A final vote will be taken on Friday.<\/p>\n<p>Leading up to this event, there has been much discussion about the nuclear option and the role of the Senate. David French, <a href=\"http:\/\/www.nationalreview.com\/article\/446425\/roe-v-wade-supreme-court-shadow-abortion-decision-politicized-court?utm_source=Sailthru&amp;utm_medium=email&amp;utm_campaign=Daily%20Trending%20Email%20Reoccurring-%20Monday%20to%20Thursday%202017-04-04&amp;utm_term=NR5PM%20Actives\">writing for National Review<\/a> on April 4, says it comes down to <em>Roe v. Wade, <\/em>which in 1973 legalized abortion on demand in all 50 states.<\/p>\n<div class=\"ArticleAd1\">\n<p><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>In discussing &#8220;what went wrong,&#8221; French writes that &#8220;[t]he Supreme Court went wrong, and it did so most decisively and consequentially when it created the right to kill a child.&#8221; French regards the pro-abortion position as one about &#8220;presumed social justice,&#8221; and, just as pro-abortion Senator Dianne Feinstein <a href=\"\/news\/senator-dianne-feinstein-calls-roe-v-wade-super-precedent-during-gorsuch-hearing\/\">mentioned<\/a> when expressing concern about\u00a0Gorsuch, a &#8220;&#8216;living constitution'&#8221; which turned the founding document into &#8220;a child-devouring monster.&#8221; Similarly, as has long been <a href=\"\/news\/top-10-reasons-against-roe-v-wade\/\">a criticism<\/a>\u00a0of <em>Roe,\u00a0<\/em>French evokes &#8220;penumbras and emanations,&#8221; calling them &#8220;sheer nonsense&#8221; and &#8220;embarrassing rhetoric.&#8221; Unfortunately, &#8220;embarrassing rhetoric from the Supreme Court has the force of law,&#8221; French reminds.<\/p>\n<p>With regard to Democrats and Republicans, French writes it is\u00a0important to understand\u00a0the stakes, particularly when it comes to &#8220;taking steps to correct the judiciary&#8217;s overreach and abuse&#8221; and when it comes to &#8220;checks and balances&#8230; checking the justices of the Supreme Court.&#8221;<\/p>\n<p><a href=\"http:\/\/liveaction.org\/petition\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-160409 aligncenter\" src=\"\/news\/wp-content\/uploads\/2017\/01\/DefundAd-400b-1.jpg\" alt=\"\" width=\"400\" height=\"170\" \/><\/a><\/p>\n<p>French does not believe that <em>Roe <\/em>will end anytime soon, but he does have hope that the time for the Court&#8217;s abuse is coming to an end. He writes:<\/p>\n<blockquote><p>Defying President Obama in 2016 and Chuck Schumer in 2017 won\u2019t fix our nation\u2019s jurisprudence, and it won\u2019t necessarily end <em>Roe<\/em>, but it does signal that a critical mass of Americans have had enough. At long last, and for today at least, judicial supremacists face the consequences they so richly deserve.<\/p><\/blockquote>\n<div>\n<p>How does this relate to the nuclear option? As French makes clear, it is of utmost importance that the Court be comprised of those who can correctly interpret the Constitution to protect the right to life, rather than have it bend to their whims. During his hearings, Gorsuch\u00a0<a href=\"http:\/\/thehill.com\/regulation\/court-battles\/325203-gorsuch-i-accept-roe-v-wade-as-the-law-of-the-land\">has acknowledged that <em>Roe <\/em>is the law<\/a> and has\u00a0<a href=\"\/news\/senator-dianne-feinstein-calls-roe-v-wade-super-precedent-during-gorsuch-hearing\/\">refused to prejudge cases<\/a>. He has not yet directly ruled on abortion cases, but <a href=\"\/news\/neil-gorsuch-ruled-life-issues\/\">the cases he has ruled on<\/a> could be considered promising\u00a0by\u00a0pro-lifers.<\/p>\n<p>Perhaps most promising of all is how he has stood up against attacks on his originalist view, by those who take the &#8220;living constitution&#8221; view, which is how <em>Roe <\/em>became law in the first place.<\/p>\n<div class=\"ArticleAd2\">\n<p><!-- \/1011927\/LAN_300_BY_250_mid_article --><\/p>\n<div id=\"div-gpt-ad-1473179101244-0\" class=\"ArticleAd2a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179101244-0'); });\n<\/script><\/div>\n<div class=\"ArticleAd2a\"><\/div>\n<\/div>\n<\/div>\n<div>Since <em>Roe <\/em>and its companion case of <em>Doe v. Bolton, <\/em>which legalized abortion throughout all nine months of pregnancy, <a href=\"http:\/\/liveactionnews.org\/consequences-of-roe-v-wade-over-59-million-babies-lost-to-abortion\/\">an estimated over 58 million preborn Americans<\/a> have been aborted. The numbers are surely higher, due to the lack of requirements for states to report abortions.<\/div>\n<div><\/div>\n<div>Not too long ago, including for those still on the Court or having just recently departed, justices were confirmed by 96 or 98 votes. As both the pro-abortion and pro-life sides have noted, the battle for the Supreme Court has taken on a hyper-political role.
