When reading LawNewz, however, one would be wrong.<\/p>\n<p>There, Elura Nanos <a href=\"http:\/\/lawnewz.com\/uncategorized\/sessions-gets-it-really-wrong-calls-roe-v-wade-unconstitutional\/\">attacks<\/a> Senator Jeff Sessions, Donald Trump\u2019s <a href=\"\/news\/would-jeff-sessions-investigate-planned-parenthood-attorney-general\/\">nominee for Attorney General<\/a>, for daring to show insufficient respect to <em>Roe v. Wade<\/em>. Specifically, Sessions answered that he stands by his previously-stated view that Roe \u201cviolated the Constitution, and really attempted to set policy and not follow law.\u201d<\/p>\n<p>Her title calls this answer \u201creally wrong,\u201d while in the body she writes it\u2019s \u201cjust not quite right,\u201d so it\u2019s unclear exactly how outrageously outraged we\u2019re meant to be here. But the justification for Nanos\u2019s outrage leaves much to be desired:<\/p>\n<blockquote><p>Saying that a Supreme Court decision \u201cviolated the Constitution\u201d is essentially meaningless. The Supreme Court sits as the final authority on interpretative questions of federal law. In other words, what SCOTUS says the Constitution says is what the Constitution says. That\u2019s just how it works.<\/p><\/blockquote>\n<p>No, that\u2019s not how it works. At all. The idea that one branch of government has an exclusive monopoly on interpreting the Constitution\u2014y\u2019know, the document that\u2019s supposed to keep<em> all three<\/em> branches in check\u2014is so blatantly backwards that its popularity can only be explained by political agendas subverting legal education and journalism.<\/p>\n<div class=\"ArticleAd1\"><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>The truth is that the three branches have a coequal power and responsibility to protect the Constitution as they understand it\u2014from each other, if necessary. As Thomas Jefferson <a href=\"http:\/\/famguardian.org\/subjects\/politics\/thomasjefferson\/jeff1030.htm\">explained<\/a>, \u201cthere is not a word in the Constitution which has given\u201d SCOTUS more \u201cauthority to decide on the constitutionality of a law\u201d than that given \u201cto the Executive or Legislative branches.\u201d Which again, should be readily apparent after just a few moments of asking oneself why we have a Constitution in the first place.<\/p>\n<p>Bizarrely, Nanos next concedes there are \u201cplenty of ways to appropriately critique Supreme Court decisions\u201d such as <em>Roe<\/em>\u2014she\u2019s simply nitpicking Sessions\u2019s wording because \u201cit\u2019s just far easier for him to yell \u2018unconstitutional!\u2019 and hope people will think that sounds powerful.\u201d<\/p>\n<p>Funny, I wonder if she would also label as \u201cyelling\u201d <a href=\"\/news\/justice-scalias-refresher-on-constitutional-originalism\/\">these condemnations<\/a> of <em>Roe<\/em>, from pro-abortion legal scholars:<\/p>\n<blockquote><p>Roe \u201cis not constitutional law and gives almost no sense of an obligation to try to be.\u201d\u2014John Hart Ely, Yale, Harvard, and Stanford Law Schools<\/p>\n<p>\u201cWhat, exactly, is the problem with Roe? The problem, I believe, is that it has little connection to the Constitutional right it purportedly interpreted.\u201d\u2014Edward Lazarus, former clerk to Justice Harry Blackmun<\/p>\n<p>\u201cAs constitutional argument, Roe is barely coherent. The court pulled its fundamental right to choose more or less from the constitutional ether.\u201d\u2014Kermit Roosevelt, University of Pennsylvania Law School<\/p>\n<p>\u201cOne of the most curious things about Roe is that, behind its own verbal smokescreen, the substantive judgment on which it rests is nowhere to be found.