{"id":155525,"date":"2016-10-28T12:30:38","date_gmt":"2016-10-28T16:30:38","guid":{"rendered":"\/news\/?p=155525"},"modified":"2016-10-28T20:10:20","modified_gmt":"2016-10-29T00:10:20","slug":"for-25-years-justice-clarence-thomas-has-defended-life-and-the-constitution","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/for-25-years-justice-clarence-thomas-has-defended-life-and-the-constitution\/","title":{"rendered":"For 25 years, Justice Clarence Thomas has defended life and the Constitution"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Twenty-five years ago Sunday, Justice Clarence Thomas <a href=\"http:\/\/dailysignal.com\/2016\/10\/24\/25-years-after-thomas-joins-supreme-court-a-friend-hails-an-american-originalist\/\">took his place<\/a> on the United States Supreme Court. With the <a href=\"\/news\/time-pro-lifers-stand-strong-protecting-scalias-principles\/\">passing of Justice Antonin Scalia in February<\/a>, Thomas is now the most committed champion for the Constitution and the right to life remaining at the top of the federal judiciary.<\/p>\n<p>In 2001, Thomas laid out the essence of his judicial philosophy in a <a href=\"https:\/\/www.aei.org\/publication\/be-not-afraid\/\">speech to the American Enterprise Institute<\/a>. He started with a simple truth: that while \u201creasonable minds often differ\u201d on the exact meaning of certain constitutional provisions, \u201cthat does not mean that there is no correct answer, that there are no clear, eternal principles recognized and put into motion by our founding documents [\u2026] The law is not a matter of purely personal opinion.\u201d<\/p>\n<p>From these starting principles, there was only one conclusion Thomas could draw about the <a href=\"\/news\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">raw exercise of judicial malpractice that is legalized abortion-on-demand<\/a>.<\/p>\n<p>In 1992\u2019s<em> <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/505\/833\">Planned Parenthood v. Casey<\/a><\/em>, Thomas joined Chief Justice William Rehnquist\u2019s dissenting opinion \u201cthat Roe was wrongly decided, and that it can and should be overruled consistently with our traditional approach to stare decisis in constitutional cases, as well as Scalia\u2019s opinion \u201cthat a woman&#8217;s decision to abort her unborn child is not a constitutionally protected \u2018liberty,\u2019 because (1) the Constitution says absolutely nothing about it, and (2) the longstanding traditions of American society have permitted it to be legally proscribed.\u201d<\/p>\n<p>In 2000\u2019s <em><a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/99-830.ZS.html\">Stenberg v. Carhart<\/a><\/em>\u00a0ruling upholding the \u201cright\u201d to partial-birth abortion, Thomas wrote a dissenting opinion blasting the majority for not only disregarding the Constitution\u2019s plain meaning, but for interpreting the <a href=\"\/news\/abortion-advocate-hysteria-after-oreilly-calls-out-health-exception-abortion-loophole\/\">fraudulent &#8220;health exceptions&#8221; loophole<\/a> even more broadly than <em>Casey<\/em> itself required:<\/p>\n<blockquote><p>In effect, no regulation of abortion procedures is permitted because there will always be some support for a procedure and there will always be some doctors who conclude that the procedure is preferable. If Nebraska reenacts its partial birth abortion ban with a health exception, the State will not be able to prevent physicians like Dr. Carhart from using partial birth abortion as a routine abortion procedure [\u2026] The majority\u2019s insistence on a health exception is a fig leaf barely covering its hostility to any abortion regulation by the States\u2013a hostility that Casey purported to reject.<\/p><\/blockquote>\n<p>He also shamed the majority for misrepresenting what partial-birth abortion really is:<\/p>\n<blockquote><p>In the almost 30 years since <em>Roe<\/em>, this Court has never described the various methods of aborting a second- or third-trimester fetus. From reading the majority\u2019s sanitized description, one would think that this case involves state regulation of a widely accepted routine medical procedure. Nothing could be further from the truth. The most widely used method of abortion during this stage of pregnancy is so gruesome that its use can be traumatic even for the physicians and medical staff who perform it.<\/p><\/blockquote>\n<p>In 2007\u2019s <em><a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/05-380.ZS.html\">Gonzales v. Carhart<\/a><\/em>, which finally upheld the federal partial-birth abortion ban, Thomas wrote a concurring opinion that affirmed the majority\u2019s judgment, but reiterated his contention that the entire judicial regime propping up the \u201cright to choose\u201d needs to go: \u201cthe Court\u2019s abortion jurisprudence, including <em>Casey<\/em> and <em>Roe v. Wade<\/em>, 410 U. S. 113 (1973), has no basis in the Constitution.