{"id":1025,"date":"2010-06-02T02:50:44","date_gmt":"2010-06-02T07:50:44","guid":{"rendered":"http:\/\/liveaction.org\/blog\/?p=1025"},"modified":"2013-03-29T06:06:07","modified_gmt":"2013-03-29T10:06:07","slug":"nebraska-abortion-legislation","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/nebraska-abortion-legislation\/","title":{"rendered":"Nebraska abortion legislation leads way on sanctity of life, sparks controversy"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>by Stephen Brown<\/p>\n<p>Nebraska, like the world, is polarized on abortion.\u00a0 On one hand, the state is home to Dr. Leroy Carhart, a vocal pro-abortion advocate.\u00a0 He operates <a href=\"http:\/\/www.abortionclinics.org\/\" target=\"_blank\">Abortion &amp; Contraception Clinic of Nebraska<\/a>, which, as his website states, was founded to provide \u201cfirst and second trimester abortions.\u201d\u00a0 On the other hand, however, it\u2019s the state that recently passed groundbreaking legislation regulating abortion, a move that has sparked controversy not only nationwide, but internationally.<\/p>\n<p><a href=\"http:\/\/www.cbsnews.com\/stories\/2010\/04\/13\/national\/main6391141.shtml\" target=\"_blank\">CBS News states<\/a> that both sides of the issue call the bills \u201cfirsts in the country\u201d. Nebraska\u2019s unique unicameral legislature proposed the two bills earlier this year and both passed, becoming law.\u00a0 At least, that is, if the army of opponents allows them to even have a chance at being practiced as law before shutting them down (and subsequently any other states\u2019 similar legislation that may follow Nebraska\u2019s precedent).<\/p>\n<p>One of the major regulations signed into law this April was a state ban on abortions 20 weeks and later.\u00a0 The basis of the law is the belief that fetuses as early as 20 weeks can feel pain.\u00a0 Currently, laws use viability, or when a fetus is able to survive outside the womb, as the determining factor for limits on abortions, which is generally 22-24 weeks, meaning that Nebraska would prohibit abortions 2-4 weeks sooner than the national standard.<\/p>\n<div id=\"attachment_787\" style=\"width: 190px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-787\" decoding=\"async\" loading=\"lazy\" class=\"size-full  wp-image-787\" title=\"20 Week Human Fetus\" alt=\"\" src=\"http:\/\/liveaction.org\/blog\/wp-content\/uploads\/2010\/04\/20-weeks2.jpg\" width=\"180\" height=\"270\" \/><p id=\"caption-attachment-787\" class=\"wp-caption-text\">20 week human fetus.<\/p><\/div>\n<p>The law, scheduled to take effect in October, already has major opposition.\u00a0 CBS News states, \u201cAbortion-rights advocates say that is a clear break with court precedent and it won\u2019t withstand a court challenge.\u201d\u00a0 Dr. Carhart has suggested he might challenge the law, which would shut down his late-term abortion practice, which is one of only a few left nationwide.\u00a0 One such practice in Kansas closed last year when Dr. Tiller, a friend of Carhart\u2019s, was killed by an anti-abortion gunman.\u00a0 Dr. Carhart offered to run the practice in conjunction with his in the Omaha area, but the Tiller family shut down the practice instead.<\/p>\n<p>Another challenger to the law may be the Center for Reproductive Rights, which indicated their group may take legal action.\u00a0 Planned Parenthood and similar organizations also have a vested interest in shutting the legislation down.\u00a0 In Nebraska, abortions have been on a steady decline, dropping from nearly 5,800 abortions in 1985 to under 3,800 in 2005.\u00a0 Further regulations on abortions would significantly affect these groups, not only in the state, but nationally.<\/p>\n<p>The second law requires women to meet with a doctor to determine if they have risk factors for mental or physical problems post-abortion.\u00a0 In a study published by Canada\u2019s Winnipeg Free Press, the University of Manitoba found that nearly half of post-abortive women are plagued with depression and substance abuse.\u00a0 About 25% of abortive women reported having substance addiction issues compared to only 7% of women who had not had a prior abortion.\u00a0 While the study can\u2019t prove that abortions caused the depression, panic attacks, addiction, and other problems, even opponents admitted there is a connection, recommending that women receive counseling prior to making a decision regarding their pregnancies.<\/p>\n<p>The coming months are crucial to the laws\u2019 success and only time will tell if these uniquely pro-life, pro-women\u2019s health, and anti-fetal pain laws will see the light of day.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>by Stephen Brown Nebraska, like the world, is polarized on abortion.\u00a0 On one hand, the state is home to Dr. Leroy Carhart, a vocal pro-abortion advocate.\u00a0 He operates Abortion &amp;
