As we ring in 2019, here are five initiatives to watch in state legislatures seeking to ban or restrict abortion:<\/p>\n<p>1. <strong>Texas<\/strong>: Pro-Life Constitutional Amendment<\/p>\n<p><span style=\"font-weight: 400;\">State Senator Bob\u00a0<\/span>Hall has introduced\u00a0<a href=\"https:\/\/capitol.texas.gov\/tlodocs\/86R\/billtext\/html\/SJ00003I.htm\" target=\"_blank\" rel=\"noopener\">SJR 3<\/a>, which would immediately outlaw abortion in Texas if and when <em>Roe v. Wade<\/em> is overturned, acknowledging the right to life of preborn children. The proposal will be on the Texas ballot in November 2019 if it passes the legislature. The Alabama legislature recently passed a similar amendment to its state constitution.<\/p>\n<p>2. <strong>Kentucky<\/strong>: Heartbeat bill, informed consent, abortion facility inspections<\/p>\n<p>Kentucky Representative <a href=\"https:\/\/www.wymt.com\/content\/news\/Kentucky-lawmaker-pre-files-bill-to-prohibit-abortion-after-heartbeat-is-detectable-502730071.html\" target=\"_blank\" rel=\"noopener\">Robert Goforth<\/a> filed the Fetal Heartbeat legislation <a href=\"https:\/\/archive.liveaction.org\/news\/kentucky-lawmaker-heartbeat-bill-life\/\" target=\"_blank\" rel=\"noopener\">BR 823<\/a>, which would make it a felony for a physician to commit an abortion after a heartbeat is detectable, as early as 6-10 weeks of gestation &#8212; although research indicates the heartbeat may start as early as 16-21 days after conception. The bill would also require <a href=\"http:\/\/www.lrc.ky.gov\/recorddocuments\/bill\/19RS\/BR823\/bill.pdf\" target=\"_blank\" rel=\"noopener\">informed consent and strict abortion facility oversight inspections<\/a>.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/bHe8YGPGzj4\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/woman-leaves-abortion-baby-heartbeat\/\">Woman leaves abortion facility after learning her baby has a heartbeat<\/a><\/em><\/strong><\/p>\n<p>3.\u00a0<strong>Ohio<\/strong>: Heartbeat bill<\/p>\n<p>Ohio\u2019s 2018 heartbeat bill &#8212; which would have criminalized abortion performed after a heartbeat is detectable &#8212; ended in a dramatic defeat in December by Ohio\u2019s outgoing governor, John Kasich, whose veto <a href=\"https:\/\/archive.liveaction.org\/news\/ohio-fails-override-veto-heartbeat\/\" target=\"_blank\" rel=\"noopener\">the legislature failed to override by only one vote<\/a>. However, the success of a heartbeat law in 2019 is <a href=\"https:\/\/www.cincinnati.com\/story\/news\/politics\/2018\/12\/26\/veto-overrides-possible-ohio-kasich-abortion-guns-medicaid\/2418337002\/\" target=\"_blank\" rel=\"noopener\">much more likely<\/a>. Governor-elect Mike Dewine, who will be inaugurated on January 14th, has promised to sign similar legislation, but even if he somehow reneges on his promise, the legislature could now have a veto-proof majority.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The House overrode, but the Senate was one vote shy. That also means there is *more* than enough people supporting it to pass it easily next year. And next year they don&#8217;t need an override because gov elect Dewine already promised to sign it.<\/p>\n<p>\u2014 Robin Marty (@robinmarty) <a href=\"https:\/\/twitter.com\/robinmarty\/status\/1078350652172992517?ref_src=twsrc%5Etfw\">December 27, 2018<\/a><\/p><\/blockquote>\n<p>4. <strong>South Carolina<\/strong>: Heartbeat bill, ultrasound mandate<\/p>\n<p>State Senator Grooms <a href=\"https:\/\/www.wltx.com\/article\/news\/local\/abortion-voting-machines-gambling-and-education-changes-in-senate-pre-filed-bill-proposals\/101-623230973\" target=\"_blank\" rel=\"noopener\">filed S 32<\/a>, the \u201cSouth Carolina Fetal Heartbeat Protection from Abortion Act,\u201d which similarly would make abortion a felony for the physician if a heartbeat is detectable. The bill would also <a href=\"https:\/\/www.scstatehouse.gov\/sess123_2019-2020\/prever\/32_20181212.htm\" target=\"_blank\" rel=\"noopener\">require ultrasound images<\/a> of the preborn child to be shown to the woman seeking an abortion.<\/p>\n<p>5. <strong>Missouri<\/strong>: Heartbeat law, reporting requirements<\/p>\n<p>Similar to Kentucky and South Carolina initiatives, <a href=\"https:\/\/www.senate.mo.gov\/19info\/pdf-bill\/intro\/SB139.pdf\" target=\"_blank\" rel=\"noopener\">SB 139<\/a> would require physicians to test for a heartbeat prior to committing an abortion. If a heartbeat is present, the physician may not commit an abortion except in the case of a medical emergency, or risks penalties including losing his\/her license to practice medicine. Additionally, abortion providers would need to report on the\u00a0date, time, method, and results of the heartbeat test.<\/p>\n<p>Several of these initiatives challenge the framework of legalized abortion in America, making 2019 a potentially significant year in the fight for the unborn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The year 2018 saw some significant pro-life victories on the state level.
