{"id":161249,"date":"2017-01-31T09:33:59","date_gmt":"2017-01-31T14:33:59","guid":{"rendered":"\/news\/?p=161249"},"modified":"2017-01-31T01:14:46","modified_gmt":"2017-01-31T06:14:46","slug":"a-pro-life-look-at-trumps-scotus-frontrunner-neil-gorsuch","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/a-pro-life-look-at-trumps-scotus-frontrunner-neil-gorsuch\/","title":{"rendered":"A pro-life look at Trump&#8217;s SCOTUS frontrunner, Neil Gorsuch"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Less than a week into his presidency, Donald Trump has already made several encouraging moves for life: <a href=\"\/news\/breaking-president-trump-signs-executive-order-defunding-international-planned-parenthood\/\">restoring the ban<\/a> on foreign aid money going to abortion groups, <a href=\"https:\/\/www.lifesitenews.com\/news\/trump-promises-to-sign-new-ban-on-taxpayer-funded-abortions\">confirming he will sign<\/a> a permanent ban on taxpayer funding of abortion if it reaches his desk, <a href=\"https:\/\/www.lifesitenews.com\/news\/trump-plugs-march-for-life-to-liberal-reporter-youre-gonna-have-a-large-cro\">calling out the media<\/a> for ignoring the March for Life while obsessively covering the pro-abortion, so-called Women\u2019s March on Washington, and <a href=\"http:\/\/www.lifenews.com\/2017\/01\/26\/vice-president-mike-pence-will-speak-at-march-for-life-first-vp-ever-to-address-pro-life-event\/\">sending Vice President Mike Pence<\/a> to speak and represent the White House at the March for Life.<\/p>\n<p>But, reportedly, the biggest test yet of whether he\u2019s serious about being a pro-life president will come tonight. Trump has announced that he will be <a href=\"http:\/\/www.cnn.com\/2017\/01\/30\/politics\/donald-trump-supreme-court-choice-announcement-coming-tuesday-8-p-m-\/\">revealing his first Supreme Court nominee<\/a> at 8:00pm on Tuesday. The\u00a0dominant buzz\u00a0is that Judge Neil Gorsuch from the Tenth Circuit Court of Appeals is now Trump\u2019s favorite to replace the <a href=\"\/news\/time-pro-lifers-stand-strong-protecting-scalias-principles\/\">late, great Antonin Scalia<\/a>.<\/p>\n<p>If true, could Gorsuch be instrumental in overturning <em>Roe v. Wade<\/em>, or has President Trump chosen his frontrunner poorly? Let\u2019s find out.<\/p>\n<p>Gorsuch\u2019s name <a href=\"\/news\/trump-releases-another-list-of-judicial-nominees-including-pro-life-mike-lee\/\">appeared<\/a> on Trump\u2019s list of potential Supreme Court nominees he offered during the campaign to show he could be trusted with the responsibility. The list was assembled with substantial input from the Heritage Foundation and the Federalist Society to ensure every name was a solid originalist, garnering the list widespread praise from pro-life and conservative legal experts.<\/p>\n<p>Gorsuch himself is also being widely hailed as an eminently qualified jurist committed to the original meaning of the Constitution. His former clerk David Feder <a href=\"http:\/\/yalejreg.com\/nc\/the-administrative-law-originalism-of-neil-gorsuch\/\">attests<\/a> that his old boss \u201cnot only faithfully applies originalist methodology but articulately explains why our constitutional design remains relevant\u2014and critical\u2014over two hundred years later&#8221;:<\/p>\n<blockquote><p>Whenever a constitutional issue came up in our cases, he sent one of his clerks on a deep dive through the historical sources. \u201cWe need to get this right,\u201d was the motto\u2014and right meant \u201cas originally understood.\u201d I can think of no one better to carry on Justice Scalia\u2019s legacy and, in the words of Justice Thomas, \u201cto stand firm in the defense of the constitutional principles and structure that secure our liberty.