Becerra accused them of using &#8220;manufactured identities and a fictitious bioresearch company to meet women\u2019s healthcare providers and covertly record the private discussions they initiated.&#8221;<\/p>\n<p>&#8220;The right to privacy is a cornerstone of California\u2019s Constitution, and a right that is foundational in a free democratic society,&#8221; Becerra said. &#8220;We will not tolerate the criminal recording of confidential conversations.&#8221;<\/p>\n<p>Then, last month, federal judge William Orrick (an <a href=\"https:\/\/archive.liveaction.org\/news\/judge-orricks-cmp-gag-order-makes-mockery-factual-impartial-jurisprudence\/\">Obama donor<\/a> with <a href=\"https:\/\/archive.liveaction.org\/news\/center-medical-progress-files-motion-disqualify-judge\/\">connections<\/a> to <a href=\"http:\/\/liveaction.org\/abortioncorporation\">Planned Parenthood<\/a>)\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/federal-judge-threatens-to-hold-david-daleiden-in-contempt-after-release-of-new-cmp-video\/\" target=\"_blank\" rel=\"noopener\">threatened to hold Daleiden and Merritt in contempt<\/a> after their attorneys released another video, despite an injunction having been filed against videos featuring the National Abortion Federation.<\/p>\n<p><a href=\"http:\/\/liveaction.org\/petition\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-160409\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2017\/01\/DefundAd-400b-1.jpg\" alt=\"\" width=\"400\" height=\"170\" \/><\/a><\/p>\n<p>But this week, news broke that a state judge had <a href=\"https:\/\/archive.liveaction.org\/news\/breaking-state-judge-rules-in-favor-of-center-for-medical-progress-investigators\/\">ruled in favor of Daleiden and Merritt<\/a>, granting &#8220;most of defendant Daleiden\u2019s and Merritt\u2019s demurrer motions, knocking out the 14 recording charges until the CA AG amends their complaint&#8221; and had &#8220;also denied the AG\u2019s request for contempt sanctions against David\u2019s defense counsel, and agreed Judge Orrick\u2019s federal gag order in the civil lawsuit should not prevent defendants from using the videos in our defense.&#8221;<\/p>\n<p>This evidently did not deter Becerra, who has responded to the news by <a href=\"http:\/\/www.sfgate.com\/bayarea\/article\/SF-judge-deals-setback-to-prosecutors-in-abortion-11237776.php\" target=\"_blank\" rel=\"noopener\">vowing to reinstate the felony charges against Daleiden and Merritt<\/a> anyway.
