{"id":158834,"date":"2016-12-21T16:21:11","date_gmt":"2016-12-21T21:21:11","guid":{"rendered":"\/news\/?p=158834"},"modified":"2016-12-21T16:22:10","modified_gmt":"2016-12-21T21:22:10","slug":"il-pregnancy-center-optimistic-judge-injunction-abortion-referral-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/il-pregnancy-center-optimistic-judge-injunction-abortion-referral-law\/","title":{"rendered":"Illinois pregnancy centers &#8216;optimistic&#8217; following injunction against abortion referral law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/pregnancyhelpnews.com\/illinois-judge-halts-state-s-free-speech-assault-on-pro-life-docs-clinics\">Pregnancy Help News<\/a>)\u00a0Pro-life advocates in Illinois are celebrating the first of what they hope to be many victories in the fight against a new state law that would force pro-life doctors, nurses and pregnancy centers to refer patients for abortions, following a preliminary injunction handed down late Tuesday.<\/p>\n<p>The injunction, granted by Judge Eugene Doherty of the 17th Judicial Circuit Court in Winnebago County, halts a 2016 change in Illinois\u2019 Healthcare Right of Conscience Act that would have forced pro-life medical professionals and nonprofits to refer patients directly to abortion businesses upon request.<\/p>\n<p>Applying only to the named defendants in\u00a0<em>Pregnancy Care Center of Rockford, et al. v. Bruce Rauner et al<\/em>, the preliminary injunction could set the stage for good news in\u00a0<a href=\"https:\/\/pregnancyhelpnews.com\/adf-files-second-suit-opposing-illinois-abortion-referral-law\">a broader case<\/a>\u00a0challenging the law in federal court.<\/p>\n<p>That hearing is scheduled\u00a0for Jan. 10, 2017\u201410 days after the law was set to go into effect.<\/p>\n<p>\u201cWe are optimistic and we are grateful,\u201d Tiffany Staman, executive director at Pregnancy Care Center of Rockford, said. \u201cWe realize this is just the beginning of the road, but we\u2019re really grateful that the court ruled based on our free speech rights that are found in the Constitution. We are looking forward to 2017 and following God\u2019s leading every step of the way.\u201d<\/p>\n<div class=\"ArticleAd1\">\n<p><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>In the court\u2019s\u00a0<a href=\"http:\/\/www.adfmedia.org\/files\/OrderGrantingPrelimInjunction.pdf\">order granting the preliminary injunction<\/a>, Judge Doherty agreed with the three\u00a0pregnancy help organizations and one physician, Dr. Anthony Caruso, named in the case that the state\u2019s amendment violates their free speech rights by compelling them to speak a state-sponsored message\u2014particularly since the state is equipped to speak its own message without forcing others to do so on its behalf.<\/p>\n<p>Alliance Defending Freedom (ADF), which represents the pregnancy centers in lawsuits at state and federal levels, also represents pro-life organizations in California who are\u00a0<a href=\"https:\/\/pregnancyhelpnews.com\/fight-for-free-speech-conscience-rights-continues-in-california-illinois\">battling a similar push<\/a>\u00a0by the state to compel them to post signage advertising state-funded abortions.<\/p>\n<p>\u201cNo state has the authority to compel health professionals, against their will and their sacred oath to \u2018do no harm,\u2019 to promote abortion,\u201d Matt Bowman, senior counsel for ADF, said in a statement following Tuesday\u2019s injunction. \u201cWe commend the court\u2019s ruling which is a victory for free speech and the freedom of conscience\u201d<\/p>\n<p>Susan Barrett, who serves as executive director at Chicago-based Aid for Women\u2014one of the named plaintiffs on the suit\u2014wrote to supporters Tuesday evening informing them of the news while keeping them prepared for a long battle ahead.<\/p>\n<p>Since at least 2009, abortion advocacy groups such as NARAL Pro-Choice America have backed state and local legislative efforts to force pro-life pregnancy centers to speak government-dictated messages that often run specifically counter to the organizations\u2019 pro-life missions.<\/p>\n<p>Two separate cases where governments have tried to enforced compelled speech on pregnancy centers on the East Coast\u2014one in New York City and the other in\u00a0<a href=\"https:\/\/pregnancyhelpnews.com\/positive-ruling-in-baltimore-could-set-persuasive-precedent-for-free-speech-attacks-elsewhere\">Baltimore<\/a>\u2014have been ongoing since 2010, even though courts have consistently ruled that they are unconstitutional infringements.<\/p>\n<p>Other cases where state and local governments have unsuccessfully attempted to force pro-lifers to speak a compelled message include Austin (TX) and Montgomery County (MD), which eventually was ordered to pay pregnancy centers\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/exclusive-e-mails-reveal-maryland-officials-collaborating-with-naral-to-shu\">$330,000 in attorney&#8217;s\u00a0fees<\/a>.<\/p>\n<p>\u201cOur fight for our conscience rights, the lives of the unborn, and the best interest of women will press on,\u201d Barrett said. \u201cWe are enormously grateful for the help of our friends at Alliance Defending Freedom in protecting and defending our life-saving work. We have an absolute moral and Constitutional right to save lives.