\u201d<\/p><\/blockquote>\n<p>Hot Air\u2019s Allahpundit <a href=\"http:\/\/hotair.com\/archives\/2017\/01\/23\/cbs-judge-neil-gorsuch-emerges-as-a-leading-supreme-court-candidate\/\">summarizes<\/a> the judge\u2019s background:<\/p>\n<blockquote><p>Gorsuch\u2019s career arc in public service has been meteoric. He joined the DOJ in 2005, was elevated as a judge to the Tenth Circuit in Colorado a year after, and now is in line for a Supreme Court appointment a little more than 10 years later. He\u2019s all of 49 years old, five years younger than the nominal frontrunner for the Scalia vacancy, William Pryor. Put him on the Court this year and there\u2019s a fair chance he\u2019ll still be there in 2050.<\/p><\/blockquote>\n<p>But while impressive, Gorsuch\u2019s rapid rise has one problematic side effect, through no fault of his own: a relatively thin paper trail of opinions by which to determine how he\u2019d rule in specific cases, including little precedent directly ruling on abortion and no express statements on whether he considers <em>Roe<\/em> to be wrongly decided. That leaves us to try to infer his position from what he\u2019s ruled and said elsewhere.<\/p>\n<p>First, SCOTUSblog\u2019s <a href=\"http:\/\/www.scotusblog.com\/2017\/01\/potential-nominee-profile-neil-gorsuch\/\">profile on Gorsuch<\/a> highlights cases in which his \u201copinions also reveal a measure of distrust towards unwritten constitutional provisions like the dormant commerce clause\u201d\u2014a useful clue:<\/p>\n<blockquote><p>Gorsuch\u2019s opinion shows respect for the doctrine\u2019s \u201c[d]etractors,\u201d like Scalia, who \u201cfind dormant commerce doctrine absent from the Constitution\u2019s text and incompatible with its structure.\u201d Though Gorsuch\u2019s personal constitution seems to require him to write clearly about the many unclear aspects of the doctrine, his opinion plainly takes some joy in the act of demonstrating that not only does the dormant commerce clause not apply \u2014 the doctrine also doesn\u2019t make much sense [\u2026]<\/p>\n<p>[I]t\u2019s noteworthy that criticism of the dormant commerce clause is of a piece with criticism of the \u201cright to privacy\u201d that undergirds the Supreme Court \u2018s abortion jurisprudence, as well as other judge-made doctrines that do not have a strong connection to the constitutional text. Again, Gorsuch\u2019s opinions seem to follow the lead of textualists and federalists like Scalia in expressing great skepticism towards such doctrines, which allow judges to strike down duly enacted local laws on the basis of vague principles that cannot be found in the concrete text of the national charter.<\/p><\/blockquote>\n<p>Second, SCOTUSblog notes that Gorsuch sided with Hobby Lobby and the Little Sisters of the Poor in their suits against the Obama Administration\u2019s contraception mandate: \u201cGorsuch has shown himself to be an ardent defender of religious liberties and pluralistic accommodations for religious adherents.\u201d He also <a href=\"http:\/\/fox13now.com\/2016\/10\/28\/10th-circuit-court-wont-hear-planned-parenthood-lawsuit-against-gov-herbert-again\/\">sided with<\/a> Utah Governor Gary Herbert\u2019s attempts to defund Planned Parenthood.<\/p>\n<p>Third, while in private practice, Gorsuch actually wrote a <a href=\"http:\/\/www.nationalreview.com\/article\/213590\/liberalsnlawsuits-joseph-6\">National Review article<\/a> about the reliance \u201con judges and lawyers rather than elected leaders and the ballot box, as the primary means of effecting [liberals\u2019] social agenda [&#8230;] This overweening addiction to the courtroom as the place to debate social policy is bad for the country and bad for the judiciary.