Wade<\/em>,\u00a0<em>Doe v. Bolton<\/em>, and\u00a0<em>Planned Parenthood v. Casey<\/em> have shaped the abortion laws in the United States for decades. While polls claim that a majority of Americans do not want to see\u00a0<em>Roe <\/em>overturned, the <a href=\"https:\/\/www.nationalreview.com\/corner\/roe-wade-abortion-recent-polls-overstate-public-support\/\">numbers also show<\/a> that\u00a0a minority of Americans understand what this trio of Supreme Court decisions actually required.<\/p>\n<p><em>The Hill<\/em> recently reported: &#8220;A 2013 Pew Research Center <a href=\"http:\/\/www.pewforum.org\/2013\/01\/16\/roe-v-wade-at-40\/\">study found\u00a0that<\/a>\u00a057 percent of polled adults aged 18 to 29 did not know that the 1973 case dealt with abortion.&#8221; And, <a href=\"http:\/\/www.lifenews.com\/2018\/07\/09\/poll-finds-57-of-millennials-dont-even-know-roe-v-wade-is-about-abortion\/\">Celinda Lake<\/a>, a Democratic pollster, believes it is accurate that Millennials have no idea where in history to place the abortion decisions, with some supposing\u00a0<em>Roe<\/em> came after the War of 1776.<\/p>\n<p>So, in layman&#8217;s terms, what did\u00a0<em>Roe<\/em>,\u00a0<em>Doe<\/em>, and\u00a0<em>Casey<\/em> do to American abortion law?<\/p>\n<p><strong>Roe v. Wade &#8211; 1973<\/strong><\/p>\n<p style=\"text-align: left;\"><em>Roe\u00a0<\/em>is the most well-known of the decisions, even though it came down from the Supreme Court on the same day as\u00a0<em>Doe<\/em>: January 22, 1973.\u00a0<em>Roe<\/em> came out of Texas, where attorney Sarah Weddington argued that the state&#8217;s abortion laws were unconstitutional, though she never explained exactly\u00a0<em>how<\/em> they were unconstitutional. She asserted (and the Court agreed) that a woman should have the right to control her own life through ending the life of her preborn child. The Court decided that a child who is unborn is not a constitutional person, even though corporations had been considered constitutional persons for over 100 years.<\/p>\n<p><u>What did <em>Roe<\/em> do?<\/u><\/p>\n<ul>\n<li><em>Roe v. Wade<\/em>\u00a0created a &#8220;trimester&#8221; framework for state abortion laws, where states could place some regulations on it in the third trimester and very few in the second. <strong><em>Roe\u00a0<\/em>required that states leave the first trimester entirely alone<\/strong>, forbidding them from doing anything to protect children at this stage of life.<\/li>\n<li><em>Roe<\/em> so far erased the abortion restrictions of states around the nation that it suddenly became legal at all ages of the child. <strong><em>Roe\u00a0<\/em>immediately\u00a0legalized abortion until the day of birth.<\/strong><\/li>\n<li>The Supreme Court wrote its decision in such a way that its ruling did not only apply to Texas, but also to the entire nation. At that point, only a very small handful of states permitted abortion &#8212; even in limited circumstances. <strong>But after\u00a0<em>Roe<\/em>, abortion was forced on all 50 states.<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/lRDnVSMr5j0\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><strong><a href=\"https:\/\/archive.liveaction.org\/news\/roe-v-wade-exploitation-mccorvey\/\">REA<\/a><a href=\"https:\/\/archive.liveaction.org\/news\/roe-v-wade-exploitation-mccorvey\/\">D:<\/a><em><a href=\"https:\/\/archive.liveaction.org\/news\/roe-v-wade-exploitation-mccorvey\/\"> What you might not know about Jane Roe of Roe v. Wade<\/a><\/em><\/strong><\/p>\n<p><strong>Doe v. Bolton &#8211; 1973<\/strong><\/p>\n<p><em>Doe<\/em> is rarely spoken of, but it is the case that required abortion to be &#8220;on demand&#8221; throughout the United States. Instead of abortion being legal only for rare circumstances,\u00a0<em>Doe<\/em> &#8212; which came out of Georgia &#8212; opened the door wide to it for literally any reason.<\/p>\n<p><u>What did <em>Doe<\/em> do?<\/u><\/p>\n<ul>\n<li>While the Court began by saying that abortion would now be legal for reasons of the mother&#8217;s &#8220;health,&#8221; it <strong>then <a href=\"https:\/\/en.wikipedia.org\/wiki\/Doe_v._Bolton\">defined health<\/a> in an extremely broad and unpredictable way<\/strong>:\n<p style=\"padding-left: 30px;\"><em>We agree with the District Court&#8230; that the medical judgment may be exercised in the light of all factors &#8211; physical, emotional, psychological, familial, and the woman&#8217;s age &#8211; relevant to the well-being of the patient. All these factors may relate to health.<\/em><\/p>\n<\/li>\n<li>When\u00a0<em>Roe\u00a0<\/em>and\u00a0<em>Doe<\/em> are combined, abortion is legal in all 50 states, at all ages of the child, for any reason whatsoever. Casey &#8211; 1992<\/strong><\/p>\n<p><em>Casey<\/em> changed the trimester framework of\u00a0<em>Roe<\/em>. The Court discussed &#8220;viability&#8221; instead. &#8220;Viability&#8221; is the point in time at which a child could survive outside the womb.\u00a0Still, the abortion industry continues to argue that it should be allowed to abort without state interest even after viability &#8212; and a number of facilities do exactly that. Abortion remains legal in many states throughout all 40 weeks, for any reason.<\/p>\n<p><u>What did <em>Casey<\/em> do?<\/u><\/p>\n<ul>\n<li><em>Casey<\/em> acknowledged that viability might move as modern science advanced &#8212; and this has indeed happened, with <a href=\"https:\/\/archive.liveaction.org\/news\/baby-born-just-21-weeks-thriving-three-years-later\/\">babies surviving as young as 21 weeks<\/a>.<\/li>\n<li>The Court in<em> Casey<\/em> also ruled that a state regulation on abortion in any trimester <strong>could not impose &#8220;an undue burden&#8221; on a woman.<\/strong> So, while\u00a0<em>Casey<\/em> allowed states to regulate some aspects of abortion even in the first trimester (contrary to\u00a0<em>Roe<\/em>), it created a difficult standard states were required to abide by. The &#8220;undue burden&#8221; standard is both widely and differently interpreted, and it has created mass confusion regarding what limits states will be allowed to enact.<\/li>\n<\/ul>\n<p><strong><a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-planned-parenthood-actually-does-perform-abortions-after-viability\/\">READ: <em>FACT CHECK: Yes, Planned Parenthood does commit abortions after viability across the U.S.<\/em><\/a><\/strong><\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>In conclusion, thanks to\u00a0<em>Roe<\/em>,\u00a0<em>Doe<\/em>, and\u00a0<em>Casey<\/em>, abortion remains legal and on demand all the way up to birth in many states around the nation. This is contrary to <a href=\"https:\/\/archive.liveaction.org\/news\/gallup-poll-abortion-restrictions\/\">the views of the majority of Americans<\/a> who believe that it should either be illegal or highly restricted.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Roe v.
