{"id":192444,"date":"2018-12-10T16:12:44","date_gmt":"2018-12-10T22:12:44","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=192444"},"modified":"2018-12-11T19:44:33","modified_gmt":"2018-12-12T01:44:33","slug":"supreme-court-appeals-abortion-medicaid","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/supreme-court-appeals-abortion-medicaid\/","title":{"rendered":"Supreme Court declines appeal, forcing state taxpayers to fund Planned Parenthood"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Two states, Kansas and Louisiana, asked the Supreme Court of the United States to determine whether &#8220;Medicaid Act grants individual Medicaid patients a private right of action to sue in federal court in order to challenge a state\u2019s disqualification of their preferred Medicaid provider,&#8221; according to <a href=\"https:\/\/aul.org\/2018\/12\/10\/supreme-court-declines-opportunity-to-determine-whether-states-can-defund-abortion-businesses-from-medicaid\/\">Americans United for Life<\/a> (AUL). Today, the Court declined to hear the appeals cases of <i>Andersen v. Planned Parenthood of Kansas and Mid-Missouri<\/i>\u00a0(Kansas) and <em>Gee v. Planned Parenthood of the Gulf Coast<\/em> (Louisiana). The mainstream media, predictably, is hailing the decision not to hear the appeals as a victory for Planned Parenthood and &#8216;abortion rights.&#8217;<\/p>\n<p>AUL had &#8220;filed a &#8216;friend of the court&#8217;\u00a0<a href=\"https:\/\/aul.org\/wp-content\/uploads\/2018\/10\/20180423103023537_17-1340-Amicus-Brief-of-American-United-for-Life.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\">brief<\/a>\u00a0in support of Kansas, as well as a\u00a0<a href=\"https:\/\/aul.org\/wp-content\/uploads\/2018\/08\/17-1492-amicus-brief-of-90-members-of-congress.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\">brief\u00a0<\/a>in\u00a0support of Louisiana on behalf of 24 Senators and 66 Representatives in Congress, urging the High Court to review these cases and recognize the sovereign authority of states.&#8221;<\/p>\n<p>Justices John Roberts and Brett Kavanaugh sided with the majority on the Supreme Court, while Justices Samuel Alito, Clarence Thomas, and Neil Gorsuch dissented. Four justices were needed in order for the appeals to be heard. According to <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-12-10\/kavanaugh-court-let-stand-rulings-favoring-planned-parenthood\">Bloomberg<\/a>, &#8220;Justices Clarence Thomas, Samuel Alito and Neil Gorsuch said Monday they would have heard the appeals, which contended the federal Medicaid law doesn\u2019t allow lawsuits by providers who are kicked out of the program.&#8221;<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-overturn-roe-v-wade\/\">Judge calls on Supreme Court to overturn Roe v. Wade and protect the preborn<\/a><\/em><\/strong><\/p>\n<p>Justice Thomas (joined by Samuels and Alito) penned a <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/121018zor_f2ah.pdf\">scathing dissent<\/a> to the Court&#8217;s decision not to intervene at this time, writing (emphasis added):<\/p>\n<p style=\"padding-left: 30px;\"><em>Because of this Court\u2019s inaction, patients in different States\u2014even patients with the same providers\u2014have different rights to challenge their State\u2019s provider decisions.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>The question presented also affects the rights of the States, many of which are amici requesting our guidance. Under the current majority rule, a State faces the threat of a federal lawsuit\u2014and its attendant costs and fees\u2014 whenever it changes providers of medical products or services for its Medicaid recipients&#8230;.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>So what explains the Court\u2019s refusal to do its job here? <strong>I suspect it has something to do with the fact that some respondents in these cases are named \u201cPlanned Parenthood.\u201d That makes the Court\u2019s decision particularly troubling, as the question presented has nothing to do with abortion.<\/strong> It is true that these particular cases arose after several States alleged that Planned Parenthood affiliates had, among other things, engaged in \u201cthe illegal sale of fetal organs\u201d and \u201cfraudulent billing practices,\u201d and thus removed Planned Parenthood as a state Medicaid provider&#8230;. But these cases are not about abortion rights. They are about private rights of action under the Medicaid Act&#8230;.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>Some tenuous connection to a politically fraught issue does not justify abdicating our judicial duty.<\/em><\/p>\n<p>Catherine Glenn Foster, AUL&#8217;s president and CEO, <a href=\"https:\/\/aul.org\/2018\/12\/10\/supreme-court-declines-opportunity-to-determine-whether-states-can-defund-abortion-businesses-from-medicaid\/\">noted<\/a> that \u201cthere are other similar cases pending in lower courts, which may give the Supreme Court another opportunity to decide this important issue.