\u201d\u2014Laurence Tribe, Harvard Law School<\/p><\/blockquote>\n<p>Nanos continues:<\/p>\n<blockquote><p>Sessions\u2019 flip \u201cRoe really stinks, but I\u2019ll grudgingly follow it anyway\u201d is a prelude to what we know Sessions will do as Attorney General. He will continue to obscure the legal issues surrounding reproductive freedom. He will continue to fuel the arguments of the uninformed by suggesting that Roe was some sort of judicial anomaly.<\/p><\/blockquote>\n<p>This rampant speculation is apparently based on nothing more than Nanos thinking modern abortion jurisprudence really is infallible after all, despite just claiming to respect reasonable dissent in the previous paragraph. For actual \u201cobscuring of the legal issues\u201d and \u201cfueling the arguments of the uninformed,\u201d you have to check out her <a href=\"\/news\/pro-abortion-analyst-utterly-fails-to-discredit-clarence-thomass-texas-dissent\/\">nonsensical attack on Justice Clarence Thomas<\/a> last summer for dismantling the illogic of <em>Whole Woman\u2019s Health v. Hellerstedt<\/em>.<\/p>\n<p>Finally, Nanos attacks Sessions for giving the following answer:<\/p>\n<blockquote><p>Sessions went on to tell Senator Feinstein that Roe, \u201cis the law of the land. It has been so established and settled for quite a long time, and it deserves respect, and I would respect it and follow it.\u201d<\/p><\/blockquote>\n<p>What could possibly be wrong with a prospective attorney general recognizing that it wouldn\u2019t be his job to decide which rulings stand or fall, but rather to enforce whatever is in effect during his tenure? Get ready for crazy:<\/p>\n<blockquote><p>Such a statement is the worst kind of publicly-perpetrated con. On its face, it sounds reasonable, respectable, and righteous. But the damage it inflicts is subtle and stealthy. What Sessions has really said is that he will choose to follow the law. Such a promise hinges on the unspoken assumption that such a choice would be Sessions\u2019 to make. It may sound gracious and even noble for Sessions to vow to uphold a legal precedent he finds so detestable and erroneous; but so characterizing himself makes the implicit point that Sessions could have chosen not to do so.<\/p><\/blockquote>\n<p>Your eyes do not deceive you; a \u201c<a href=\"https:\/\/twitter.com\/EluraNanos\">TV lawyer &amp; millennial expert<\/a>\u201d (mostly the latter, clearly) is arguing that Sessions believes he has the discretion to disregard whatever he doesn\u2019t like\u2026 based <em>solely<\/em> on convoluted inferences from his phrasing. That\u2019s it. Never mind that he expressly called it \u201cthe law of the land\u201d and pledged to \u201crespect it and follow it.\u201d<\/p>\n<div class=\"ArticleAd2\"><!-- \/1011927\/LAN_300_BY_250_mid_article --><\/p>\n<div id=\"div-gpt-ad-1473179101244-0\" class=\"ArticleAd2a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179101244-0'); });\n<\/script><\/div>\n<\/div>\n<p>This complaint is particularly ironic considering that reserving the right to follow or ignore the law based on one\u2019s personal desires is <em>precisely what Nanos champions<\/em> by defending <a href=\"http:\/\/liveaction.org\/blog\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">abortion&#8217;s judicial status quo<\/a>. Not only that, but she doesn\u2019t care that the previous attorney general committed a far more open-and-shut case of ignoring the law by <a href=\"\/news\/four-months-later-ag-lynch-hasnt-seen-planned-parenthood-videos\/\">ignoring the evidence<\/a> of Planned Parenthood committing numerous federal crimes. Nanos <a href=\"http:\/\/lawnewz.com\/uncategorized\/the-trump-dojs-first-big-target-could-be-planned-parenthood\/\">dutifully repeats<\/a> the abortion industry\u2019s <a href=\"\/news\/amanda-marcotte-packs-a-year-of-baby-parts-lies-into-a-single-diatribe\/\">utter lie<\/a> that the Center for Medical Progress videos revealing Planned Parenthood\u2019s fetal chop shop were \u201cheavily-edited and later discredited,\u201d even \u201cfake.\u201d<\/p>\n<p>This is the level of dishonesty, hysteria, and legal fraud Jeff Sessions will be up against if confirmed.