\u201d That\u2019s exactly right, and it would be <em>extremely<\/em> surprising if he didn\u2019t apply that exact same logic to <em>Roe.<\/em><\/p>\n<p>Fourth, Hot Air\u2019s Ed Morrissey has <a href=\"https:\/\/storify.com\/captained1963\/getting-started\">reviewed<\/a> Gorsuch\u2019s 2006 book, &#8220;The Future of Assisted Suicide and Euthanasia,&#8221; in which the judge makes (in Morrissey\u2019s paraphrasing) a powerful\u00a0case for the \u201cintrinsic value of human life, and its correlation to equal treatment under the law.\u201d That strongly suggests he\u2019s not merely in the \u201cpersonally pro-life\u201d camp, but that he recognizes that the right to life is a matter of justice.<\/p>\n<p>In the\u00a0book, Gorsuch also <a href=\"http:\/\/www.nationalreview.com\/bench-memos\/442581\/schlafly-attack-gorsuch\">makes the astute observation<\/a> that \u201cno constitutional basis exists for preferring the mother\u2019s liberty interests over the child\u2019s life,\u201d which is why <em>Roe<\/em> opted to <a href=\"\/news\/life-conception-act-idea-whose-time-come\/\">simply dodge the subject of personhood<\/a>\u00a0(a strong hint as to what he thinks of <em>Roe<\/em>, but not an outright condemnation).<\/p>\n<p>Finally, Gorsuch does have one pro-life detractor: Andy Schlafly, pro-life activist and son of the late pro-life icon <a href=\"\/news\/honoring-departed-pro-life-hero-phyllis-schlafly\/\">Phyllis Schlafly<\/a>, who has been waging a one-man war against many of the very nominees on Trump\u2019s list that his mother enthusiastically supported. Schlafly claims Gorsuch is almost certainly not pro-life, but Ethics and Public Policy Center president Ed Whelan <a href=\"http:\/\/www.nationalreview.com\/bench-memos\/442581\/schlafly-attack-gorsuch\">refuted<\/a> his <a href=\"http:\/\/www.nationalreview.com\/bench-memos\/444183\/andy-schlafly-smears-neil-gorsuch\">charges<\/a> in <a href=\"http:\/\/www.nationalreview.com\/bench-memos\/444195\/andy-schlafly-smears-neil-gorsuch\">extensive detail<\/a>, showing Schlafly\u2019s case to be a mix of convoluted, speculative reaching and a twisting of rulings to mean the <em>opposite<\/em> of how Gorsuch actually came down.<\/p>\n<p>So, in conclusion, the good news is that all available evidence suggests Gorsuch would be a reliable pro-life justice, and no evidence suggests he\u2019d let us down. The bad news is that he\u2019s not explicitly\u00a0on the record as wanting\u00a0<em>Roe <\/em>gone<em>,<\/em>\u00a0like fellow SCOTUS contender <a href=\"\/news\/a-pro-life-look-at-donald-trumps-supreme-court-nominees\/\">William Pryor is<\/a>.<\/p>\n<p>If Gorsuch is indeed the choice, pro-lifers should be cautiously optimistic, but should also call on him to reveal his position on <em>Roe<\/em> before the Senate confirms him. Candidate Trump <a href=\"http:\/\/www.cnbc.com\/2016\/10\/19\/trump-ill-appoint-supreme-court-justices-to-overturn-roe-v-wade-abortion-case.html\">explicitly promised<\/a> that his Supreme Court nominees would overturn it, and while judges aren\u2019t supposed to pre-judge future cases, there\u2019s nothing improper about publicly judging <em>past<\/em> cases.<\/p>\n<p>The pro-life cause has <a href=\"\/news\/john-roberts-defection-spells-trouble-for-overturning-roe\/\">gotten burned<\/a> too many times by <a href=\"\/news\/remembering-reagans-judicial-nominees-on-the-anniversary-of-his-death\/\">stealth judicial nominees<\/a>, so we deserve to know exactly what we\u2019re getting with Trump\u2019s