\u201d<\/p>\n<p>He also, of course, voted with the majority in 2014\u2019s <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/13-354\">Burwell v. Hobby Lobby<\/a><\/em> to uphold private entities\u2019 constitutional right <a href=\"\/news\/ginsburgs-atrocious-hobby-lobby-analysis-draws-a-deluded-crowd\/\">to not provide abortifacient drugs against their will<\/a>.<\/p>\n<p>Most recently, Thomas <a href=\"\/news\/pro-abortion-analyst-utterly-fails-to-discredit-clarence-thomass-texas-dissent\/\">powerfully dissented<\/a> from the Supreme Court\u2019s <em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/15pdf\/15-274_p8k0.pdf\">Whole Woman&#8217;s Health v. Hellerstedt<\/a><\/em>, which all but eviscerated states\u2019 rights to place basic health and safety regulations on abortion facilities. He chastised the majority for \u201csecond-guessing medical evidence and making its own assessments of \u2018quality of care\u2019 issues,\u201d thereby \u201creappoint[ing] this Court as \u2018the country\u2019s ex officio medical board.&#8221;<\/p>\n<p>He stated the high court used\u00a0\u201cempty words\u201d to impose its will by \u201cjudicial fiat,\u201d \u201ctransform[ing] judicially created rights like the right to abortion into preferred constitutional rights, while disfavoring many of the rights actually enumerated in the Constitution\u201d and \u201cusing \u2018made-up tests\u2019 to \u2018displace longstanding national traditions as the primary determinant of what the Constitution means.\u2019\u201d<\/p>\n<p>Thomas\u00a0boiled down the essence of the problem with a grim warning for the nation:<\/p>\n<blockquote><p>Today\u2019s decision will prompt some to claim victory, just as it will stiffen opponents\u2019 will to object. But the entire Nation has lost something essential. The majority\u2019s embrace of a jurisprudence of rights-specific exceptions and balancing tests is \u2018a regrettable concession of defeat\u2014an acknowledgement that we have passed the point where \u201claw,\u201d properly speaking, has any further application.<\/p><\/blockquote>\n<p>Thomas\u00a0has long held to the original intent of\u00a0the Constitution:<\/p>\n<blockquote><p>When interpreting the Constitution and statutes, judges should seek the original understanding of the provision\u2019s text, if the meaning of that text is not readily apparent.<\/p>\n<p>This approach works in several ways to reduce judicial discretion and to maintain judicial impartiality. First, by tethering their analysis to the understanding of those who drafted and ratified the text, modern judges are prevented from substituting their own preferences for the Constitution.<\/p>\n<p>Second, it places the authority for creating the legal rules in the hands of the people and their representatives, rather than in the hands of the judiciary. The Constitution means what the delegates of the Philadelphia Convention and of the state ratifying conventions understood it to mean; not what we judges think it should mean.<\/p>\n<p>Third, this approach recognizes the basic principle of a written Constitution. \u201cWe the people\u201d adopted a written Constitution precisely because it has a fixed meaning, a meaning that does not change. Otherwise we would have adopted the British approach of an unwritten, evolving constitution. Aside from amendment according to Article V, the Constitution\u2019s meaning cannot be updated, or changed, or altered by the Supreme Court, the Congress, or the President.<\/p><\/blockquote>\n<p>This is only legitimate way to operate a judiciary in a governing system like America\u2019s. The entire point of having a written Constitution is that there are things neither a majority nor a minority should be able to do to each other, boundaries enforced by a normally immutable standard that is as divorced as humanly possible from policy preferences or value judgments.<\/p>\n<p>The fact that\u00a0abortion advocates, however,\u00a0<a href=\"\/news\/hillary-likes-idea-of-supreme-court-justice-obama\/\">lay out a judicial philosophy<\/a> fixated entirely on subjective value judgments is their first tell that they only believe in manipulating the law to get whatever outcomes they want.<\/p>\n<p>To decide cases based on anything beyond what Thomas describes above defeats the Supreme Court\u2019s very purpose in impartially holding all parties to that standard. Indeed, the fact that justices didn\u2019t have that discretion was supposed to be why we could trust them with unelected positions and lifetime tenure.<\/p>\n<p>For two-and-a-half decades, Clarence Thomas has been one of the pro-life movement\u2019s truest friends in Washington, D.C. And yet, he\u2019s done so not by imposing his personal will on the law in the opposite direction (i.e., claiming the Constitution <em>forces<\/em> states to <em>ban<\/em> abortion), but by simply following the letter of the law and standing up for our right as Americans to answer the question for ourselves through the democratic process.<\/p>\n<p>Here\u2019s hoping that Clarence Thomas remains on the Supreme Court for years to come.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Twenty-five years ago Sunday, Justice Clarence Thomas took his place on the United States Supreme Court.
