A Louisiana abortion facility is under scrutiny<\/a> for failing to report the rape of a 14-year-old girl as legally mandated. The facility then destroyed the medical records to allegedly hide the evidence.<\/p>\n

In February of 2017, the Department of Health (LDH)\u00a0cited Bossier City Medical Suite<\/a> (BCMS) for failure to report the rape of a minor as well as failing to properly document abortion at the facility. The following month, on March 30, BCMS told LDH that it would suddenly and voluntarily close and surrender its outpatient abortion facility license as of April 1, 2017.<\/p>\n

Robert Gross, the Vice President of BCMS told the LDH that the medical records would be stored at a to be determined location. Louisiana law<\/a> states that abortionists must keep medical records for no less than seven years. Yet, about a month after BCMS closed, all of the facility’s business records and patient files were shredded. The owner of BCMS, Roneal Martin, claims<\/a> they were destroyed because the cost to store them was too high and he wanted to protect patients’ privacy.<\/p>\n

Louisiana Right to Life has now requested an investigation of BCMS, sending a letter to the Bossier Parish District Attorney, the Department of Health, and the Louisiana State Board of Medical Examiners expressing concern that other laws may have been violated by BCMS.<\/p>\n

“I am concerned that other state laws could have been violated as well surrounding failure to report rape of a minor and failure to submit ITOP [Induced Termination of Pregnancy] forms following abortion,” states the letter<\/a> signed by Benjamin Clapper, Executive Director of Louisiana Right to Life. “I am requesting investigation by your agencies or offices to ascertain whether legal action must be pursued on these matters.”<\/p>\n

The letter goes on to say that the Health Standards Section of the Louisiana Department of Health had cited BCMS for failure to report the rape of a minor who was just 14 years old and had an abortion at BCMS on September 6, 2016. The Health Standards report states, “Further review of the Minor Patient Questionnaire revealed an answer to the following question: ‘Did he force you to have sex?’ ‘Yes.’ She indicated on the questionnaire that the age of the father was 16. Continued review of the record revealed no documented evidence that the facility had reported the patient response of ‘forced sex.'”<\/p>\n
