2019s General Comment no. 36\u2014a document <a href=\"https:\/\/www.pop.org\/states-must-legalize-abortion-says-u-n-human-rights-committee\/\">adopted<\/a> late last year by the Human Rights Committee that <a href=\"https:\/\/tbinternet.ohchr.org\/Treaties\/CCPR\/Shared%20Documents\/1_Global\/CCPR_C_GC_36_8785_E.pdf\">claims<\/a> that every country that has ratified the treaty \u201cmust provide\u2026legal and effective access to abortion\u201d in cases of rape, incest, health of the mother, and when the pregnancy \u201cis not viable.\u201d<\/p>\n<p>The Committee has <a href=\"http:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=6QkG1d%2fPPRiCAqhKb7yhsijKy20sgGcLSyqccX0g1nlYhE7dxYvkfnqbOgGjt0WN%2bV80Vhr%2fCeDA%2fmavqFwov8pSVO80BC2Blh%2f7I%2bUBsm%2f7%2buQp4Oidt1KdSgRNH5%2f4\">ordered<\/a> the Trump administration to respond to its inquiry \u201cin the light of the Committee\u2019s General Comment No. 36.\u201d What the Committee did not say was that General Comment No. 36 is the very <a href=\"https:\/\/www.pop.org\/states-must-legalize-abortion-says-u-n-human-rights-committee\/\">first<\/a> document ever adopted by a U.N. treaty body to suggest that the ICCPR treaty, or any other U.N. treaty, requires countries to legalize abortion. Nor did it mention that its radical interpretation of the treaty has been rejected by a number of countries.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/CFZDhM5Gwhk\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>The Committee also took sweeping aim at the hundreds of pro-life laws that have been passed in the U.S. on the state level over the past few years. Explain how these pro-life state laws are in compliance with U.S. obligations under the ICCPR Treaty, the Committee told the Trump administration.<\/p>\n<p>The U.N. Committee did not specify which state-level abortion restrictions it wanted the U.S. Government to review in particular, but broadly <a href=\"http:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=6QkG1d%2fPPRiCAqhKb7yhsijKy20sgGcLSyqccX0g1nlYhE7dxYvkfnqbOgGjt0WN%2bV80Vhr%2fCeDA%2fmavqFwov8pSVO80BC2Blh%2f7I%2bUBsm%2f7%2buQp4Oidt1KdSgRNH5%2f4\">requested<\/a> that the administration include any pro-life laws which \u201crestrict women\u2019s access to reproductive health and abortion services and create new barriers to them in practice.\u201d<\/p>\n<p>One can understand why international abortion advocates are in panic mode over state-level initiatives to protect life. Literally hundreds of pro-life laws have already been enacted by various states over the past few years. Just since January 1 of this year, more than <a href=\"https:\/\/www.lifesitenews.com\/news\/41-states-have-introduced-over-250-pro-life-laws-since-january-planned-parenthood-complains\">250 new pro-life laws<\/a> have been introduced in state legislatures. And these laws restricting abortions have been saving many lives, as Michael New has recently <a href=\"https:\/\/lozierinstitute.org\/how-the-legal-status-of-abortion-impacts-abortion-rates\/\">documented<\/a>.<\/p>\n<p>While the U.S. Supreme Court\u2019s decisions in <i>Roe v. Wade<\/i> and <i>Planned Parenthood v. Casey<\/i> prevent states from banning abortion outright, states have successfully banned abortion after 20 weeks when a child can feel pain, required <a href=\"https:\/\/www.msn.com\/en-us\/news\/us\/supreme-court-asked-to-void-abortion-clinic-law\/ar-BBW2sA7?OCID=ansmsnnews11\">basic health standards<\/a> for abortion facilities, prohibited taxpayer funding for abortion, [and] provided women seeking abortion with <a href=\"http:\/\/www.cnn.com\/2011\/POLITICS\/05\/20\/texas.abortion.sonogram\/index.html\">informed<\/a><a