{"id":166206,"date":"2017-05-24T12:15:47","date_gmt":"2017-05-24T16:15:47","guid":{"rendered":"http:\/\/www.liveaction.org\/news\/?p=166206"},"modified":"2017-05-24T12:15:47","modified_gmt":"2017-05-24T16:15:47","slug":"fresno-state-professor-erases-pro-life-messages-says-campuses-not-free-speech-areas","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/fresno-state-professor-erases-pro-life-messages-says-campuses-not-free-speech-areas\/","title":{"rendered":"Fresno State professor erases pro-life messages, says campuses not &#8216;free speech areas&#8217;"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The\u00a0First Amendment freedom of speech is no longer applicable on a college campus, according to William Gregory Thatcher, an assistant professor of public health at California State University in Fresno.<\/p>\n<p>When Fresno State Students for Life finished writing\u00a0pro-life messages in chalk on the sidewalk leading to the university library on May 2, club president Bernadette Tasy found other students deliberately editing and erasing the messages. When she questioned their actions, the students replied that they were censoring the pro-life messages at the behest of their teacher, Thatcher, who had previously confronted Tasy about the project. Tasy quickly explained to Thatcher that Fresno State Students for Life had received permission to write on the sidewalk from both Plant Operations and Student Involvement.<\/p>\n<p>&#8220;Free speech is free speech in the free speech area,&#8221; Thatcher replied. &#8220;College campuses are not free speech areas.&#8221; The video Tasy captured of the encounter can be viewed below:<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" style=\"border: none; overflow: hidden;\" src=\"https:\/\/www.facebook.com\/plugins\/video.php?href=https%3A%2F%2Fwww.facebook.com%2FAllianceDefendingFreedom%2Fvideos%2F10155337190838417%2F&amp;show_text=0&amp;width=560\" width=\"560\" height=\"315\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Thatcher argued that his stamping out their\u00a0free speech was a form of free speech itself.<\/p>\n<p>On the contrary, Fresno State President Joseph Castro\u00a0<a href=\"http:\/\/www.fresnobee.com\/news\/local\/article150003172.html\">says<\/a>\u00a0&#8220;[t]hose disagreeing with the students\u2019 message have a right to their own speech, but they do not have the right to erase or stifle someone else\u2019s speech under the guise of their own right to free speech.&#8221; Thatcher also apparently alluded to Fresno having specific free speech zones for students, a <a href=\"https:\/\/adflegal.blob.core.windows.net\/web-content-dev\/docs\/default-source\/documents\/case-documents\/fresno-state-students-for-life-v.-thatcher\/fresno-state-students-for-life-v-thatcher---complaint.pdf?sfvrsn=4\">policy that was rescinded in June 2015<\/a>.<\/p>\n<p>Thatcher, whose research centers on youth risk behavior and sexuality, has <a href=\"http:\/\/fresnostate.edu\/chhs\/public-health\/faculty-staff\/faculty\/thatcher.html\">taught at Fresno for ten years<\/a>. While receiving an overall good job rating from college students, even the relatively positive\u00a0<a href=\"https:\/\/www.ratemyprofessors.com\/ShowRatings.jsp?tid=1095310\">RateMyProfessor<\/a> reviews make note that in the classroom Thatcher &#8220;comes off as mean,&#8221; &#8220;plays favorites,&#8221; &#8220;teaches in a very biased manner towards his own opinion,&#8221; and doesn&#8217;t hesitate to make a spectacle out of students.<\/p>\n<p>Among the\u00a0<a href=\"https:\/\/adflegal.blob.core.windows.net\/web-content-dev\/docs\/default-source\/documents\/case-documents\/fresno-state-students-for-life-v.-thatcher\/fresno-state-students-for-life-v-thatcher---complaint.pdf?sfvrsn=4\">life-affirming sidewalk chalk messages<\/a> Thatcher found to be offensive were the following:<\/p>\n<blockquote><p>\u201cPregnant? Thatcher<\/em><\/a>, arguing that\u00a0&#8220;erasing, obscuring, and defacing Plaintiffs\u2019 expression and in directing students to do the same violate Plaintiffs\u2019 rights under the First and Fourteenth Amendments,&#8221; and that Thatcher is violating their First Amendment rights by relegating their liberty to &#8220;unspecified speech zones.&#8221;<\/p>\n<p>The U.S. government should not\u00a0support a university that violates U.S. Constitutional rights. In a <a href=\"http:\/\/calstate.edu\/financialservices\/resources\/auditedstatements\/systemwide\/2015-2016_SystemwideFS.pdf\">2016 revenue statement<\/a>, California State University in Fresno received $23,063,000 in &#8220;noncapital&#8221; federal funds.<\/p>\n<p><a href=\"http:\/\/liveaction.org\/petition\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-160409\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2017\/01\/DefundAd-400b-1.jpg\" alt=\"\" width=\"400\" height=\"170\" \/><\/a><\/p>\n<p>&#8220;Like all government officials, professors have an obligation to respect students\u2019 free speech rights,&#8221; <a href=\"https:\/\/www.adflegal.org\/detailspages\/press-release-details\/fresno-state-u.-professor-sued-for-erasing-censoring-students-pro-life-sidewalk-chalk-expression\">says<\/a> ADF Legal Counsel Travis Barham. &#8220;And they should encourage all students to participate in the marketplace of ideas, rather than silencing those with whom they happen to differ. The professor\u2019s actions here represent a flagrant violation of the First Amendment.&#8221;<\/p>\n<p>Students for Life of America President Kristan Hawkins expressed a similar view, <a href=\"https:\/\/www.adflegal.org\/detailspages\/press-release-details\/fresno-state-u.-professor-sued-for-erasing-censoring-students-pro-life-sidewalk-chalk-expression\">saying<\/a>, &#8220;Fresno State Students for Life received full permission to chalk pro-life messages near the library.&#8221;<\/p>\n<p>&#8220;Rather than countering with his own message, Dr. Thatcher took the illegal approach of censoring speech and inciting students to help in this,&#8221; continued Hawkins, whose organization is currently the largest pro-life youth organization in the United States. &#8220;No students should have to endure this kind of intimidation and harassment for simply expressing their views, but especially not those who want to help the women betrayed, and the preborn children killed, by the abortion industry.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The\u00a0First Amendment freedom of speech is no longer applicable on a college campus, according to William Gregory Thatcher, an assistant professor of public health at California State University in Fresno.
