Beauty wasn\u2019t exactly the place to go for deep political-constitutional analysis, Jennifer Gerson Uffalussy (a <a href=\"\/news\/257-media-outlets-and-journalists-awarded-by-planned-parenthood\/\">recipient of Planned Parenthood&#8217;s &#8220;Media Excellence&#8221; award<\/a> for pro-abortion propaganda such as <a href=\"\/news\/glamour-lies-to-public-about-plan-b-abortifacient-nature\/\">deceiving <em>Glamour <\/em>readers about Plan B&#8217;s abortifacient capacity<\/a>) has one.<\/p>\n<p>She <a href=\"https:\/\/www.yahoo.com\/beauty\/debate-explainer-heres-what-could-happen-to-180647810.html\">writes a \u201cDebate Explainer\u201d about<\/a> \u201cWhat Could Happen to Abortion, Birth Control if Trump Becomes President,\u201d but all she really explains is that she doesn\u2019t understand what laws actually do.<\/p>\n<div class=\"ArticleAd1\">\n<p><!-- \/1011927\/LAN_300_by_250_top_article --><\/p>\n<div id=\"div-gpt-ad-1473179053567-0\" class=\"ArticleAd1a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179053567-0'); });\n<\/script><\/div>\n<\/div>\n<p>Uffalussy specifically attacks Trump\u2019s running mate, Indiana Governor Mike Pence, as \u201cthe man who <a href=\"http:\/\/www.nytimes.com\/2016\/03\/25\/us\/indiana-governor-mike-pence-signs-abortion-bill.html\">signed a state law earlier this year that bans abortions<\/a> because a fetus has been diagnosed with a disability or genetic abnormality or because of a fetus\u2019s sex or race\u201d and \u201crequires women to view an ultrasound of their fetus and hear its heartbeat 18 hours before having an abortion performed.\u201d<\/p>\n<p>Why are these horrible things? She doesn\u2019t say; apparently you\u2019re just supposed to assume it all sounds scary (although <a href=\"\/news\/absurd-periods-for-pence-launched-protest-indiana-abortion-law\/\">for the record<\/a>, the law didn\u2019t require that women view the ultrasounds; just that they be presented to them. Yahoo Beauty fact-checking, everyone!).<\/p>\n<blockquote><p>While a member of Congress, <a href=\"http:\/\/www.vox.com\/2016\/7\/14\/12189446\/mike-pence-planned-parenthood\">Pence was the first congressman to introduce a bill to defund Planned Parenthood in 2007<\/a> and <a href=\"https:\/\/www.thenation.com\/article\/mike-pence-is-a-smooth-talking-todd-akin\/\">got onboard the \u201clegitimate rape\u201d bandwagon in an attempt to redefine rape to further ban abortion access<\/a>. Pence <a href=\"http:\/\/www.huffingtonpost.com\/don-c-reed\/personhood-pence-vp-candi_b_12281720.html\">cosponsored a \u201cpersonhood\u201d bill <\/a>during his time in the House \u2014 a measure that, if made into law, would define life as beginning at fertilization and would outlaw all abortion, some forms of contraception, and the practice of in vitro fertilization (IVF), which many people rely on to have children.<\/p><\/blockquote>\n<p>Uffalussy\u2019s source for the charge of redefining rape doesn\u2019t specify which bill they\u2019re talking about (when lying, making it harder to fact-check is a must). But this seems to be a reference to one of several bills over the years that, <em>in the spirit of compromise<\/em>, accepted rape exceptions but <a href=\"https:\/\/www.lifesitenews.com\/opinion\/fact-checking-the-fact-checkers-did-an-abortion-defunding-bill-try-to-redef\">narrowed their application<\/a> to cases of \u201cforcible rape\u201d (as opposed to cases such as statutory rape with a willing partner who cannot legally consent).<\/p>\n<p>Pro-aborts have tried to gin up hysteria about this several times over the years, but the truth is that not only did these bills redefine nothing, but the distinction between \u201cforcible\u201d and \u201cstatutory rape\u201d <a href=\"https:\/\/www.justia.com\/criminal\/docs\/uniform-crime-reporting-handbook\/forcible-rape.html\">was also already an established part of the law<\/a> before pro-lifers came along.<\/p>\n<div class=\"ArticleAd2\">\n<p>As for the \u201cpersonhood\u2019 bill\u201d she\u2019s referring to, it\u2019s actually the Life at Conception Act, which as I\u2019ve <a href=\"\/news\/life-at-conception-act-under-attack-by-the-constitution-center\/\">written about recently<\/a>, wouldn\u2019t do anything about contraception or IVF (which should be obvious since it doesn\u2019t even directly ban abortion).<\/p>\n<blockquote><p>Pence is also the man who, as governor of Indiana, signed into law \u2014 law that was eventually blocked by a federal judge \u2014 a requirement that\u00a0<a href=\"http:\/\/www.vox.com\/2016\/7\/14\/12190380\/mike-pence-trump-vice-president-abortion-funerals-fetuses\">all fetal tissue must be buried or cremated<\/a>, even that resulting from a miscarriage. So yes, Pence tried to ensure that women who had a miscarriage but did not save the fetal tissue and bring it to a hospital for verification and then burial would be criminally charged.