{"id":164814,"date":"2017-04-12T14:18:32","date_gmt":"2017-04-12T18:18:32","guid":{"rendered":"http:\/\/www.liveaction.org\/news\/?p=164814"},"modified":"2017-04-12T14:18:32","modified_gmt":"2017-04-12T18:18:32","slug":"164814-2","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/164814-2\/","title":{"rendered":"Hawaii&#8217;s house of representatives votes to force pregnancy centers to advertise abortions"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p style=\"font-weight: 300;\">(<a href=\"https:\/\/pregnancyhelpnews.com\/free-speech-crackdown-on-hawaii-pregnancy-centers-passes-house-vote\">Pregnancy Help News<\/a>) All five pro-life pregnancy help organizations on the Hawaiian islands are the stroke of a pen away from being forced by law to advertise abortions, following a vote by Hawaii\u2019s house of representatives Tuesday, April 11 in Honolulu.<\/p>\n<p style=\"font-weight: 300;\">With only 10 of Hawaii\u2019s 51 state representatives voting against SB 510, the measure will now go back to the state senate for a review of amendments before landing on the desk of Democratic Gov. David Ige.<\/p>\n<p style=\"font-weight: 300;\">Backed by Planned Parenthood Northwest and Hawaii, the edict mirrors a 2015 California law that is <b><strong><a href=\"https:\/\/pregnancyhelpnews.com\/california-bully-bill-may-be-headed-to-supreme-court-challenging-state-s-hit-on-pregnancy-centers\">likely on its way to the U.S. Supreme Court<\/a><\/strong><\/b> because, as pro-lifers argue, it forces them to choose between denying conscience by posting pro-abortion signage and defying the government by refusing to comply with the law.<\/p>\n<p style=\"font-weight: 300;\">If the law were to take effect, all community-funded pregnancy centers offering free services such as ultrasounds would be forced\u2014at the threat of a $500 first-time fine and a $1,000 subsequent fine\u2014to post and distribute to clients the following statement:<\/p>\n<p style=\"font-weight: 300;\"><em>Hawaii has public programs that provide immediate free or low-cost access to comprehensive family planning services, including, but not limited to, all FDA-approved methods of contraception and pregnancy-related services for eligible women.<\/em><\/p>\n<p style=\"font-weight: 300;\"><em>To apply online for medical insurance coverage, that will cover the full range of family planning and prenatal care services, go to mybenefits.hawaii.gov.<\/em><\/p>\n<p style=\"font-weight: 300;\"><em>Only ultrasounds performed by qualified healthcare professionals and read by licensed clinicians should be considered medically accurate.<\/em><\/p>\n<p style=\"font-weight: 300;\"><a href=\"http:\/\/liveaction.org\/petition\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-medium wp-image-160409\" src=\"http:\/\/www.liveaction.org\/news\/wp-content\/uploads\/2017\/01\/DefundAd-400b-1-300x128.jpg\" alt=\"\" width=\"300\" height=\"128\" \/><\/a><\/p>\n<p style=\"font-weight: 300;\">While supporters of the bill, including state Rep. Chris Lee, argued that its intent is to provide \u201cbasic transparency,\u201d opponents to the law argued that it was not likely to pass constitutional muster on First Amendment grounds, and pointed out that the state should use its own resources to advertise its own taxpayer-funded programs.<\/p>\n<p style=\"font-weight: 300;\">One lawmaker, Reb. Bob McDermott, was far more direct in his criticism.<\/p>\n<p style=\"font-weight: 300;\">\u201cUltimately, what was the whole point of this whole thing? Where did it come from? Why is it even before us? It\u2019s before us because there\u2019s Christian centers that offer alternatives to abortion,\u201d McDermott said. \u201cThey don\u2019t believe in abortion. So, a woman comes in there and they\u2019re encouraging, they offer alternatives but they don\u2019t do abortions. And that\u2019s what this is about.<\/p>\n<p style=\"font-weight: 300;\">\u201cThese pregnancy centers offer the ultrasound\u2026 the young lady will not have the abortion\u2014she won\u2019t\u2014and Planned Parenthood loses money.\u201d<\/p>\n<p style=\"font-weight: 300;\"><b><strong>Trampling on Free Speech<\/strong><\/b><\/p>\n<p style=\"font-weight: 300;\">Arguing that the law is a threat to free speech, Hawaiian pro-lifers have seen their rights evaporate even while the bill has made its march through the state legislature.<\/p>\n<p style=\"font-weight: 300;\">Their testimony opposing the bill has been held back from relevant committees, an issue the state\u2019s attorney general <b><strong><a href=\"https:\/\/pregnancyhelpnews.com\/hawaii-s-lower-house-to-vote-on-anti-free-speech-bill-over-state-s-ag-concerns\">has said<\/a><\/strong><\/b> is a violation of First Amendment rights.<\/p>\n<p style=\"font-weight: 300;\">At issue in the censorship was testimony from a former client at one center, A Place for Women in Waipio\u2014an outreach of Calvary Chapel Pearl Harbor\u2014who now works with Planned Parenthood. The woman had testified to the senate\u2019s Ways and Means Committee that her experience at the center had left her feeling like \u201cthe only thing they cared about was the baby.