Wade"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>In the wake of pro-lifers <a href=\"\/news\/what-trumps-election-means-for-pro-lifers\/\">retaking the White House<\/a> and <a href=\"\/news\/along-with-trump-win-americans-elect-prolife-house-senate\/\">keeping Congress<\/a>, abortion advocates <a href=\"\/news\/planned-parenthood-begs-for-money-after-the-elections-were-devastated-angry-shocked\/\">fear<\/a> it\u2019s only a matter of time before they take over the remaining part of the federal government, the Supreme Court\u2014and that with it, <em>Roe v. Wade\u2019s<\/em> 43-year reign of terror might finally come to an end.<\/p>\n<p>At Cosmopolitan, Robin Marty <a href=\"http:\/\/www.cosmopolitan.com\/politics\/a8262419\/donald-trump-abortion-roe-v-wade\/\">frets<\/a> (hat tip to <a href=\"http:\/\/www.lifenews.com\/2016\/11\/09\/abortion-activists-complain-the-end-of-roe-v-wade-is-now-a-real-possibility\/\">Life News<\/a>) that it \u201ccould well mean the end of safe, legal abortion in the country.\u201d (Say, is \u201csafe, legal abortion\u201d a medical term? I seem to recall pro-aborts being sticklers for that sort of thing.)<\/p>\n<blockquote><p>The anti-abortion movement faced some of its darkest hours following\u00a0<a href=\"http:\/\/www.cosmopolitan.com\/politics\/a53639\/scalia-death-abortion-rights\/\">the death of Supreme Court Justice Antonin Scalia<\/a>. The sudden loss of the most conservative member of the Court threw a wrench in a decade of intricate planning to pass a number of abortion restrictions in state legislatures with the hope that they would be challenged by abortion providers and eventually make it to the Supreme Court, where justices could rule to overturn\u00a0Roe v. Wade. The 5\u20133 decision in\u00a0<a href=\"http:\/\/www.cosmopolitan.com\/politics\/news\/a60604\/supreme-court-abortion-texas-facts\/\">Whole Women\u2019s Health v. Hellerstedt<\/a>\u00a0made it clear that without a new socially conservative justice, the quest to end abortion through the court system was on hold.<\/p><\/blockquote>\n<p>Slight correction: we do indeed quest to end abortion, but not through the court system. Overturning <em>Roe<\/em> would only directly end abortion in <a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/abortion-policy-absence-roe\">fifteen states with unenforced abortion bans currently on the books<\/a>, and abortion advocates\u00a0in those states would be free to attempt to persuade their fellow residents or their legislators to repeal those bans.<\/p>\n<p>All we want from the courts is to get out of the democratic process\u2019s way, both because it\u2019s the constitutionally right thing to do and because we\u2019re confident that as long as we have the chance to make our case in the court of public opinion, legislatures and electorates can get us the rest of the way. Speaking of making our case in the court of public opinion, it seems that when people learn what&#8217;s involved in an\u00a0abortion, they&#8217;re more likely to change their minds about it:<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/0xWQHhqOAcg\" width=\"640\" height=\"360\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>If Marty and her fellow travelers truly possess the confidence they normally project that abortion is a settled women\u2019s right in the minds of the American public, they should welcome a fair fight. What do you say?<\/p>\n<blockquote><p>Only one Republican incumbent lost his race at this point, with just one Senate race still too close to call, and that means when Trump is sworn into office this January, he will be able to appoint someone from his short list of judges \u201c<a href=\"http:\/\/www.lifenews.com\/2016\/10\/09\/donald-trump-im-looking-to-appoint-judges-very-much-in-the-mold-of-justice-scalia\/\">very much in the mold of Scalia<\/a>.\u201d That new judge will once again make moderate Justice Anthony Kennedy \u2014 who is an inconsistent supporter of abortion rights at best \u2014 the swing vote on the court. Meanwhile there will be a number of laws geared toward testing his complicated feelings around the \u201c<a href=\"http:\/\/time.com\/4243675\/heres-what-justice-kennedy-thinks-about-abortion\/\">life of the unborn<\/a>\u201d working their way up the docket.<\/p><\/blockquote>\n<p>Indeed. Replacing Scalia with somebody from Trump\u2019s strong list of judicial nominees would prevent the cementing of a clear pro-abortion majority, but beyond that it would just restore the status quo from before Scalia died. The real revolution starts when the next vacancies arise\u2014which could absolutely come during Trump\u2019s first term. <a href=\"https:\/\/www.supremecourt.gov\/about\/biographies.aspx\">Justices Anthony Kennedy, Ruth Bader Ginsburg, and Stephen Breyer<\/a> are 80, 83, and 78 years old, respectively, and there are already <a href=\"http:\/\/qz.com\/832200\/election-2016-heres-what-a-president-trump-will-do-to-the-supreme-court\/\">reports<\/a> that Ginsburg and Breyer \u201care expected to retire\u201d around or before the 2018 midterm congressional elections.