In his nomination speech, Obama praised Garland, saying:<\/p>\n<blockquote><p>Chief Judge Garland is more than just a brilliant legal mind, he\u2019s someone who has a keen understanding that justice is about more than abstract legal theories, more than some footnote in a dusty case book.<\/p><\/blockquote>\n<p>Many worried that this meant Garland would presumably rule based on factors beyond just the text of the law, and the intent of its authors. Pro-abortion activists applauded the nomination. And while Garland didn&#8217;t often rule on abortion cases, he previously <a href=\"\/news\/obama-nominee-garland-sided-against-priests-for-life-in-contraception-mandate-case\/\">ruled against Priests for Life<\/a> in a case against the Obama administration&#8217;s contraception mandate. Garland also has ties to <em>Roe v. Wade<\/em> Justice William Brennan, and has also expressed admiration for Harry Blackmun, who authored the court&#8217;s opinion on <em>Roe<\/em>.<\/p>\n<div class=\"ArticleAd1\">\n<p><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>Pro-life Americans immediately contested the appointment, and were aided by pro-life Republicans, who <a href=\"\/news\/pro-abortion-activists-protest-republicans-to-demand-garland-vote\/\">prevented a vote on Garland&#8217;s confirmation<\/a>. Senate Republicans repeatedly insisted that the next president should be the one to fill the vacancy on the Supreme Court, a move that angered pro-abortion activists.<\/p>\n<p>Now, the Washington Times is reporting that while Obama isn&#8217;t withdrawing the nomination, <a href=\"http:\/\/www.washingtontimes.com\/news\/2016\/nov\/22\/obama-waves-white-flag-trade-deal-garland\/?mkt_tok=eyJpIjoiTkdabVpqbG1PVE5qTkRWayIsInQiOiJcLzlIY29GeGJSbVlocG84eEw4OTkzVlZCcE4rN2ZkQTBiSEFpUTdKUVRHYVZlcGxnc0M3SWlFZkR0ekQyMUpBNW9cL2hCNkVyaEpFODBwZmpsUVRBSk9DdHNsZDZzRjVFcEVcL1F6d1VVSkp0OD0ifQ%3D%3D\">he is essentially giving up<\/a>. White House Press Secretary Josh Earnest said, \u201cHis treatment and the way this situation is likely to end is a scar on the institution of the United States Senate.