href=\"https:\/\/www.kcur.org\/post\/brownback-signs-bill-adding-abortion-information-requirements#stream\/0\"> consent<\/a>. States have also banned certain kinds of abortions, such as <a href=\"https:\/\/www.washingtontimes.com\/news\/2015\/dec\/15\/arizona-abortion-sex-selection-lawsuit-dismissed\/\">sex-selective abortion<\/a> and or the abortion of unborn children diagnosed with <a href=\"https:\/\/lozierinstitute.org\/overview-legislation-litigation-involving-protections-against-down-syndrome-discrimination-abortion\/\">Down Syndrome<\/a> or other congenital defects.<\/p>\n<p>While the U.N. Committee rejected in General Comment No. 36 the imposition of criminal sanctions on abortionists, many of the state-level pro-life laws in the U.S. do just this to ensure compliance.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/woman-syndrome-address-un-right-live\/\">Woman with Down syndrome addresses United Nations: \u2018I have a right to live\u2019<\/a><\/em><\/strong><\/p>\n<p>Another area where the U.N. Committee\u2019s positions are at odds with current U.S. practice is in the area of conscience rights. In 2016, the Committee called on <a href=\"https:\/\/tbinternet.ohchr.org\/_layouts\/treatybodyexternal\/Download.aspx?symbolno=CCPR%2fC%2fPOL%2fCO%2f7&amp;Lang=en\">Poland<\/a> and <a href=\"http:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=6QkG1d%2fPPRiCAqhKb7yhsvdnCkCHlZNza%2fmH1Yi62160cRVzfJ0UIlrhYroSGfkkK3tlQjOruxH1HydgYgInHdFT6a%2fJked42AnhUK3IaPzu%2fVrvGWUdjlhIJibfD0bN\">Colombia<\/a> to require that doctors who conscientiously object to performing an abortion provide abortion referrals, even if it violates their conscience to do so. General Comment No. 36 returns to this issue, instructing <a href=\"https:\/\/tbinternet.ohchr.org\/Treaties\/CCPR\/Shared%20Documents\/1_Global\/CCPR_C_GC_36_8785_E.pdf\">countries<\/a> to remove \u201cbarriers\u201d to abortion, \u201cincluding barriers caused as a result of the exercise of conscientious objection.\u201d<\/p>\n<p>The Trump administration has just done the opposite. The U.S. now has in place a <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/final-conscience-rule.pdf\">broad-based policy<\/a> of protecting the conscience rights of healthcare entities and individuals.<\/p>\n<p>The U.N. Committee justified its request to the Trump administration by pointing to Article 40 of the ICCPR, which authorizes it to periodically request reports from countries on their progress in implementing the treaty. The Committee has long used such reviews as occasions to harass countries into loosening restrictions on abortion.<\/p>\n<p>The Committee\u2019s request last month to the Trump administration is unprecedented, however. It represents the first time the Committee has officially criticized U.S. laws protecting the\u00a0unborn \u2014 under the guise of \u201crequesting\u201d the Trump administration to comment how such laws comport with the Committee\u2019s radical interpretation of the ICCPR treaty.<\/p>\n<p>It will be interesting to see how the Trump administration will respond.<\/p>\n<p>We recommend that it simply reject General Comment No. 36 altogether, along with any other interpretation of the ICCPR treaty that undermines American sovereignty and democracy.<\/p>\n<p><a href=\"https:\/\/www.pop.org\/u-n-committee-launches-attack-on-u-s-pro-life-laws\/?eType=EmailBlastContent&amp;eId=83ba042a-3d38-4d9b-9f50-254bd36e8b7a#_ftnref1\" name=\"_ftn1\"><sup>[1]<\/sup><\/a> The Mexico City Policy is a policy that prohibits U.S. foreign aid in global health programs from being used to financially support foreign non-governmental organizations (NGOs) that perform or promote abortion.