<\/p><\/blockquote>\n<p><!-- \/1011927\/LAN_300_BY_250_mid_article --><\/p>\n<div id=\"div-gpt-ad-1473179101244-0\" class=\"ArticleAd2a\"><script>\ngoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1473179101244-0'); });\n<\/script><\/div>\n<\/div>\n<p>As I\u2019ve <a href=\"\/news\/abortion-supporters-attacks-on-pence-follow-same-old-script\/\">covered before<\/a>, this lie is insane even by pro-abortion standards. The <a href=\"https:\/\/iga.in.gov\/static-documents\/5\/1\/b\/5\/51b52d50\/HB1337.05.ENRS.pdf\">bill<\/a> did not require <em>women<\/em> to have or pay for a burial for their aborted babies; it required <em>the abortion facility<\/em> to either bury or cremate the remains unless the mother <em>chooses<\/em> an alternate costlier means of burial. But don\u2019t take my word for it\u2014even Snopes <a href=\"http:\/\/www.snopes.com\/pence-law-forcing-fetus-funerals\/\">acknowledged<\/a> the charge was \u201cmostly false.\u201d<\/p>\n<p>And the new lie about forcing women to save and bring in fetal tissue from miscarriages is hard to square with the opening of the miscarriage section, which makes clear that it\u2019s talking about handling remains \u201cafter a woman has her miscarried fetus expelled or extracted <em>in a health care facility<\/em>\u201d (emphasis added).<\/p>\n<p>In light of all this, I suppose it would be\u00a0unreasonable to expect\u00a0a writer for\u00a0Yahoo! Beauty to know much about <em>Roe v. Wade<\/em>\u00a0either, the\u00a0legal merits of which are so flawed that\u00a0<span class=\"m_-1208499977265121634gmail-s1\"><a href=\"\/news\/justice-scalias-refresher-on-constitutional-originalism\/\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=\/news\/justice-scalias-refresher-on-constitutional-originalism\/&amp;source=gmail&amp;ust=1476377713571000&amp;usg=AFQjCNHxNCiC1yr9yhjjaM6vf-VW31hRhQ\" rel=\"noopener\">many pro-abortion scholars admit it&#8217;s bad law<\/a>. It would be unreasonable to expect such a\u00a0writer to know<\/span>\u00a0that overturning <em>Roe<\/em> could simply restore the <em>right to vote<\/em> on abortion rather than directly ban it. Then again, that also raises the question of why Yahoo! Beauty is\u00a0dabbling in legal commentary to begin with!<\/p>\n<p class=\"m_8529014309425939604gmail-p1\">Uffalussy\u00a0also\u00a0complains that Donald Trump cited abortion as a judicial litmus test and openly supports overturning <em>Roe v. Wade<\/em>. She\u00a0cites and condemns four judges from Trump&#8217;s <a href=\"\/news\/a-pro-life-look-at-donald-trumps-supreme-court-nominees\/\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=\/news\/a-pro-life-look-at-donald-trumps-supreme-court-nominees\/&amp;source=gmail&amp;ust=1476466843241000&amp;usg=AFQjCNEeYt0yVzo_lS_NDPZgOM7uVE31Wg\" rel=\"noopener\"><span class=\"m_8529014309425939604gmail-s1\">list<\/span><\/a> of <span class=\"m_8529014309425939604gmail-s1\"><a href=\"\/news\/trump-releases-another-list-of-judicial-nominees-including-pro-life-mike-lee\/\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=\/news\/trump-releases-another-list-of-judicial-nominees-including-pro-life-mike-lee\/&amp;source=gmail&amp;ust=1476466843241000&amp;usg=AFQjCNEPLP8UHNM-wgzz0sMp-I7Jo0Va7g\" rel=\"noopener\">judicial nominees<\/a>\u00a0<\/span>William Pryor, Steven Colloton, Raymond Gruender, and Neil Gorsuch.<\/p>\n<p class=\"m_8529014309425939604gmail-p2\">But while these judges might be opposed to legal abortion and access to abortifacient birth control\u00a0in their capacities as voters or private citizens, Uffalussy&#8217;s examples of their actions as judges only show them doing one thing: upholding private citizens&#8217; First Amendment right against <a href=\"\/news\/ginsburgs-atrocious-hobby-lobby-analysis-draws-a-deluded-crowd\/\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=\/news\/ginsburgs-atrocious-hobby-lobby-analysis-draws-a-deluded-crowd\/&amp;source=gmail&amp;ust=1476466843241000&amp;usg=AFQjCNFA1sx-KGyPQySJ_JdhSwsTtu4gqA\" rel=\"noopener\"><span class=\"m_8529014309425939604gmail-s1\">coerced participation in or support for practices that violate their religious beliefs<\/span><\/a>. None of the cases Uffalussy cites show any of these judges restricting legal access to contraception (<a href=\"\/news\/pro-abortion-comic-mangles-freedom-by-abusing-the-word-access\/\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=\/news\/pro-abortion-comic-mangles-freedom-by-abusing-the-word-access\/&amp;source=gmail&amp;ust=1476466843242000&amp;usg=AFQjCNHheDyAg2xNb6zyhryLwsNWAhUofQ\" rel=\"noopener\"><span class=\"m_8529014309425939604gmail-s1\">real access, not the Choicespeak hijacking of the word<\/span><\/a>).<\/p>\n<p>As egregious as all of these falsehoods are, ultimately they aren\u2019t the scary part.