<\/p>\n<p>Of course, it will depend on whether Trump sticks to his nominee list (which, as commentator Hugh Hewitt explains, Senate Republicans <a href=\"http:\/\/www.washingtonexaminer.com\/once-more-into-the-supreme-court-breach\/article\/2599319\">can force him to if necessary<\/a>), but <em>we could just be a few years away from a 6-3 pro-life, pro-Constitution majority on the Supreme Court<\/em>. From there, it\u2019s a simple matter for a pro-life legislature and governor to enact test-case legislation forcing the court to revisit <em>Roe<\/em>.<\/p>\n<blockquote><p>The inability to access birth control easily \u2014 an issue that will be impacted not just by defunding Planned Parenthood but when Trump and the Republican Congress follow through on their promise to repeal the Affordable Care Act, which mandated no co-pay birth control in insurance programs \u2014 plus the likelihood that it will be nearly impossible to get an abortion after 20 weeks will both have immediate effects on women.<\/p><\/blockquote>\n<p>Gee, if only birth control was <a href=\"http:\/\/cnsnews.com\/blog\/craig-bannister\/sex-crazed-co-eds-going-broke-buying-birth-control-student-tells-pelosi-hearing\">readily available<\/a> for prices ranging from <a href=\"http:\/\/www.nationalreview.com\/article\/292202\/my-contraceptive-haul-charles-c-w-cooke\">free<\/a> to <a href=\"http:\/\/www.weeklystandard.com\/dc-target-sells-birth-control-9-month-georgetown-student-tells-congress-friends-are-going-broke-pay-pills\/article\/632955?nopager=1\">$9 per month<\/a> without Planned Parenthood or government programs\u2026<\/p>\n<blockquote><p>But if Trump has the opportunity to appoint even more Supreme Court justices, that would shift the court even further right, and he has pledged to only appoint\u00a0<a href=\"http:\/\/www.cnbc.com\/2016\/10\/19\/trump-ill-appoint-supreme-court-justices-to-overturn-roe-v-wade-abortion-case.html\">justices who would overturn\u00a0Roe<\/a>, which would allow states to make abortion completely illegal again. Currently, there are three justices are age 78 or older, and they all are considered liberal-leaning judges.<\/p><\/blockquote>\n<p>Correct, Robin. <em>Isn\u2019t it exciting?<\/em><\/p>\n<div class=\"ArticleAd1\">\n<p><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>Consider this: when we\u2019re talking about abortion in the context of judges, we\u2019re not talking about its moral legitimacy, whether it should be banned, its impact on society, any of that. We\u2019re strictly talking about one secular, empirical, legal, historical, value-neutral question: whether the Constitution contains a right to it. Not whether one should be there, not whether to amend it to put one there, but <em>whether someone else put one there<\/em> when writing any part of it. That\u2019s it.<\/p>\n<p>And the <a href=\"http:\/\/liveaction.org\/blog\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">objective, inarguable truth<\/a> (you don\u2019t have to believe us on that, pro-aborts; believe <a href=\"\/news\/justice-scalias-refresher-on-constitutional-originalism\/\">scholars who agree with you that abortion \u201crights\u201d are a good thing<\/a>) is that the \u201cright to choose\u201d simply <em>isn\u2019t there<\/em>. Not in the text, not in the amendments, not in the ratification debates, not even in the \u201cpenumbras\u201d (because the penumbras are imaginary).<\/p>\n<p>So really, if the Supreme Court does end up overturning <em>Roe<\/em> in the not-too-distant future, abortion advocates will have no legitimate grounds to object\u2014unless they want to openly admit that they believe in abusing the law to get the outcomes they want.<\/p>\n<p>If <em>Roe<\/em> falls, America could be on track to answer two vitally important abortion questions: whether America can survive without abortion, and whether the abortion movement can live under a Constitution.<\/p>\n<p>Pro-lifers already know the answer to the first question, but the jury&#8217;s still out on the second one.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the wake of pro-lifers retaking the White House and keeping Congress, abortion advocates fear it\u2019s only a matter of time before they take over the remaining part of the federal government, the Supreme Court\u2014and that with it, Roe v.