\u201d<\/p>\n<p style=\"font-weight: 300;\">While that testimony\u2014even if true\u2014has nothing to do with the law, A Place For Women submitted rebuttal testimony citing a voluntary exit survey the same woman had filled out saying her visit was, &#8220;very comfortable.&#8221; The senate president squelched the rebuttal testimony before it was passed onto committee members, however, denying A Place for Women a chance to plead its case.<\/p>\n<p style=\"font-weight: 300;\">That action, the attorney general asserted in a March 29 letter, infringed on the pregnancy help center\u2019s First Amendment right to petition the government.<\/p>\n<p style=\"font-weight: 300;\">\u201cThe fact that we did not have a voice\u00a0in that\u00a0decision is very concerning,\u201d Joy Wright, executive director at Malama Pregnancy Center, said. \u201cEven if they\u2019re for the bill, it\u2019s very important that we have a voice. We are abiding by the process put together by the state legislature, and so if it\u2019s not followed through on the other side, then we have a problem that needs to be addressed.&#8221;<\/p>\n<p style=\"font-weight: 300;\"><b><strong>Legislation by Anecdote<\/strong><\/b><\/p>\n<p style=\"font-weight: 300;\">Testifying in favor of the bill prior to Tuesday\u2019s vote, Lee relayed an anecdotal example of a woman he claimed to know who went to a pregnancy center\u2014though he didn\u2019t specify which center, or if it was even in Hawaii\u2014and wasn\u2019t able to access the morning-after pill at the center.<\/p>\n<p style=\"font-weight: 300;\">Plan B One-Step, commonly called the morning-after pill, has been available for sale over the counter since 2013, and pregnancy centers do not refer for abortions or abortifacient drugs such as the morning-after pill.<\/p>\n<p style=\"font-weight: 300;\">At a hearing before the state\u2019s House Committee on Health on March 16, one supporter of the bill, Michael Golojuch, Jr., chair of the state\u2019s LGBT Caucus, testified that pregnancy centers are dangerous for women based on his own third-hand account of the sister of one of his friends.<\/p>\n<p style=\"font-weight: 300;\">Without providing any substantiating details or even establishing that the pregnancy center had made a mistake of any kind, Golojuch\u2019s testimony was markedly similar to the sweeping claims often made by abortion lobby groups and one \u201cundercover reporter\u201d whose vague allegations <a href=\"https:\/\/pregnancyhelpnews.com\/the-one-question-no-one-is-asking-in-the-pregnancy-center-witch-hunt\"><b><strong>formed the backbone of California\u2019s 2015 law<\/strong><\/b><\/a>.<\/p>\n<p style=\"font-weight: 300;\">\u201cWe don\u2019t make policy based on anecdotal stories,\u201d McDermott said. \u201cThe biggest thing that these centers do is\u2014the ones that have it\u2014provide an ultrasound opportunity for the young lady to see the child. Once the young lady sees the child, the abortion option is almost always off the table, because they see this living, breathing human being.\u201d<\/p>\n<p style=\"font-weight: 300;\">Past attempts by local authorities to compel pro-life pregnancy centers to post signage either declaring\u00a0the services they do not offer or referring patients\u2014even indirectly\u2014to abortion providers have been struck down in New York City, Austin (TX), <b><strong><a href=\"https:\/\/pregnancyhelpnews.com\/positive-ruling-in-baltimore-could-set-persuasive-precedent-for-free-speech-attacks-elsewhere\">Baltimore<\/a> <\/strong><\/b>(MD) and Montgomery County (MD), the latter of which <b><strong><a href=\"https:\/\/www.lifesitenews.com\/news\/exclusive-e-mails-reveal-maryland-officials-collaborating-with-naral-to-shu\">cost taxpayers<\/a><\/strong><\/b> $330,000 in attorneys fees.<\/p>\n<p style=\"font-weight: 300;\">Meanwhile, another law in Illinois forcing pro-life medical professionals to refer for abortions is <a href=\"https:\/\/pregnancyhelpnews.com\/illinois-judge-halts-state-s-free-speech-assault-on-pro-life-docs-clinics\"><b><strong>facing similar challenges<\/strong><\/b><\/a> in court.<\/p>\n<p style=\"font-weight: 300;\">As one pro-abortion lawmaker, Joy San Buenaventura, said Tuesday, the potential redirecting of federal taxpayer dollars away from Planned Parenthood to federally qualified health centers makes cracking down on pregnancy help centers a must for the abortion industry.<\/p>\n<p style=\"font-weight: 300;\">\u201cIn this federal climate that we have here, where the defunding of Planned Parenthood seems to me highly likely, there\u2019s going to be a number of consumers who\u2019ll be flocking to these limited pregnancy centers,\u201d Buenaventura said. \u201cWhat we have produced here is\u2026 the best of all possible options.\u201d<\/p>\n<p style=\"font-weight: 300;\"><em>Editor\u2019s Note:\u00a0This story, which originally appeared at <a href=\"https:\/\/pregnancyhelpnews.com\/free-speech-crackdown-on-hawaii-pregnancy-centers-passes-house-vote\">Pregnancy Help News<\/a> on April 11, 2017, was reprinted with permission.\u00a0<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Pregnancy Help News) All five pro-life pregnancy help organizations on the Hawaiian islands are the stroke of a pen away from being forced by law to advertise abortions, following a vote by Hawaii\u2019s house of representatives Tuesday, April 11 in Honolulu.
