As Live Action News has previously <a href=\"https:\/\/archive.liveaction.org\/news\/trump-officially-defunds-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">documented<\/a>, under the new rules, Title X projects will not be allowed to refer women for\u00a0<a href=\"http:\/\/www.abortionprocedures.com\/\" target=\"_blank\" rel=\"noopener\">abortions<\/a>. Any organization that receives family planning funds will also be required to keep facilities where abortions are committed separate from facilities where family planning care is provided. Planned Parenthood is the largest provider of abortions, and although its supporters will claim tax dollars cannot pay for abortions, Live Action and <a href=\"https:\/\/archive.liveaction.org\/news\/yes-your-tax-dollars-fund-abortions-at-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">Live Action News<\/a> have previously <a href=\"https:\/\/archive.liveaction.org\/news\/yes-your-tax-dollars-fund-abortions-at-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">demonstrated<\/a> how deceptive that claim is:<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/BgB5E91lD6s\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Title X was enacted in 1970, and as Live Action News has previously\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/history-of-george-h-w-bushs-relationship-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">documented<\/a>, one of the\u00a0chief co-sponsors of the\u00a0<a href=\"http:\/\/www.hhs.gov\/opa\/title-x-family-planning\/title-x-policies\/title-x-funding-history\/\" target=\"_blank\" rel=\"noopener\">Title X statute<\/a>\u00a0<a href=\"http:\/\/www.gao.gov\/products\/GAO-15-270R\" target=\"_blank\" rel=\"noopener\">allocating<\/a>\u00a0millions of federal tax dollars to Planned Parenthood was Rep. George H.W. The federal program <a href=\"https:\/\/www.hhs.gov\/opa\/sites\/default\/files\/ogc-cleared-final-april.pdf\" target=\"_blank\" rel=\"noopener\">consists<\/a> of &#8220;<a href=\"https:\/\/www.hhs.gov\/opa\/title-x-family-planning\/title-x-grantees\/index.html\" target=\"_blank\" rel=\"noopener\">grantees<\/a>,&#8221; or a &#8220;direct recipient&#8221; of Title X funds, which is an &#8220;entity that receives Federal financial assistance via a grant and assumes legal and financial responsibility and accountability for the awarded funds and for the performance of the activities approved for funding.&#8221;<\/p>\n<p>Funding can also go to &#8220;sub-recipients,&#8221; which, <a href=\"https:\/\/www.hhs.gov\/opa\/guidelines\/program-guidelines\/program-requirements\/index.html\" target=\"_blank\" rel=\"noopener\">according<\/a> to <a href=\"https:\/\/www.hhs.gov\/opa\/sites\/default\/files\/ogc-cleared-final-april.pdf\" target=\"_blank\" rel=\"noopener\">current requirements<\/a>, are &#8220;[t]hose entities that provide family planning services with Title X funds\u00a0under a written agreement with a grantee. May also be referred to as delegates or contract agencies.&#8221;<\/p>\n<p>The facilities where grantee or sub-recipient locate are called &#8220;service sites.&#8221;<\/p>\n<div id=\"attachment_183632\" style=\"width: 429px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-183632\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-183632\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2018\/06\/HHS-TitleX-definitions-from-2014-requirements.jpg\" alt=\"Image: HHS TitleX definitions from 2014 requirements\" width=\"419\" height=\"542\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2018\/06\/HHS-TitleX-definitions-from-2014-requirements.jpg 419w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2018\/06\/HHS-TitleX-definitions-from-2014-requirements-232x300.jpg 232w\" sizes=\"(max-width: 419px) 100vw, 419px\" \/><p id=\"caption-attachment-183632\" class=\"wp-caption-text\">HHS TitleX definitions from 2014 requirements<\/p><\/div>\n<p>There are ten <a href=\"https:\/\/www.hhs.gov\/opa\/title-x-family-planning\/title-x-grantees\/index.html\" target=\"_blank\" rel=\"noopener\">administrative