{"id":15190,"date":"2012-04-26T17:48:48","date_gmt":"2012-04-26T21:48:48","guid":{"rendered":"http:\/\/www.www.liveactionnews.org\/?p=15190"},"modified":"2013-04-03T01:06:53","modified_gmt":"2013-04-03T05:06:53","slug":"rethinking-intersection-of-church-state-right-to-life","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/rethinking-intersection-of-church-state-right-to-life\/","title":{"rendered":"Rethinking the intersection of church, state, and the right to life"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>When pro-aborts can\u2019t win the argument with <a href=\"..\/opinion\/why-viability-is-a-meaningless-standard-for-human-rights\/\">biological shell games<\/a> and <a href=\"..\/opinion\/hypocrisy-alert-pro-abortion-sexist-lectures-pro-life-men-on-how-to-treat-women\/\">character assassination<\/a>, they usually resort to disqualifying pro-life opinions from consideration by <a href=\"..\/investigative\/analysis\/bogus-church-state-ruling-defunds-bishops-aid-to-sex-trafficking-victims\/\">labeling them violations<\/a> of America\u2019s separation of church and state. So it\u2019s worth spending some time on a broader look at the way abortion politics intertwines with religion.<\/p>\n<p>Contrary to the insistence of abortion defenders, the case against abortion is <em>not<\/em> exclusively theological. It has two core factors: the empirical observation that <a href=\"http:\/\/rightcal.blogspot.com\/2011\/07\/indisputable-fact-life-begins-at.html\">individual human life begins at fertilization<\/a>, and the moral\/philosophical proposition that all human beings have an equal claim to live.<\/p>\n<p>Clearly, the former point has nothing to do with religion. Admitting that zygotes, embryos, and fetuses are live human beings is simple biology. If protecting the right to life after birth isn\u2019t \u201cimposing religion,\u201d then neither is concluding that such shared humanity entitles the pre-born to be included in that same protection. Indeed, pro-lifers are just advocating for a broader, more consistent application of the general right-to-life principle the rest of society already accepts, albeit selectively.<\/p>\n<p>However, we\u2019d be lying if we said there was <em>no<\/em> religious component to the pro-life cause. Many pro-lifers are driven to get involved because God <a href=\"http:\/\/bible.cc\/exodus\/20-13.htm\">commands<\/a>, \u201cThou shalt not kill,\u201d and because <a href=\"http:\/\/www.christiananswers.net\/q-aig\/aig-bibleandabortion.html\">the Bible&#8217;s teachings<\/a> inform them that our souls &#8211; the divine spark that makes us sacred, gives us our identity, and sets us apart from the rest of the animal kingdom &#8211; exist in our bodies from conception onward, meaning that abortion destroys someone who is every bit as worthy of love and respect as everyone else.<\/p>\n<p>Does acting on that conviction violate the First Amendment? Not at all. First, the law regulates only the <em>actions<\/em> <em>of government<\/em>, not the motives of people who vote on them. I could vote for a certain policy for any reason &#8211; because I read a study supporting it, because I think God wants it that way, or because I had a dream where Bugs Bunny promised to give me a million dollars in return &#8211; and the policy itself would still be perfectly constitutional, as long as the Constitution allowed it. And contrary to the <a href=\"..\/opinion\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">Supreme Court&#8217;s indefensible abortion precedent<\/a>, the Constitution most certainly allows states to ban abortion, since the <a href=\"http:\/\/www.law.cornell.edu\/constitution\/tenth_amendment\">Tenth Amendment<\/a> reserves for the states and the people all powers not expressly delegated to the federal government, and nothing else in the Constitution recognizes abortion \u201crights.\u201d (Admittedly, whether Congress has the power to do so federally is <a href=\"http:\/\/liveaction.org\/blog\/is-abortion-a-state-or-federal-issue\/\">a little trickier<\/a>, but that dispute concerns enumerated powers and the extent of the Fourteenth Amendment; it has nothing to do with religion.)<\/p>\n<p>Second, the foundation and purpose of American law aren\u2019t quite as secular as pro-aborts would have you believe. The United States\u2019 mission statement, the <a href=\"http:\/\/www.ushistory.org\/declaration\/document\/\">Declaration of Independence<\/a>, asserts the nation\u2019s right to a \u201cseparate and equal station\u201d bestowed by the \u201cLaws of Nature and of Nature\u2019s God,\u201d and proclaims that \u201c[g]overnments are instituted among men\u201d for the express purpose of securing the unalienable rights men are \u201cendowed by their Creator with.\u201d The Creator has a similarly prominent role in the works of <a href=\"http:\/\/www.constitution.org\/jl\/2ndtr02.htm\">John Locke<\/a> and <a href=\"http:\/\/www.blackstoneinstitute.org\/sirwilliamblackstone.html\">William Blackstone<\/a>, two of the Founding\u2019s most important philosophical influences. <a href=\"http:\/\/avalon.law.yale.edu\/18th_century\/washing.asp\">George Washington<\/a>, <a href=\"http:\/\/www.founding.com\/founders_library\/pageID.2144\/default.asp\">John Adams<\/a>, <a href=\"http:\/\/www.beliefnet.com\/resourcelib\/docs\/8\/Letter_from_James_Madison_to_Frederick_Beasley_1.html\">James Madison<\/a>, <a href=\"http:\/\/books.google.com\/books?id=VJYoAQAAIAAJ&amp;pg=PA61&amp;lpg=PA61&amp;dq=You+would+be+convinced+that+natural+liberty+is+a+gift+of+the+beneficent+Creator+to+the+whole+human+race,+and+that+civil+liberty+is+founded+in+that,+and+cannot+be+wrested+from+any+people+without+the+most+manifest+violation+of+justice.&amp;source=bl&amp;ots=gxqDIFirAQ&amp;sig=9I-s-SEwKpiGYNknyW8lfhud6YY&amp;hl=en&amp;sa=X&amp;ei=iz-YT5TaOMi42wXN8bmxBw&amp;ved=0CB8Q6AEwAA#v=onepage&amp;q=You%20would%20be%20convinced%20that%20natural%20liberty%20is%20a%20gift%20of%20the%20beneficent%20Creator%20to%20the%20whole%20human%20race%2C%20and%20that%20civil%20liberty%20is%20founded%20in%20that%2C%20and%20cannot%20be%20wrested%20from%20any%20people%20without%20the%20most%20manifest%20violation%20of%20justice.&amp;f=false\">Alexander Hamilton<\/a>, and even the less orthodox <a href=\"http:\/\/www.monticello.org\/site\/jefferson\/quotations-jefferson-memorial#Panel_Three\">Thomas Jefferson<\/a> and <a href=\"http:\/\/americanrhetoric.com\/speeches\/benfranklin.htm\">Benjamin Franklin<\/a> all perceived that liberty is deeply intertwined with man\u2019s status as a divine creation.<\/p>\n<p>The inescapable conclusion is that there\u2019s one particular religious value that America <em>does<\/em> impose: the view that human life is sacred. Though the rationale may have been buried and forgotten over the years, government is imposing this religious value every time a police officer stops a mugging, every time a murderer is imprisoned, every time stolen property is returned &#8211; in short, every time the government steps in to prevent or rectify one person\u2019s decision to trespass against the sanctity of another.<\/p>\n<p>The purpose of the <a href=\"http:\/\/www.law.cornell.edu\/constitution\/billofrights#amendmenti\">First Amendment<\/a> isn\u2019t to ensure that God and government <em>never<\/em> intersect, but to preserve liberty in all matters pertaining to man\u2019s freedom of thought and conscience, and to his personal relationship (or lack thereof) with God.
