And when you combine them, the results reach new and spectacular deaths of nonsense.<\/p>\n<p>At Cosmopolitan, Jill Filipovic uses this week\u2019s <a href=\"https:\/\/www.conservativereview.com\/commentary\/2017\/03\/gorsuchs-hearing-is-a-sham-its-time-for-bold-judicial-reform\">Supreme Court confirmation hearings<\/a> as a springboard to <a href=\"http:\/\/www.cosmopolitan.com\/politics\/a9162680\/neil-gorsuch-constitutional-originalism-supreme-court\/\">explain<\/a> why \u201cconstitutional originalism is bulls***.\u201d As you\u2019ve probably already guessed, there\u2019s more than a smidgen of projection going on here.<\/p>\n<p>Filipovic starts off by declaring that originalism\u2014the legal doctrine by which laws are interpreted based on the words on the page and the intended meaning of their authors\u2014is \u201cboth impossible and undercut by its own conceit, given that the writers of the Constitution arguably intended for it to be a living document.\u201d No, she offers no source for that last claim.<\/p>\n<blockquote><p>No one is really an originalist. No, not even Scalia, who decided plenty of cases according to his own whims and opinions. Take the District of Columbia v. Heller case, about a D.C. law restricting handgun ownership. Until recently, judges generally interpreted the Second Amendment according to the same narrow interpretation many historians say the founders held, as evidenced by the text itself: that the Second Amendment doesn&#8217;t give individuals the right to bear arms, but rather provides for the right of well-regulated militia to exist.<\/p><\/blockquote>\n<p>Now, I don\u2019t want to get too far into the weeds of non-abortion issues, but this passage is positively spectacular for how well it captures the utter bankruptcy of Filipovic\u2019s argument: she is actually suggesting that \u201cgive[s] individuals the right to bear arms\u201d is an <em>activist reading<\/em> of <a href=\"https:\/\/www.archives.gov\/founding-docs\/bill-of-rights-transcript\">the text<\/a>, \u201cthe right of the people to keep and bear Arms, shall not be infringed.\u201d Do I really need to elaborate further? A right the Constitution explicitly mentions isn&#8217;t real, but the &#8220;right&#8221; to abortion is?<\/p>\n<div class=\"ArticleAd1\">\n<p><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>Of course, that\u2019s nothing compared to a correction at the very bottom of the page, which shows you just how rigorous her idea of \u201csignificant historical evidence\u201d is:<\/p>\n<blockquote><p>Correction: A previous version of this article said handguns didn\u2019t exist in the 18th century. The author was referring to the type of modern handguns at issue in the Heller case; however, this was unclear and has been clarified.<\/p><\/blockquote>\n<p>\u2018Nuff said.<\/p>\n<p>Her second point against originalism is that \u201csocieties evolve, and that\u2019s a good thing,&#8221; because &#8220;our understanding of human rights has gotten more sophisticated; so has the science on how we live, experience pain, and develop.&#8221;<\/p>\n<p>First (and this also applies to her fourth, seventh, and ninth points, which basically repeat the same complaint in an attempt to make her argument seem more sophisticated than it really is), you don\u2019t need to redefine the Constitution\u2019s text to deal with changing understandings, ideas, technology, or problems. The genius of our system is that, because the Constitution is primarily concerned with restraining the federal government but delegates most things to the state and local level, it already allows more than enough flexibility for legislatures to try different solutions to issues as they arise.<\/p>\n<p>Of course, there have been a handful of times throughout history where we\u2019ve deemed it necessary to change the Constitution, but originalism provides a way to do that, too\u2014the amendment process.<\/p>\n<p>Second, it\u2019s ironic to see Filipovic talk about the importance of laws keeping up with society\u2019s knowledge when her side refuses to admit that society\u2019s <a href=\"\/news\/science-video-series-smuggles-abortion-lies-in-nonpartisan-packaging\/\">understanding of human biology<\/a> has evolved past the days when we thought a mother\u2019s womb didn\u2019t really contain a living human child until quickening\u2026<\/p>\n<p>Next, Filipovic asks:<\/p>\n<blockquote><p>Do we really want jurists to interpret \u201cequal\u201d the way it was meant when the Declaration of Independence declared that \u201call men are created equal\u201d \u2014 excluding all women and men who weren\u2019t white?<\/p><\/blockquote>\n<p>Why yes, as a matter of fact, we do\u2014because the Declaration <em>didn\u2019t<\/em> exclude females or non-whites. For one thing, \u201call men\u201d was <a href=\"http:\/\/dailysignal.com\/2010\/08\/18\/does-the-declaration-of-independence-prevent-women%E2%80%99s-suffrage\/\">commonly understood language for humanity as a whole, including women<\/a>\u00a0(as in \u201cmankind&#8221;). For another, if we taught civics properly these days, Filipovic would be familiar with Abraham Lincoln\u2019s <a href=\"http:\/\/teachingamericanhistory.org\/library\/document\/speech-on-the-dred-scott-decision\/\">astute observation<\/a> that declaring human equality \u201cwas of no practical use in effecting our separation from Great Britain,\u201d but was instead established \u201cfor future use\u201d as a \u201cstumbling block\u201d against tyranny, to help lay the groundwork for bringing about the abolition of slavery, which the Founders <a href=\"http:\/\/vindicatingthefounders.com\/library\/slavery.html\">despised from the beginning<\/a>.