regions<\/a> which oversee Title X-funded family planning grantees, subrecipients, and clinics. Currently, &#8220;Any public or private nonprofit entity located in a State (which includes one of the 50 United States, District of Columbia, Commonwealth of Puerto Rico, U.S. Virgin Islands, Commonwealth of the Northern Mariana Islands, American Samoa, Guam, Republic of Palau, Federated States of Micronesia, and the Republic of the Marshall Islands) is eligible to apply for a [<a href=\"https:\/\/www.hhs.gov\/opa\/grants-and-funding\/grant-opportunities\/fy2018-services-questions-answers\/index.html\" target=\"_blank\" rel=\"noopener\">Title X<\/a>] grant&#8230;&#8221;<\/p>\n<p>This includes &#8220;[f]aith-based organizations and American Indian\/Alaska Native\/Native American (AI\/AN\/NA) organizations&#8230;.&#8221;<\/p>\n<p>The April 2018\u00a0<a href=\"https:\/\/www.hhs.gov\/opa\/sites\/default\/files\/OPA_Title_X_Family_Planning_Directory_April2018_508.pdf\" target=\"_blank\" rel=\"noopener\">Title X Family Planning Directory<\/a>\u00a0lists the current agencies receiving funding as either a grantee\/recipient, sub-recipient or service site. According to <a href=\"https:\/\/www.federalregister.gov\/documents\/2018\/06\/01\/2018-11673\/compliance-with-statutory-program-integrity-requirements\" target=\"_blank\" rel=\"noopener\">HHS<\/a>, &#8220;The Department seeks public comment as to whether additional regulatory application review criteria may be necessary or advisable to implement the Department&#8217;s interpretation of the statutory provisions applicable to Title X, in particular section 1008&#8230;.&#8221;<\/p>\n<p>According to <a href=\"http:\/\/thehill.com\/opinion\/healthcare\/388092-trump-taxpayers-want-title-x-funding-protected-from-abortion-clinics\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>:<\/p>\n<blockquote><p>Section 1008 of the Act, passed by a Democrat-controlled Congress, ensures that no taxpayer dollars be \u201cused in programs where abortion is a method of family planning.\u201d It was not until 1988 that the Reagan administration issued\u00a0<a href=\"https:\/\/www.frc.org\/updatearticle\/20180501\/may-day\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cco-location\u201d guidelines<\/a>. These guidelines were intended to further protect taxpayers from being complicit with the destruction of abortion. They were challenged in court and the Supreme Court ruled in 1991 that the regulations are permissible. (Example: The requirement that recipients report abuse.)<\/li>\n<li>Whether a referral agency should be subject to the same reporting requirements as a grantee or subrecipient\u2014by means of requiring grantees and subrecipients to use referral agencies only if they require the referral agencies to submit the required information.<\/li>\n<li>Whether additional regulatory provisions, such as a requirement for a Title X clinic to operate under a distinct name from a facility that provides abortion as a method of family planning, or for organizational separation&#8230;<\/li>\n<li>Whether additional policies or requirements, beyond those proposed, should be imposed to ensure compliance. These include expanding the requirement that referral agencies that do not receive Title X funds but nevertheless provide information, counseling, or services to Title X clients be subject to the same reporting and compliance requirements as do grantees and subrecipients; and requiring organizational separation in addition to physical and financial separation.<\/li>\n<\/ul>\n<p>The proposed rule changes have been published in the <a href=\"https:\/\/www.federalregister.gov\/documents\/2018\/06\/01\/2018-11673\/compliance-with-statutory-program-integrity-requirements\" target=\"_blank\" rel=\"noopener\">Federal Register<\/a> as well as <a href=\"https:\/\/www.regulations.gov\/document?D=HHS-OS-2018-0008-0001\" target=\"_blank\" rel=\"noopener\">Regulations.gov<\/a>.
