{"id":18266,"date":"2012-06-26T01:12:31","date_gmt":"2012-06-26T05:12:31","guid":{"rendered":"\/news\/?p=18266"},"modified":"2013-04-03T21:31:35","modified_gmt":"2013-04-04T01:31:35","slug":"obamacare-tramples-constitution","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/obamacare-tramples-constitution\/","title":{"rendered":"Four ways ObamaCare tramples the Constitution"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-medium wp-image-12868\" style=\"margin: 15px;\" src=\"\/news\/wp-content\/uploads\/2012\/03\/health_care_Obama_graphic_01-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" \/>Yesterday Kristan Hawkins at LifeNews <a href=\"http:\/\/www.lifenews.com\/2012\/06\/25\/pro-lifers-wait-for-one-of-the-biggest-abortion-decisions-obamacare\/\">noted<\/a> that pro-lifers are waiting with bated breath for the Supreme Court to rule on the constitutionality of President Barack Obama\u2019s intensely controversial health care law:<\/p>\n<blockquote><p>At this moment, I am standing in front of the Supreme Court with the rest of our team and missionaries on Capitol Hill. Waiting.\u00a0 Waiting to see if today is the day that we find out whether or not Obamacare is constitutional. And whether or not our rights of conscience and freedom of religion will continue to be defended by those charged to protect them.<\/p>\n<p>This is the biggest moment for the pro-life movement since January 22, 1973.<\/p><\/blockquote>\n<p>The main challenge to ObamaCare has concerned the individual mandate, which requires Americans to purchase health insurance. The Court\u2019s Thursday ruling probably won\u2019t focus on Health and Human Services Department rules <a href=\"http:\/\/standupforreligiousfreedom.com\/mandate\/\">forcing religious employers<\/a> to include birth control in their health plans, but there is a chance the Court might decide to strike down the entire law, and it\u2019s important for pro-lifers to have a broad understanding of why ObamaCare is so thoroughly and blatantly unconstitutional.<\/p>\n<p><strong>1.) The Constitution gives the federal government no general grant of authority over health care.<\/strong><\/p>\n<p>In <em><a href=\"http:\/\/thomas.loc.gov\/home\/histdox\/fed_45.html\">Federalist 45<\/a><\/em>, James Madison explains that the federal government is fundamentally different from state governments in one key way:<\/p>\n<blockquote><p>The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite.<\/p><\/blockquote>\n<p>While states are mostly free to legislate in \u201call the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State,\u201d federal domestic policy is almost exclusively limited to objects expressly identified by <a href=\"http:\/\/www.law.cornell.edu\/constitution\/articlei#section8\">Article I, Section 8<\/a> of the Constitution. It\u2019s a pretty straightforward list, which says nothing about providing <em>any<\/em> health care to Americans &#8211; birth control or otherwise.<\/p>\n<p><strong>2.) The Commerce Clause does not empower government to make Americans buy products.<\/strong><\/p>\n<p>The Commerce Clause is the heart of Democrats\u2019 legal justification for the mandate. The Clause, found in Article I, Section 8, authorizes Congress to \u201cregulate commerce \u2026 among the several states.\u201d They have argued that because one person\u2019s decision to forgo insurance affects everyone else who pays premiums, the decision is an interstate economic activity subject to federal control. But Alexander Hamilton\u2019s explanation of the Commerce Clause in <em><a href=\"http:\/\/thomas.loc.gov\/home\/histdox\/fed_22.html\">Federalist 22<\/a><\/em> reveals a very different purpose:<\/p>\n<blockquote><p>The interfering and unneighborly regulations of some States, contrary to the true spirit of the Union, have, in different instances, given just cause of umbrage and complaint to others, and it is to be feared that examples of this nature, if not restrained by a national control, would be multiplied and extended till they became not less serious sources of animosity and discord than injurious impediments to the intcrcourse between the different parts of the Confederacy.<\/p><\/blockquote>\n<p>The intended purpose of Congress&#8217;s power to regulate interstate commerce was specifically to prevent the states from discriminating against one another through <em>over<\/em>-regulation, to erect a uniform standard that would keep the interstate flow of commerce mostly <em>un<\/em>-regulated. Further, Hamilton is clearly talking about regulating the actions of state governments, not of private citizens &#8211; especially not the <em>inaction<\/em> of those not crossing state lines. The Commerce Clause simply doesn\u2019t make it government\u2019s business what economic choices individuals make.<\/p>\n<p><strong>3.) The First Amendment protects people from being forced to participate in practices that violate their religious beliefs.<\/strong><\/p>\n<p>Not only does the Constitution give government no power to decide what services employers should offer, but it gives employers special protection against such control when religion enters the picture. The <a href=\"http:\/\/www.law.cornell.edu\/constitution\/first_amendment\">First Amendment<\/a> lets Congress make \u201cno law \u2026 prohibiting the free exercise\u201d of religion. Private citizens and organizations are free to follow the dictates of their faiths, as long as doing so doesn\u2019t violate anyone else\u2019s constitutional rights (for instance, burning witches isn\u2019t protected under religious liberty), and there is no constitutional right to be given birth control.<\/p>\n<p>Ultimately, if \u201cfree exercise of religion\u201d doesn\u2019t at the very least mean you cannot be compelled to participate in practices that violate your religious beliefs, then it means nothing.<\/p>\n<p><strong>4.) ObamaCare violates separation of powers by delegating vast policy-making power to the executive branch and to unaccountable administrative agencies.<\/strong><\/p>\n<p>To prevent government from growing too powerful, the Constitution splits legislative power (making laws) and executive power (carrying out laws) into two branches. This also serves another essential function of good government: the people\u2019s ability to clearly see who in government is responsible for which decisions, and to accordingly hold them accountable.<\/p>\n<p>ObamaCare did not define which services employer health plans had to include; it left the details up to the Obama administration to decide. The problem is that any decision changing the liberties and obligations of the people, such as the HHS birth control mandate, is legislative in nature, not executive, and so must be made by the people&#8217;s chosen representatives. Congress cannot outsource its legislative responsibility to other departments.<\/p>\n<p>Even worse, <a href=\"http:\/\/www.hoover.org\/publications\/defining-ideas\/article\/103021\">according to<\/a> the Congressional Research Service, the number of new agencies, boards, and commissions created by ObamaCare is \u201cunknowable.\u201d If not even the CRS can determine how many new administrative and rule-making bodies <em>exist<\/em> under the 2,700-page law (much less their roles, jurisdictions, and oversight, each of which would raise brand-new constitutional questions), then what chance does the average citizen have?<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>A law professor trying to craft a model of bad legislation for his students to dissect would be hard-pressed to come up with something more target-rich than ObamaCare. It runs roughshod over all the principles the Founders deemed most important in our Constitution &#8211; economic and religious liberty, limited government, and accountability to the people. Its overturn would be a powerful affirmation that the rule of law still matters in this country, giving us renewed hope that the Supreme Court will correct other longstanding <a href=\"\/news\/opinion\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">pro-abortion affronts<\/a> to the Constitution.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A law professor trying to craft a model of bad legislation for his students to dissect would be hard-pressed to come up with something more target-rich than ObamaCare.<\/p>\n","protected":false},"author":54,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false},"categories":[15],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.7 -