<\/p>\n<p>Next she claims that originalism \u201cis a cover for legal discrimination,\u201d citing as her example how <em>Plessy v. Ferguson<\/em> upheld segregation on the grounds that \u201cseparate\u201d was still \u201cequal,\u201d while <em>Brown v. Board of Education<\/em> reversed it \u201cbased not just on the text of the 14th Amendment itself, but also a showing that conditions for African-Americans were not equal to those of whites under Jim Crow.\u201d<\/p>\n<p>Wrong again. When she talks about Brown considering the conditions of blacks under segregation, she\u2019s really talking about the Court looking at the facts to see whether the laws of the time satisfied the <em>mandate in the text of the Constitution<\/em> that races be treated equally, not about setting aside the text for other considerations. That\u2019s perfectly consistent with originalism.<\/p>\n<p><a href=\"http:\/\/liveaction.org\/petition\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-160409\" src=\"\/news\/wp-content\/uploads\/2017\/01\/DefundAd-400b-1.jpg\" alt=\"\" width=\"400\" height=\"170\" \/><\/a><\/p>\n<p>Further, as\u00a0Ben Shapiro at the Daily Wire <a href=\"http:\/\/www.dailywire.com\/news\/14645\/hot-cosmo-features-9-reasons-constitutional-ben-shapiro\">explains<\/a>, Antonin Scalia made the case that <em>Plessy<\/em> was wrong and <em>Brown<\/em> was right <em>according to originalism<\/em>. The late justice said:<\/p>\n<blockquote><p>In my view the Fourteenth Amendment\u2019s requirement of &#8220;equal protection of the laws,&#8221; combined with the Thirteenth Amendment\u2019s abolition of the institution of black slavery, leaves no room for doubt that laws treating people differently because of their race are invalid.<\/p><\/blockquote>\n<p>And once again, the perverse irony of an abortion supporter making this case is hard to ignore\u2014her favored \u201cliving Constitution\u201d mode of jurisprudence has enabled and continues to protect the most violent form of discrimination in American history.<\/p>\n<p>(Oh, she also makes this incomprehensible statement: \u201cA strictly textual reading of a law isn\u2019t neutral; it also invites in the reader\u2019s own biases and assumptions.\u201d Uh, Jill? Imprinting one\u2019s \u201cown biases and assumptions\u201d onto the text is the exact <em>opposite<\/em> of a \u201cstrictly textual reading.\u201d)<\/p>\n<p>Filipovic\u2019s next point may be the worst\u00a0in the whole piece: \u201cnot even the founders were originalists.\u201d No, she doesn\u2019t offer any support for that contention, but it may have come from her next, which I still can\u2019t believe I actually read (I know, I know, nothing should surprise me anymore):<\/p>\n<blockquote><p>The framers of the Constitution didn\u2019t offer any instructions for how to interpret the document, nor did they get into specifics on what each of its provisions meant.<\/p><\/blockquote>\n<p><em>No instructions<\/em>? Has Filipovic never heard of the <a href=\"https:\/\/www.congress.gov\/resources\/display\/content\/The+Federalist+Papers\">Federalist Papers<\/a>? Do the names Madison, Hamilton, or Jay ring any bells, Jill? For goodness\u2019 sake, the framers left us <em>so many<\/em> instructions on the intent and meaning and function of the Constitution\u2019s <em>every provision<\/em> that one of the essential resources for any serious political observer, the University of Chicago\u2019s <em><a href=\"http:\/\/press-pubs.uchicago.edu\/founders\/tocs\/toc.html\">Founders&#8217; Constitution<\/a><\/em>, is a massive collection of the framers\u2019 writings <em>on every clause<\/em> of the Constitution.<\/p>\n<p>It\u2019s hard to top that, but Filipovic tries by declaring \u201cno one really wants to live in an originalist country.\u201d It soon becomes clear, though, that what she really means is \u201cno one who shares my politics.\u201d<\/p>\n<div class=\"ArticleAd2\">\n<p><!-- \/1011927\/LAN_300_BY_250_mid_article --><\/p>\n<div id=\"div-gpt-ad-1473179101244-0\" class=\"ArticleAd2a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179101244-0'); });\n<\/script><\/div>\n<\/div>\n<p>She quotes UC Irvine Law School Dean Erwin Chemerinsky rattling off a string of supposed horrors originalism would bring. Some are just false\u2014\u201cNo longer would the Bill of Rights apply to state and local governments\u201d (the <a href=\"https:\/\/www.law.cornell.edu\/wex\/incorporation_doctrine\">14th Amendment extends those protections to the states<\/a>, not \u201cliving Constitution\u201d thinking)\u2014but mostly it\u2019s just a mix of things we didn\u2019t need judicial activism to secure and illicit political goals that prove originalists\u2019 point, including\u2014you guessed it\u2014\u201cthe right to abortion.\u201d<\/p>\n<p>Filipovic closes her piece\u00a0by sneering that originalism is nothing more than \u201ca way to allow rampant discrimination against actual people while protecting the interests of corporate \u2018persons\u2019 and promoting the extreme ideologies of lobby groups.\u201d<\/p>\n<p>Let\u2019s see: <a href=\"\/news\/why-are-sex-selective-abortions-so-offensive-if-abortion-itself-isnt\/\">rampant discrimination against actual people<\/a>? Government protection of a <a href=\"http:\/\/liveaction.org\/abortioncorporation\/\">wildly-corrupt, powerful business<\/a>? Promoting the agenda of a special interest whose ideology is <a href=\"http:\/\/www.realclearpolitics.com\/articles\/2017\/01\/27\/poll_finds_most_women_back_abortion_restrictions_132913.html\">dramatically out of step with public opinion<\/a>?<\/p>\n<p>Sounds to me like Jill Filipovic just described the abortion industry and the legal and political privileges it\u2019s enjoyed for a long time\u2026 perversions of law, justice, human rights, and public safety that originalism had nothing to do with.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Among valuable sources of legal advice, pro-abortion activists and fashion magazines rank near the bottom of the list.
